Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; and,for a portion of the meeting, Chris Doty and George Kolb, Road Department; Peter Russell, Community Development; Laurie Craghead, County Counsel; and media representative Elon Glucklich of The Bulletin. Chair Baney opened the meeting at 1:30 p.m. 1. Recap of Meeting with the Sunriver HOA Board regarding their Input on Boat Ramp Concepts for Harper Bridge. Peter Russell pointed out various features of the area on an oversized map. Harper Bridge has been an issue for some time. He has been working with local citizens and the Marine Board. The Marine Board does not want them even applying for a grant; they have worked on this for a long time and came up with their own ideas on this last year. There is a process if they are to sell property; it would take more than six months. The citizens wanted to form a task force, as they did not respond to how they might come up with their own funds. They need to know the use and size of the boat ramp. They want to know if the County would support a concept that is not eligible for a Marine Board grant. The Sunriver Board would like to have a second launch site on the Deschutes, but this would be a public site. He wants to know how involved the County should be. The grant process is competitive and takes time. They would rather lease the land. Minutes of Board of Commissioners' Work Session Monday, March 24, 2014 Page 1 of 8 The Sunriver preferred design is oriented more to hand-launching, canoes and similar. There is some concern about access onto Spring River Road. The Marine Board was not interested in this concept. A 1908. right of way also complicates matters. It is only sixty feet wide. The Marine Board did some work on the concept of a larger ramp that would accommodate thirteen boat trailers, and this one would have a better chance of getting a grant. Mr. Kropp asked if this would cover just the original work. Mr. Russell said it would not include ongoing maintenance, and would require possibly a 10% grant. Mr. Anderson stated that the by-laws do not allow them to sell land. Mr. Russell stated that this would have to go through the HOA and would take at least six months. This is why they are looking at a long-term lease. The Deschutes River Conservancy is concerned about what might be removed to accommodate this, and other changes. There are some issues with this being near residential areas, and the Marine Board is aware of this. Chair Baney is concerned about managing expectations and having a problem defined for the County to solve. Sunriver Resort has met its land use criteria and there is a small launch. She worries about the community restating a problem and expecting the County to solve it. She would not want to just seek funding or have funding decide what a project looks like. This could create noise for the homeowners and would draw new clients to the area. She feels the Board is being asked to solve something that does not exist. She sees the use there already, but is worried about the concept of the County determining what is eligible. They don't need to solve a problem that the community should. There is a role, but the County did not state it would put in a boat launch. Commissioner DeBone asked where this originated, and still does not have a feel for the whole issue. Who is using the access —tourists or residents. Mr. Russell said there are a fair amount of folks from the area that use what is there. It is not just Sunriver. Crosswater had to put access to the river as a condition, but it is not of great quality. It did not say at what level it had to be. Minutes of Board of Commissioners' Work Session Monday, March 24, 2014 Page 2 of 8 Chair Baney said that some feel Crosswater did not meet its requirements and should have done more. It was too vague, so they did what they had to do on a minimal basis. Mr. Anderson said this started it; however, there was general acknowledgment that the situation at Harper Bridge is unsafe. What drove it forward was a property owner on the west side of the bridge who wanted to develop his property, which is partly wetlands, for an RV park and to solve this issue. The land use law and zoning precluded this type of zoning. As part of this discussion, there were statements that the County shirked its responsibility. CDD analyzed this situation, and if something was done wrong, it was not identifying in more detail what Crosswater was to do. They were basically to provide land and access. The Board had CDD convene a committee to look at alternatives to Harper Bridge. The USFS and ODF&W were involved along with County staff and citizens. About half-dozen alternatives were examined, and all had challenges. They thought that if something could be worked out with SROA, it would be the most practical way to go. He is not aware of any one group that is pushing for the County to fix this. The County agreed to help find a solution but he does not feel they are under an obligation to do so. Commissioner DeBone said his vision is not motorized boats from this location since it is residential. A smaller version would be better. Ingress and egress is a concern. He envisions a dozen parking spaces. Mr. Russell said that it has to be paved under CDD code. Mr. Anderson added that there was no expectation. that the County would provide funding, so the Marine Board was brought in. The HOA is not keen on motorized boats either, but the Marine Board does not want to fund for anything less. Mr. Russell said that ODF&W said they are hearing from citizens who want to see more motorized access. Chair Baney stated that this impacts an area and those people are not saying this is a problem and a solution is needed. Mr. Russell stated there is no one, single answer. They could close the location and issue citations. Chair Baney asked if this would be just one of many launches that people want to see installed. Mr. Russell said there is no crash history for that site but this seems to be the overall view, that it is a dangerous situation especially in the summer. Minutes of Board of Commissioners' Work Session Monday, March 24, 2014 Page 3 of 8 Commissioner DeBone said that the La Pine Park & Recreation District pulled their idea to annex some areas, and perhaps this will have something to do with it in the future. Laurie Craghead said that the County has some parcels that are designated parks, but not in this particular area. Mr. Russell said the first question is whether the County should try to solve this; and whether the solution needs to have Oregon Marine Board funding tied to it. Commissioner Unger does not feel that the Oregon Marine Board funding aspect is needed. He is not sure they should have motorized boats there. Commissioner DeBone feels the same. Mr. Russell said there is a 10-mile per hour limit there anyway. Most people would go upstream. Mr. Anderson said it would likely be mostly trolling boats. Commissioner Unger is concerned about the safety issue of the road and traffic. Chair Baney wants to know there is a basis for this. Commissioner Unger said. that ODOT would have fatality or crash reports on the site. However, he is concerned about the attraction and the uncontrolled nature of the use there. Commissioner DeBone said if they put in any kind of pavement, the location would quickly be full. It will be gridlock out to the road. Commissioner Unger noted that this would indicate a demand. Chair Baney asked about the cost of maintaining it. Mr. Russell said the task force could come up with no other locations. This has the least amount of challenges compared to the other ideas. They are trying to get it through soon because of the potential spotted frog situation. Mr. Russell said that the basic costs might be about $100,000 or more. Sunriver already owns this land but wants the County to lease it for this purpose. Commissioner Unger said that groups want the County to solve a local problem, but the locals need to do more. They could collect a fee to cover maintenance. Commissioner DeBone feels that Sunriver will want control of the land and the County does not want to be that involved. It is a gathering area by default. He likes the river trail concept overall, with access points. This is one part of a river system. They may want to add a member of La Pine Park & Recreation to the task force. Chair Baney observed this shows that the County is aware of the situation. They could put up no parking signs. Mr. Kolb said that part of the land use for Crosswater allowed for parking there and boat access. Chair Baney would like to spread the responsibility. Mr. Kolb stated that there is a USFS day use area but it badly needs improvement. It was on the list of alternatives. Mr. Anderson said it is much more remote. Commissioner DeBone asked who the equipment rental folks are there. Perhaps COVA could deal with this at some level since it is tourism related. Mr. Russell has not spoken to Sunriver Resort to see if they want to be involved, but this was suggested by the SROA. Chair Baney feels they should push usage to the designated boat ramp. Mr. Kolb said there is an issue with fencing on the Sunriver side already. Mr. Kropp said the Board does not want to lease the property, and this is a start. The group will have to consider other options. Mr. Doty said there are several locations in the County where river access creates safety concerns. People expect it to be available after using it for decades. Mr. Anderson asked if the task force was looking at the public safety part or just a boat launch, there or in other places. Mr. Russell said the task force wants it to be there so don't really ant to consider the broader issue. The County is not interested in leasing land from Sunriver. They want a community solution and perhaps they can broaden the task force to seek out ideas and funding solutions. Mr. Kolb stated that Sunriver cut off public access at their marina, and this has caused some problems. This will drive more people to Harper Bridge. Commissioner DeBone wants to know where the other public access points are. Mr. Kolb said La Pine Park & Recreation would have added land and looked at further public access points. There are not that many places at this time. Mr. Russell said it is part of the federal wild and scenic rivers umbrella, which complicates things even more. Mr. Russell will advise the group that the County does not want to lease this land, and feels the group should add others to consider this overall issue. Executive Session, under ORS 192.660(2)(h), pending or threatened litigation and ORS 192.660(2)(c), real property negotiations. UNGER: Move approval of the settlement agreement involving Rocky Mountain Products as discussed in executive session, allowing for County Administrator's signature. DEBONE: Second. VOTE: UNGER: Yes. DEBONE: Yes. BANEY: Chair votes yes. OSU Cascades has asked for a letter of support, showing the County is behind the location they have chosen. In theory, they need to meet Code requirements. Chair Baney said the County supports the university but doesn't know if they can mitigate traffic, housing, etc. This is up to the City of Bend as to whether that location works. Commissioner Unger wants to see this move forward and the Board should help if they can. The opposing group is using the media to make it more difficult. Mr. Anderson said that each Commissioner could also respond individually and personally. Chair Baney does not support this since it involves a land use action. They can provide a letter in support of OSU in general, but can't be specific about the site. Regarding the work session on April 7, Mr. Anderson asked if they want to start the meeting later or cancel it due to scheduling conflicts. Commissioner Unger stated he has a quarterly workforce meeting that he needs to attend. There is also the day of the crime victims' event. He wants to check further to see if he is free part of that afternoon. Mr. Anderson asked if the Board has agenda items for the upcoming joint meeting with the Sisters City Council, such as the school-based health center project or Sisters road construction. The Commissioners felt it was not necessary to meet to be updated on these, so they should cancel the meeting. Minutes of Board of Commissioners' Work Session Monday, March 24, 2014 Page 6 of 8 Concerning Fair Board member recruitment, Mr. Anderson asked if the Board wants to ask the Fair Board to conduct its own interviews and bring back recommendations. Commissioner Unger would like representation to be more Countywide. Chair Baney stated that this was solicited in the past, but most come from Redmond or Tumalo. The Board has interviewed these applicants previously. The goal is to have a broad composition that encompasses more than just the Redmond area. She does not think it is too late to include this provision. Commissioner Unger asked if there are by-laws governing this. Mr. Anderson feels that they might have missed the opportunity to do this, but will confer with Dan Despotopulos to see if there are some unforeseen problems with this process. Mr. Kropp said Mark Pilliod's last day is April 11. He does not want a big event for his retirement, so an open house has been suggested. Mr. Kropp handed out for the Board to review a recommended budget statement and a list of committees in which the Board is involved, for use in the County mission statement. Commissioner Unger explained that the Tumalo Community Association, which has been meeting regularly and doing small projects around the town, contacted him. They have been working on signage. Another group wanted to be heard as well, so Commissioner Unger suggested they combined forces. One person who does not know what to do is now running it and is trying to undo what has been accomplished. The businesses there sent him a petition, as they want the signage. They have a voice of their own. He wants to help the community manage this situation. Chair Baney said she has talked to various entities and persons about signage and other issues there for quite a while. Commissioner Unger asked what the County's responsibility should be, since this is part of the County and they are the governing body. Chair Baney does not feel that they have to answer for only the association there. Commissioner Unger stated that the association is not well structured, either. There should be another way for all to have a voice. Commissioner Unger is not sure this would be successful since they would need a big room due to the various interests. Chair Baney would like to support the business people who want travelers to stop, and not just have this as a wide spot in the highway. They want to signify that they are a community. She asked if the sign issue is an ODOT issue. Mr. Anderson said that it is not whether they can have signs, but what they look like. The businesses want something more than the typical sign. ODOT should do the construction part anyway. Chair Baney feels since they have the application, they should be allowed to move forward; and that the sign itself is something the community needs to decide. There are two undeveloped launch areas, one on the southeast quadrant where Spring River Road crosses the Deschutes River and the other on the northeast quadrant. The northeast quadrant is more heavily used and includes a 1908 public right of way related to an earlier bridge. Spring River Road had an average daily traffic (ADT) of 2,507 vehicles in the most recently counted year (2011). 41 a u" mzc"edh 0.N # , T fly J .. !de), '. 14. p Y -r a Harper Bridge Recap of recent meetings with Oregon State Marine Board and Sunriver Board Planning and Road Department staff along with staff from Sunriver Planning and Public Works met on Feb. 19, 2014, in Salem with staff from the Oregon Marine Board (OMB). Among the Quality Services Performed with Pride • OMB staff were the agency's grant coordinator, the boat facilities program director and deputy director, and a senior engineer for facilities. The point of the meeting was to review two design concepts; one a smaller ramp designed by Sunriver and oriented more toward hand-launched craft and a second larger design done by OMB a few year earlier. (See attached conceptual drawings.) In the past, the County has indicated any boat ramp improvements would need to be funded primarily through the OMB grant program. The next grant cycle begins in July 2015. In a candid discussion, OMP indicated the Sunriver concept would have no chance of being funded while the OMB design would be eligible for this extremely competitive grant program. Staff relayed this to the Board of County Commissioners (BOCC) at a Feb. 24 work session where staff was directed to recap the OMB discussion with the Sunriver Homeowners Board for its response and thoughts. On March 14, Planning and Road Department staff presented to the Sunriver Board at a work session the two concepts and recounted the OMB discussion. While County staff sought some indication of the Sunriver Board's preference, the Sunriver Board declined. After further discussion, the Sunriver Board expressed its preference for convening a task force, (they invited County staff to join), that would bring them up to speed and explain in greater detail the following: • expected usage of the boat ramp • implications of a shift in the site's use from non-motorized to motorized traffic • details on construction, operations, and maintenance of the site • whether the County would support a concept that would not be eligible for OMB grant funds • ability to minimize adverse effects to Sunriver residences adjacent to Harper Bridge Additionally, the Sunriver Board was interested, regardless if the OMB design was used or not, in pursuing a second boat ramp that would be internal to Sunriver and for hand-launched craft only. Key questions for BOCC's consideration Staff has heard not only from the OMB, Sunriver Board and staff, but also members of the Upper Deschutes River Coalition regarding a potential boat ramp at Harper Bridge. Based on those conversations, staff believes the Harper Bridge issue boils down to these threshold questions. • Whether a boat ramp must be eligible for OMB grant funding? • Comfort level with potentially missing 2015 OMB grant funding calendar? • Thoughts on Sunriver Board preferring to lease land for Harper Bridge Boat Ramp? Here is what I plan to send to Jim: I grew up in a small town where the university was adjacent to the main street in River Falls, Wisconsin. This connection was critical for local businesses and created an atmosphere of vitality for the entire town. The University location also served as a constant reminder to all young people of higher education and its importance. I attended that same small university before transferring to the University of Utah to complete my education. However, I always missed my small town urban university experience for my ability to walk to and from everything I needed. My urban university experience is something I hope all Bend OSU-Cascades young people can enjoy for years to come. Please keep the OSU- Cascades in its current proposed location on Bend's Westside for the local businesses,students and our community. The Board's duties include executive,judicial(quasi-judicial)and legislative authority over policy matters of countywide concern.Adoption of the County budget is also one of the Board's responsibilities.
