Authorizes issuance of lottery bonds to finance projects, related to removal of Mirror Pond dam,
for purpose of improving habitat for fish and wildlife, restoring and protecting parks and promoting
economic development.
1 A BILL FOR AN ACT
2 Relating to funding for Mirror Pond dam removal,
3 Be It Enacted by the People of the State of Oregon:
4 SECTION 1. (1) In addition to and not in lieu of the budget authorization to issue lottery
5 bonds under ORS 286A.035, for the biennium beginning July 1, 2015, at the request of the
6 Oregon Department of Administrative Services, after the department consults with the Bend
7 Park and Recreation District, the State Treasurer is authorized to issue lottery bonds pur-
8 suant to ORS 286A.560 to 286A-585 in an amount that produces $5 million in net proceeds and
9 interest earnings for the purposes described in subsection (2) of this section, plus an addi-
10 tional amount estimated by the State Treasurer to be necessary to pay bond-related costs.
11 (2) Net proceeds of lottery bonds issued under this section and interest earnings in an
12 amount sufficient to provide $5 million must be transferred to the department to provide a
13 grant to the Bend Park and Recreation District. The district shall use the grant to fund
14 projects related to the removal of the Mirror Pond dam, including:
15 (a) The establishment of fish passage, the removal of sediment and the improvement of
16 stream beds, wetlands and the ecosystem.
17 (b) Construction of one or more parks and recreational infrastructure at Mirror Pond
18 and the former dam property.
19 (c) Promotion of economic development along the east bank of Mirror Pond and the for-
20 mer dam property.
21 (3) The Legislative Assembly finds that the use of lottery bond proceeds pursuant to this
22 section will create jobs, further economic development, finance public education or restore
23 and protect parks, beaches,watersheds and native fish and wildlife, and is authorized based
24 on the following findings:
25 (a) Fish passage and other stream and ecosystem improvements protect watersheds and
26 native fish and wildlife.
27 (b) Development of one or more new parks and recreational infrastructure restores and
28 protects parks.
29 (c) The development of recreational infrastructure creates jobs and provides
30 infrastructure that is essential to support the development of economic opportunities.

A BILL FOR AN ACT
2 Relating to energy.
3 Be It Enacted by the People of the State of Oregon:
4 SECTION 1. (1) The Biomass Heat for Rural Schools Fund is established in the State
5 Treasury, separate and distinct from the General Fund. Interest earned by the Biomass Heat
6 for Rural Schools Fund shall be credited to the fund. Moneys in the fund are continuously
7 appropriated to the State Department of Energy to support the grant and loan program es-
8 tablished under section 2 of this 2015 Act.
9 (2) The department may accept grants, donations, contributions or gifts from any source
10 for deposit in the Biomass Heat for Rural Schools Fund.
11 (3) The Biomass Heat for Rural Schools Fund shall consist of:
12 (a) Moneys accepted by the department pursuant to subsection (2) of this section.
13 (b) All other moneys received for the fund from any other source.
14 SECTION 2. (1)The State Department of Energy shall establish a grant and loan program
15 to provide grants and loans that promote the replacement of low-efficiency fossil fuel based
16 heating systems with biomass heating systems in rural public schools with any grades from
17 kindergarten through grade 12.
18 (2) The department shall design and award the grants and loans specified in subsection
19 (1) of this section as follows:
20 (a) In the first phase, for conducting feasibility studies for replacing fossil fuel based
21 heating systems with biomass heating systems in rural public schools.
22 (b) In the second phase, to plan and fund capital construction costs related to replacing
23 fossil fuel based heating systems with biomass heating systems in rural public schools.
24 (3) The Director of the State Department of Energy shall adopt rules to carry out the
25 provisions of this section that:
26 (a) Direct the department to analyze the cost to rural public schools of operating an ex-
27 fisting fossil fuel based heating system as compared to the cost of operating an installed
28 biomass heating system;
29 (b) Establish criteria for designing and awarding grants and loans under this section;
30 (c) Prohibit receipt of grant funds to fund annual operating costs of heating systems that

Deschutes County Opposes SB 359.
• SB 359 limits land use appeals fees to$1000 or 10%of the application fee,whatever is
LESS. With complicated appeals,the county's expenses can run over$5,000.
• SB 359 would force counties to either give up their current process, use general fund
dollars to cover the extra costs, raise fees from other services, or pass the appeals on to
LUBA and lose local control:
o Forcing counties to give up their current process flies in the face of local
decision making and local control. The state chose to give the counties this
option and SB 359 would take that away.
o Shifting funds from general fund only serves to short other programs at a time when
many counties are in fiscal distress and only have discretion over a small fraction of
their spending. When there is talk about closing fails, underfunded mental and public
health programs and losing sheriff's deputies,this adds to the ongoing burden of county
budgets.
o Land use appeal expenses need to be covered somehow. If not from appeal fees or
general funds,then the county will need to turn to raising other fees to cover these
costs.
o Passing the appeal to LUBA again denies the county the right for local control. In
addition,the fees that LUBA charges for an appeal does not cover the state's
cost;therefore SB 359 will shift more costs to the state.
o If Counties choose this option they lose control over local decision making, but
will still bear costs in defending the earlier land use decision.

PROPOSED AMENDMENTS TO
SENATE BILL 824
1 On page 1 of the printed bill, line 2, after "emissions;" delete the rest of
2 the line and line 3 and insert "and declaring an emergency.".
3 Delete lines 4 through 27 and insert:
4 "Whereas exposure to diesel particulate pollution causes myriad health
5 effects, including the exacerbation of asthma symptoms and early death from
6 heart disease and various cancers; and
7 "Whereas children are especially vulnerable to the negative health effects
8 of diesel particulate pollution because their lungs are still in the develop-
s mental phase and they breathe, on average, 50 percent more air per pound
is of body weight than adults; and
11 "Whereas in 2007 the Environmental Quality Commission established a
12 goal to reduce excess lifetime risk of cancer due to exposure to diesel engine
13 emissions to no more than one case per million individuals by 2017, but
14 Oregon is far from achieving that target; and
15 "Whereas the health impacts and premature deaths caused by diesel
16 particulate pollution have an annual economic impact of more than $3 billion
17 in this state; and
18 "Whereas 17 Oregon counties have ambient levels of diesel particulate
19 pollution that are considered harmful to health; and
20 "Whereas new diesel engines and older diesel engines retrofitted with
21 particulate filters can reduce diesel particulates by up to 95 percent as
22 compared to diesel particulate emissions from older, dirty diesel engines that

1 are not retrofitted; and
2 "Whereas the attrition rate of older, dirty diesel engines without retrofits
3 is too slow to adequately curb emissions in a timely manner and earlier
4 adoption of the new federal diesel standards will protect public health; and
5 "Whereas a strategy to shorten the timeline for adoption of the new fed-
6 eral diesel standards requires a combination of regulations and incentives;
7 and
8 "Whereas the problem of diesel particulate pollution in this state is
9 exacerbated when engines are allowed to idle unnecessarily; and
10 "Whereas despite state statutory requirements to limit the risk from die-
11 sel particulate pollution to children by 2013, only 42 percent of school buses
12 are using clean diesel technology in Oregon today; now, therefore,".
13 On page 2, delete lines 2 through 45 and delete pages 3 through 7 and
14 insert:
15 "SECTION 1. (1) The Task Force to Investigate a Clean Diesel Pro-
16 gram is established, consisting of 19 members appointed as follows:
17 "(a) The President of the Senate shall appoint two members from
18 among members of the Senate.
19 "(b) The Speaker of the House of Representatives shall appoint two
20 members from among members of the House of Representatives.
21 "(c) The Governor shall appoint 15 members as follows:
22 "(A) One member representing cities or counties.
23 "(B) One member representing the Department of Transportation.
24 "(C) One member representing large trucking companies.
25 "(D) One member representing small trucking companies.
26 "(E) One member representing a labor organization that represents
27 members of the public health sector.
28 "(F) One member representing a labor organization that represents
29 members of the building trades.
30 "(G) One member representing large contracting companies.

1 "(H) One member representing small contracting companies.

7 Quality.
8 "(M) One member representing the Oregon Health Authority.
9 "(N) One member representing the Oregon Pupil Transportation
10 Association.
11 "(0) One member representing a labor organization that represents
12 transportation employees for school districts.
13 "(2) The task force shall explore and recommend a strategy for
14 implementing a clean diesel program in Oregon that will serve to ac-
15 complish the goal outlined in ORS 468A.793. In developing the strategy
16 required by this subsection, the task force shall:
17 "(a) Conduct an assessment of the costs, funding structures and
18 funding options, including public and private funding options, for the
19 short-term and long-term stability of a clean diesel program in Oregon
20 for both on-road and nonroad vehicles;
21 "(b) Investigate establishing a registration program for nonroad
22 vehicles and related issues, including but not limited to strategies for
23 the establishment of a registration fee and a registry, and issues as-
24 sociated with administering the registration program;
25 "(c) Determine the feasibility of regulating on-road diesel emis-
26 sions;
27 "(d) Assess the effectiveness of current diesel programs in this state
28 and applicable federal programs;
29 "(e) Determine a timeline for implementation of a clean diesel pro-
30 gram;

"(f) Investigate state and federal restrictions on developing a clean
2 diesel program;
3 "(g) Explore the impacts of idling and find solutions to minimize
4 idling;
5 "(h) Examine the health impacts of diesel particulates in urban and
6 rural areas;
7 "(i) Review the categories of uses of diesel engines and determine
8 the practicality of retrofitting or replacing diesel engines within those
9 categories;
10 "(j) Review and determine the volume of emissions for each of the
11 diesel categories;
12 "(k) Review the economic impact of diesel replacement or
13 retrofitting on large and small businesses and within various industry
14 segments where appropriate;
15 "(L) Review the normal industry replacement rates of vehicles and
16 equipment;
17 "(m) Prioritize categories of engines in need of retrofit or replace-
18 ment by placing the highest priority on accomplishing the greatest
19 environmental and health benefits;
20 "(n) Assess strategies for assuring quicker compliance with state
21. goals for school bus engine retrofits and replacements; and
22 "(o) Consider appropriate exemptions from any standards adopted
23 under a clean diesel program.
24 "(3) A majority of the members of the task force constitutes a
25 quorum for the transaction of business.
26 "(4) Official action by the task force requires the approval of a
27 majority of the members of the task force.
28 "(5) The task force shall elect one of its members to serve as
29 chairperson.
30 "(6) If there is a vacancy for any cause, the appointing authority

1 shall make an appointment to become immediately effective.
2 "(7) The task force shall meet at times and places specified by the
3 call of the chairperson or of a majority of the members of the task
4 force.
5 "(8) The task force may adopt rules necessary for the operation of
6 the task force.
7 "(9)(a) The task force shall submit a preliminary report in the
8 manner provided by ORS 192.245, and may include recommendations
9 for legislation, to the interim committees of the Legislative Assembly
10 related to environment and natural resources no later than September
11 15, 2015.
12 "(b) The task force shall submit a final report in the manner pro-
13 vided by ORS 192.245, and may include recommendations for legis-
14 lation, to the interim committees of the Legislative Assembly related
15 to environment and natural resources no later than September 15,
16 2016.
17 "(10) The Legislative Administrator shall provide staff support to
18 the task force.
19 "(11) Members of the task force who are not members of the Leg-
20 islative Assembly are not entitled to compensation, but may be reim-
21 bursed for actual and necessary travel and other expenses incurred by
22 them in the performance of their official duties in the manner and
23 amounts provided for in ORS 292.495. Claims for expenses incurred in
24 performing functions of the task force shall be paid out of funds ap-
25 propriated to the Legislative Administrator for purposes of the task
26 force.
27 "(12) All agencies of state government, as defined in ORS 174.111,
28 are directed to assist the task force in the performance of its duties
29 and, to the extent permitted by laws relating to confidentiality, to
30 furnish such information and advice as the members of the task force

1 consider necessary to perform their duties.
2 "SECTION 2. Section 1 of this 2015 Act is repealed on December 31,
a 2016.
4 "SECTION 3. This 2015 Act being necessary for the immediate
5 preservation of the public peace, health and safety, an emergency is
6 declared to exist, and this 2015 Act takes effect on its passage.".

PROPOSED AMENDMENTS TO
SENATE BILL 824
1 On page 1 of the printed bill, line 2, after "emissions;" delete the rest of
2 the line and line 3 and insert "and declaring an emergency.".
3 Delete lines 4 through 27 and insert:
4 "Whereas exposure to diesel particulate pollution causes myriad health
5 effects, including the exacerbation of asthma symptoms and early death from
6 heart disease and various cancers; and
7 "Whereas children are especially vulnerable to the negative health effects
8 of diesel particulate pollution because their lungs are still in the develop-
9 mental phase and they breathe, on average, 50 percent more air per pound
10 of body weight than adults; and
11 "Whereas in 2007 the Environmental Quality Commission established a
12 goal to reduce excess lifetime risk of cancer due to exposure to diesel engine
13 emissions to no more than one case per million individuals by 2017, but
14 Oregon is far from achieving that target; and
15 "Whereas the health impacts and premature deaths caused by diesel
16 particulate pollution have an annual economic impact of more than $3 billion
17 in this state; and
18 "Whereas 17 Oregon counties have ambient levels of diesel particulate
19 pollution that are considered harmful to health; and
20 "Whereas new diesel engines and older diesel engines retrofitted with
21 particulate filters can reduce diesel particulates by up to 95 percent as
22 compared to diesel particulate emissions from older, dirty diesel engines that

1 are not retrofitted; and
2 "Whereas the attrition rate of older, dirty diesel engines without retrofits
3 is too slow to adequately curb emissions in a timely manner and earlier
4 adoption of the new federal diesel standards will protect public health; and
5 "Whereas a strategy to shorten the timeline for adoption of the new fed-
6 eral diesel standards requires a combination of regulations and incentives;
7 and
8 "Whereas the problem of diesel particulate pollution in this state is
9 exacerbated when engines are allowed to idle unnecessarily; and
10 "Whereas despite state statutory requirements to limit the risk from die-
11 sel particulate pollution to children by 2013, only 42 percent of school buses
12 are using clean diesel technology in Oregon today; now, therefore,".
13 On page 2, delete lines 2 through 45 and delete pages 3 through 7 and
14 insert:
15 "SECTION 1. (1) The Task Force to Investigate a Clean Diesel Pro-
16 gram is established, consisting of 19 members appointed as follows:
17 "(a) The President of the Senate shall appoint two members from
18 among members of the Senate.
19 "(b) The Speaker of the House of Representatives shall appoint two
20 members from among members of the House of Representatives.
21 "(c) The Governor shall appoint 15 members as follows:
22 "(A) One member representing cities or counties.
23 "(B) One member representing the Department of Transportation.
24 "(C) One member representing large trucking companies.
25 "(D) One member representing small trucking companies.
26 "(E) One member representing a labor organization that represents
27 members of the public health sector.
28 "(F) One member representing a labor organization that represents
29 members of the building trades.
30 "(G) One member representing large contracting companies.

11 "(0) One member representing a labor organization that represents
12 transportation employees for school districts.
13 "(2) The task force shall explore and recommend a strategy for
14 implementing a clean diesel program in Oregon that will serve to ac-
1s complish the goal outlined in ORS 468A.793. In developing the strategy
16 required by this subsection, the task force shall:
17 "(a) Conduct an assessment of the costs, funding structures and
18 funding options, including public and private funding options, for the
19 short-term and long-term stability of a clean diesel program in Oregon
20 for both on-road and nonroad vehicles;
21 "(b) Investigate establishing a registration program for nonroad
22 vehicles and related issues, including but not limited to strategies for
23 the establishment of a registration fee and a registry, and issues as-
24 sociated with administering the registration program;
25 "(c) Determine the feasibility of regulating on-road diesel emis-
26 sions;
27 "(d) Assess the effectiveness of current diesel programs in this state
28 and applicable federal programs;
29 "(e) Determine a timeline for implementation of a clean diesel pro-
30 gram;

1 "(f) Investigate state and federal restrictions on developing a clean
2 diesel program;
3 "(g) Explore the impacts of idling and find solutions to minimize
4 idling;
5 "(h) Examine the health impacts of diesel particulates in urban and
6 rural areas;
7 "(i) Review the categories of uses of diesel engines and determine
8 the practicality of retrofitting or replacing diesel engines within those
9 categories;
10 "(j) Review and determine the volume of emissions for each of the
11 diesel categories;
12 "(k) Review the economic impact of diesel replacement or
13 retrofitting on large and small businesses and within various industry
14 segments where appropriate;
15 "(L) Review the normal industry replacement rates of vehicles and
1s equipment;
17 "(m) Prioritize categories of engines in need of retrofit or replace-
18 ment by placing the highest priority on accomplishing the greatest
19 environmental and health benefits;
20 "(n) Assess strategies for assuring quicker compliance with state
21 goals for school bus engine retrofits and replacements; and
22 "(o) Consider appropriate exemptions from any standards adopted
23 under a clean diesel program.
24 "(3) A majority of the members of the task force constitutes a
25 quorum for the transaction of business.
26 "(4) Official action by the task force requires the approval of a
27 majority of the members of the task force.
28 "(5) The task force shall elect one of its members to serve as
29 chairperson.
30 "(6) If there is a vacancy for any cause, the appointing authority

I shall make an appointment to become immediately effective.
2 "(7) The task force shall meet at times and places specified by the
3 call of the chairperson or of a majority of the members of the task
4 force.
5 "(8) The task force may adopt rules necessary for the operation of
6 the task force.
7 "(9)(a) The task force shall submit a preliminary report in the
8 manner provided by ORS 192.245, and may include recommendations
9 for legislation, to the interim committees of the Legislative Assembly
10 related to environment and natural resources no later than September
11 15, 2015.
12 "(b) The task force shall submit a final report in the manner pro-
13 vided by ORS 192.245, and may include recommendations for legis-
14 lation, to the interim committees of the Legislative Assembly related
15 to environment and natural resources no later than September 15,
16 2016.
17 "(10) The Legislative Administrator shall provide staff support to
18 the task force.
19 "(11) Members of the task force who are not members of the Leg-
al islative Assembly are not entitled to compensation, but may be reim-
21 bursed for actual and necessary travel and other expenses incurred by
22 them in the performance of their official duties in the manner and
23 amounts provided for in ORS 292.495. Claims for expenses incurred in
24 performing functions of the task force shall be paid out of funds ap-
25 propriated to the Legislative Administrator for purposes of the task
26 force.
27 "(12) All agencies of state government, as defined in ORS 174.111,
28 are directed to assist the task force in the performance of its duties
29 and, to the extent permitted by laws relating to confidentiality, to
30 furnish such information and advice as the members of the task force

1 consider necessary to perform their duties.
2 "SECTION 2. Section 1 of this 2015 Act is repealed on December 31,
3 2016.
4 "SECTION 3. This 2015 Act being necessary for the immediate
5 preservation of the public peace, health and safety, an emergency is
6 declared to exist, and this 2015 Act takes effect on its passage.".
