Also present were Tom Anderson, County Administrator; Dave Doyle, County Counsel; and,for a portion of the meeting, DeAnn Carr and Nancy Tyler, Health Services; Nick Lelack, Matt Martin and Peter Gutowsky, Community Development; Whitney Malkin, Communications; Judith Ure, Administration; and seven other citizens, including Ted Shorack of The Bulletin. 1. Discussion of Jail Diversion Grant Application. DeAnn Carr and Nancy Tyler of Behavioral Health asked for approval to submit a proposal for a jail diversion program. Instead of going to a hospital or the jail, the individual might be able to be connected with mental health services and community support systems. It would start as part of the crisis team. Oregon Health Authority released the RFP, allowing for a seven-year duration. This would allow better tracking of savings and determining how it fits in. The crisis receiving center (the `sober station') is a collaboration with the Sheriff's Office and would benefit from this as well. Tom Anderson said that the short-term care and respite care involve different funding pieces. This will allow the department to get its foot in the door. Sustainability is a huge issue and staff is very cognizant of this. Nick Lelack gave an overview of the proposed makeup of the Committee. The Commissioners have discussed this individually with staff to help make selections. Commissioner Baney asked what baseline the group will be using, to start. There are people who seem to be knowledgeable. Mr. Lelack stated that some were involved in the process, but not all. They will receive a packet of information on the details. The first meeting is to bring the group up to speed on terminology, why certain recommendations were made by the Planning Commission, and an effort to make sure everyone starts at the same level. Matt Martin said they will provide the legislative history and what has been discussed locally. Commissioner DeBone is hoping for reasonable time, place and manner regulations. He thanked the 43 people who applied, and staff for all the work they have done. Additional resources are available if the Committee members want to learn more about a specific issue. Chair Unger said the legislative session ends on March 5, and may or may not result in any information developed that pertains to this issue. The Commissioners have indicated they want to provide comments at the start of the first meeting. Commissioner DeBone asked if this is going to address both medical and recreational marijuana. Mr. Martin said the intent is to address both and all issue surrounding them. Chair Unger hopes they talk about a dark-sky type of ordinance. 3. Other Items. Matt Martin said that there are a lot of preservation activities going on in regard to the Centennial year events. Whitney Malkin provided a list of theatrical production dates and community events. There may be opportunities for Commissioners to make a cameo appearance in the play. Other events might be added throughout the County, based on volunteer efforts. Judith Ure presented a draft letter regarding biomass and SB 1520. Chair Unger said that the schedule was already developed and he does not think this is going to make it to committee for discussion and a vote. DEBONE: Move signature of the letter of support. (A copy is attached for reference.) The items that the Board asked be `watched' are designated at Priority 3. The legislature is moving very fast and many items may not receive a hearing or continue on to the other group. Commissioner DeBone feels that it may have been discussed years ago; this came up at a NeighborImpact meeting, but they have stayed neutral. It is primarily driven in the metro areas. Chair Unger wants an update if it makes it to the Senate. Priority 2. HB 4013 —relating to vulnerable persons. Priority 3. HB 4014 —relating to cannabis. Priority 2. BB 4026 —to phase out OLCC. Tom Anderson said this would result in a net loss to the County. FIB 4030 — locally sponsored; reimbursement of expenses for emergency medical services. Commissioners Baney would like the Board to send a letter. Priority 1. BANEY: Move approval of a support letter for FIB 4030. DEBONE: Second. VOTE: BANEY: Yes. DEBONE: Yes. UNGER: Chair votes yes. HB 4043 —property assessments relating to the housing authority. An incentive to sell property to the housing authority below market. Priority 3. FIB 4054 —minimum wage increase. Mr. Anderson said this does not affect the County very much. Commissioner Baney stated that Linn County feels this will result in a burden on them as an unfunded mandate. Chair Unger said that AOC is neutral on this; Commissioner DeBone feels the Board should do the same. Priority 3. HB 4055 — low carbon fuels. Priority 3. HB 4062 —taxing nicotine delivery systems. Supportive. Priority 2. FIB 4064 — affordable housing. Supportive. Priority 2. HB 4066 --- drone regulations. Supportive. Priority 2. Not supportive. Priority 3. HB 4075 — student safety. Replaces a hot line. Priority 3. HB 4077—relates to skiing hazards. The Board signed a letter of support today. Priority 2. HB 4078 —transit expansion of rural systems. This has to do with matching grant funds and COIC supports it; it would provide for better leverage. Supportive. Priority 2. FIB 4079 — DLCD; affordable housing. There are two pilot programs, based on population. This would fast-track the UGB expansion process for cities. Priority 2. HB 4081 — low income housing taxation. The Assessor feels this should be looked at holistically with similar bills. Priority 3. HB 4082 —prostitution; includes other facets of prostitution. Priority 3. HB 4087 —police officers. Mr. Doyle stated that this bill would protect the employment status of police officers — even when the officers have Brady issues that preclude the officer from testifying. He assumes that the Sheriff s Association will strongly oppose. Priority 3. HB 4094 —marijuana. Priority 2. FIB 4096 -- veterans. Priority 2. Mr. Anderson said the County already complies. This would create more work for the County. HB 4100 — coordinated care. Ms. Ure said there are several bills on this. Priority 2. HB 4109 — economic interest. Priority 3. FIB 4116 — inmate health care task force. Priority 3. HB 4124 — prescription drugs. Support. Priority 3. BB 4125 — groundwater contamination. Support. Priority 2. HB 4141 — coordinated care. Commissioner Baney said this might allow smaller areas to be more inclusive. Priority 3. HB 4146 —transient lodging tax. Mr. Anderson said that this would require the State to spend 15% on tourism, rather than `up to' 15%. Priority 3. RJR 202 —veterans. This relates to using lottery dollars. There was concern that this might take away from other uses. Priority 3. SB 1511 — cannabis registration with the OLCC. Priority 2. SB 1512 — seismic rehabilitation. Priority 3. Chair Unger asked where the funds would come from. SB 1515 — child welfare. Support. Priority 3. SB 1519 —PERS. This sets up another retirement system that would require employee contributions. Mr. Anderson said it would take away from Tier I and Tier II employees. It is a big bill with a lot of details, and probably too complex to get anywhere. SB 1520 — forest resources. Letter of support. Priority 2. SB 1531 — coordinated care. Priority 3. SB 1533 — affordable housing. This has to do with developer incentives. Priority 3. SB 1548 --urban growth boundary. This would relate to the housing crisis. Priority 3. SB 1545 — children's special districts. Priority 3. SB 1550 —grand jury proceedings. Commissioner Baney thinks Portland is doing this already. The District Attorney said this does not come with funding, and does not support it. Mr. Doyle said Oregon is one of just two states that do not already record these. Priority 3. Commissioner Baney said the supporting organizations should act if they feel strongly about it. SB 1558 —health reporting. Priority 3. SB 1559 — inhalant delivery systems. Priority 2. SB 1563 —on-site septic system financing. Support. Priority 2. SB 1565 —tax exemption. The Assessor opposes this as being too complex. Priority 3. SB 1571 ---testing evidence kits. Support. Priority 3. SB 1575 — affordable housing. Mr. Anderson thinks this is the big bill for housing. Priority 3. SB 1579 — legal advice. Priority 3. SB 1580 —removing dams. Priority 3. SB 1582 -- fast-track housing. Priority 3. g Y SB 1593 — workforce housing. Priority 3. SJR 201 —property tax exemption. Priority 3. SJR 204 -- funding for education and public safety. Priority 3. Overall, the Board is primarily interested in watching marijuana law proposals and a few others, and will wait to see what happens this week with the rest. The Board went into executive session at 3:45 to address labor negotiations. After executive session, the following action was taken. Overview of Request: The State of Oregon, acting by and through the Oregon Health Authority, Health Systems Division issued a Request for Grant Proposals to solicit Proposals from qualified Community Mental Health Programs(CMHPs)to expand the availability of Jail Diversion Services in Oregon. Jail Diversion Services provide alternatives to incarceration for individuals who are arrested and jailed as a result of behaviors caused by their mental illness.Jail Diversion Services funds will be awarded to qualified CMHPs with the capacity and expertise to actively support the following objectives and expected outcomes: • Decrease the number of individuals diagnosed with mental illness who are in jail as a result of behaviors associated with mental illness; • Increase cooperation among law enforcement, mental health professionals, community corrections and the court system; • Increase the number of individuals enrolled in mental health services who are/have been involved with law enforcement; and • Provide linkages,to individuals diagnosed with mental illness, to appropriate services within the community(e.g. mental health treatment, public benefits, housing, etc.). The PC elected Steve Swisher as chair and Dale Crawford as vice chair.Commissioner Palcic declined the nomination to serve as chair for a second term. 2. I provided an update on the Marijuana Advisory Committee(MAC).After the update,Commissioner Tunno emphatically and repeatedly made statements that the Board should not appoint any recreational marijuana industry lobbyist or representative to the MAC.She made a motion for the PC to recommend the Board not make any such appointments. Her motion failed for lack of a second. However,she continued to passionately discuss it a number of times. I stated that I would ask the Board to watch the PC meeting video so they(you)would clearly hear her points,which she appeared to appreciate and end this discussion. New Chair Swisher and Commissioner Powell explained several times to her that the purpose of the agenda item was to provide an update on the MAC and not get into the Board's appointment process,and that I am not making the appointment given that many of her comments were initially directed at me. 3. Under Public Comments,several people talked about marijuana regulations and opt out in the County. Nunzie Gould made a couple of incorrect statements that I corrected(i.e.,she stated the Board did not know the options available to out and regulate marijuana on Dec. 21,and the Planning Commission's public process and recommendations have been disregarded)which are on the video. 4. Commissioner Powell stated on the record that he encourages the Board to initiate 2 recruitments for new planning commissioners to replace Commissioner Ed Criss and him at the same time. His term is up at the end of this fiscal year(he has served nearly 10 years in total). He said once the Board appoints his replacement,he will resign. The reason,he explained,is to allow the county to initiate both recruitments and appointments simultaneously,and then we can train both new commissioners at the same time. The play will feature four characters whose livelihoods are impacted directly by the creation of a new county.
