2016-87-Ordinance No. 2016-008 Recorded 3/2/2016 REVIEWED DESCHUTES COUNTY OFFICIAL RECORDS r1 , fi NANCY BLANKENSHIP, COUNTY CLERK vu �0 1+� LEGAL EL COMMISSIONERS' JOURNAL 03/02/2016 08:19:12 AM it II III II IIIIIIIIIIIIIII 2 1 8 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,OREGON AND THE CITY OF REDMOND CITY COUNCIL An Ordinance Amending Deschutes County Code Title 20,and Declaring an Emergency. * ORDINANCE NO.2016-008 WHEREAS,under ORS 190.003 to 190.030,and 197.175, et seq.Deschutes County and the City of Redmond are authorized to enter into intergovernmental agreements and are required to prepare and adopt comprehensive plans consistent with Statewide Planning Goals;and WHEREAS, under OAR 660-021-0020, Deschutes County and the City of Redmond are authorized to establish Urban Reserve Areas; and WHEREAS, Deschutes County and the City of Redmond recognize the importance of providing an orderly transition of urban services from County to City jurisdiction and administration as the Redmond Urban Reserve Area transitions from a rural to an urban character;and WHEREAS, ORS 190-003, et seq. requires that an intergovernmental agreement relating to the performance of functions or activities by one unit of local government for another specify the responsibilities between the parties;and WHEREAS, Deschutes County and the City of Redmond have adopted zoning and planning regulations in accordance with Oregon Revised Statutes Chapter 227 that regulate and control the development of land within the City and Urban Growth Boundary;and WHEREAS,the City of Redmond City Council ("City Council")has an adopted set of goals that includes: "Enhance the quality of life in the City through the adoption of programs,policies and standards that balance growth while maintaining the city's unique character"; and, WHEREAS,the City of Redmond has identified that the existing Urban Holding Zone, UH-10 in the unincorporated area of the urban growth boundary does not fulfill the City Comprehensive Plan goals and polices by specifically directing development design standards and locations that are desirable and most appropriate for Wireless and Broadcast Communication Facilities;and, WHEREAS, Deschutes County Board of County Commissioners ("Board") and City Council held a public hearing on February 23, 2016 to consider the recommendation of the Urban Area Planning Commission,review the existing record and gather additional evidence and public testimony;and WHEREAS, the Board and City Council have received the Redmond Planning Commission's recommendation and, after receiving additional evidence and testimony, determined that the requested Deschutes County Code amendments would contribute to the Redmond Comprehensive Plan goals and policies to maintain and enhance Redmond's quality of life;and PAGE 1 OF 3 ExWBIT 2-ORDINANCE NO.2016-008 WHEREAS, the Board and City Council find that the findings for the adoption of the amendments to Title 20 better address the City's Comprehensive Plan, the applicable state law, the Statewide Planning Goals and the City's standards and criteria for an amendment to the Redmond Development Code as set forth in Exhibit B;and, WHEREAS,the Board and City Council find that the attached code amendments are necessary to further these interests and an emergency exists;now,therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, AND THE CITY OF REDMOND ORDAIN as follows: Section 1. AMENDMENT. DCC Title 20 is amended to read as described in Exhibit "A," attached hereto and by this reference incorporated herein,with new language underlined and language to be deleted in str-iliethfeugh. Section 2. FINDINGS. The Board and City Council adopt as its findings Exhibit "B" of Ordinance 2016-008 and incorporated by reference herein. Section 3. EMERGENCY. This Ordinance being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this Ordinance takes effect on its passage.
