2013-1243-Order No. 2013-052 Recorded 12/2/2013COUNTY NANCYUBLANKENSHIP,FCOUNTY CLERKpS Q 20IM20 COMMISSIONERS' JOURNAL 12/02/2013 03:31:55 PM REVIEWED 11111111111JI11 11111111111111111 4~~ . 2013-1Z LEGAL C OUNSEL For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Declaring the Results of the Election Held on November 5, 2013 for the Formation of * ORDER NO. 2013-052 the Alfalfa Fire District WHEREAS, an election in Deschutes County, Oregon was held on November 5, 2013 on the measure set forth in Exhibit A, incorporated by herein, concerning the proposed Alfalfa Fire District ("District")-, and WHEREAS, the Deschutes County and Crook County Abstracts of Votes, copies of which are attached as Exhibits B and C, respectively and incorporated by reference herein, show that a majority of those persons voting, voted to approve the measure; and WHEREAS, ORS 198.820(1) requires the Board to canvass the votes and declare the District formed if' the Board determines that the majority of the votes cast were in favor of formation of the District; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1: At the election held in Deschutes County, Oregon on November 5, 2013, as evidenced by the abstract of votes, a copy of which is attached as Exhibit B and incorporated by reference herein, 337 electors cast ballots on the issue of formation of the District, and, of those electors, 235 electors voted YES and 100 voted NO with no over votes and 2 under votes on the measure captioned "TO FORM A FIRE DISTRICT AND ESTABLISH TAX RATE LIMIT", as set forth in the attached Exhibit B, incorporated by reference herein. Section 2: At the election held in Crook County, Oregon on November 5, 2013, as evidenced by the abstract of votes, a copy of which is attached as Exhibit C and incorporated by reference herein, 22 electors cast ballots on the issue of formation of the District, and, of those electors, 16 electors voted YES and 6 voted NO with no over votes and no under votes on the measure captioned "TO FORM A FIRE DISTRICT AND ESTABLISH TAX RATE LIMIT", as set forth in the attached Exhibit C, incorporated by reference herein. Section 3: Because a majority of the electors voting approved the formation of the proposed district, the measure is declared to have passed and the District to be formed. Section 4: The name of the District shall be the Alfalfa Fire District and the boundaries shall be as legally described in Exhibit D and depicted on the map Exhibit E, both exhibits being attached hereto and by this reference incorporated herein. Page 1 of 2 ORDER 2013-052 Section 5: The purpose of the District is to take all necessary and proper steps to organize for rural fire protection for property within the district, enter into mutual aid agreements, apply for grants, train members, educate the public, purchase and maintain necessary equipment, land, and structures as required for operating a fire district and department, and provide emergency medical assistance within the district's boundaries, pursuant to ORS 478. Section 6: The permanent rate limit for operating taxes is $1.75 per $1,000 assessed value for the District for ad valorem taxes pursuant to Section 11, Article 11, Oregon Constitution, is hereby established. Section 7. The County Clerk shall issue certificates of election to the five persons, the number of person equal to the number of board members named in the petition for formation, receiving the highest number of votes. Section 8: The Legal Counsel Department shall cause certified copies of this order be filed with the Deschutes County Clerk and Assessor, the Deschutes County 9-1-1 Service District, the Oregon Department of Revenue and Secretary of State pursuant to ORS 198.780(1) and ORS 308.225. If approved, this measure would authorize the district to tax properties within the district for the above listed services at a maximum permanent tax limit of $1.75 per $1,000 assessed value and is estimated to raise $101,092.00 in operating funds for the District beginning in the.2014-2015 tax year, (Map of the proposed district will accompany the ballots.)
