DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, NOVEMBER 9, 2015
Commissioners'Hearing Room -Administration Building- 1300 NW Wall St.,Bend
Present were Commissioners Anthony DeBone and Alan Unger; Commissioner
Tammy Baney was unable to attend. Also present were Tom Anderson, County
Administrator; Erik Kropp, Deputy County Administrator; John Laherty, County
Counsel; Peter Gutowsky and Paul Blikstad, Community Development; and three
other citizens.
Chair DeBone opened the meeting at 10:02 a.m.

Jenna App of CASA (Court Appointed Special Advocates) brought up the fact
that CASA's funding request was removed from the Victims' Assistance grant
last week. They were approved in September by the Board as one of the three
recipients. She pointed out that children in foster care should qualify as crime
victims. There has to be an imminent threat of serious harm before a child is
removed from a home. There are overlapping relationships with criminal court,
but CASA gets involved in ways outside of criminal court proceedings.

She understands the problem is that the children are not named as crime
victims, but does not feel this should mean they do not qualify for the grant.
She is not completely clear on this. She did not hear anything once she
responded to the questions to clarify the grant application, but then heard from a
reporter from the Bulletin that CASA was removed from the grant.
KIDS Center had initially had problems with their part of the grant, but was
approved. Most of the children are interviewed at the KIDS Center and then are
assigned to CASA throughout the court process. She is concerned that CASA
will miss out on $56,000 over the next two years. Their numbers are up 150%
from last year. This is a huge issue for the group. The funds were meant to
recruit and train volunteers for the increasing need.
Commissioner Unger is disappointed as well. He asked how this might be
resolved. Tom Anderson said that a decision was made by the local Public
Safety Coordinating Council after considerable discussion. They feel it is a
statewide issue, and members of the PSCC took great pains to express their
positive opinion about CASA. The State review committee indicated that, for
whatever reasons, there was differing opinions on the definition of the
appropriate clientele. There are probably some State politics going on, but once
it gets to the committee, no one want the whole application to be rejected.
There was considerable discussion at the PSCC meeting, whose members
support CASA, but they did not want to jeopardize the entire grant.
Chair DeBone realizes CASA does important work and the Board will discuss
this further. Commissioner Unger suggested that perhaps there are other
potential grants that can be pursued.
No other citizen input was offered.
3. Before the Board was Consideration of First Reading by Title Only of
Ordinance No. 2015-021, Amending Title 23, the Deschutes County
Comprehensive Plan, to Revise the Mineral and Aggregate Resource
Inventory for Deschutes County, and Re-designating Certain Property
from Agricultural to Surface Mining (SM).
Paul Blikstad gave an overview of this item as well as item #4. This is the
culmination of eleven years on this application, which has been to LUBA four
times. The last decision was not appealed.

Mr. Anderson said that Mr. Blikstad handled this issue for those eleven years.
He is retiring soon and it is great to see this resolved. Commissioner Unger
stated that these Ordinances will allow for more aggregate inventory, which
will be sequentially mined, and the land gradually reclaimed.

Map, to Change the Zone Designation on Certain Property from Exclusive
Farm Use to Surface Mining.

Provisions relating to Nuisances Caused by Animal Noises.

John Laherty provided a brief overview of the Ordinance, which clarifies some
inconsistencies in County Code; and further that a violation of the provisions of
Code will be treated as a Class B violation, which has a lower fine than. Class
A. He added that traditionally Class B has been used by the Sheriff's Office.

The Ordinance will be effective in 90 days. Commissioner Unger asked if this
timeframe could be shortened to thirty days, similar to what the cities do. Mr.
Laherty said that this would have to have been set forth at the beginning of the
process.
