Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; and Dave Doyle, County Counsel. Attending for a portion of the meeting were Scot Langton, Assessor; Whitney Hale, Communications; and two other citizens. No representatives of the media were present. Chair Unger opened the meeting at 1:30 p.m. 1. Discussion of Enterprise Zone. Janet Burton of EDCO (Economic Development for Central Oregon) for La Pine and Sunriver gave an overview of the item. (She referred to a presentation, a copy of which is attached.) She said that a valid question has been the value of an enterprise zone. It has benefited parts of the County, especially during the economic downturn. They are starting to get some interest in this program in south County. One company has used this program in La Pine and now is increasing the number of employees and buildings. It is becoming difficult to find industrial land in Redmond and Bend, so companies are looking at south County. A boundary expansion requires that household income be 80% or less than the state median income, the unemployment rate has to be 2% higher than comparable state rates, and the overall economic hardship of an area must be considered. It also needs to take into account a 15 -square mile maximum area, and be supported by zone sponsors (in this case, the County and the City of La Pine). Area economic data supports the criteria. The proposed area for inclusion is Sunriver Business Park and Spring River Plaza (just outside Sunriver); and La Pine. There would be no zone change; they would just be adding land. The hope is to attract larger, traded sector businesses to areas where the majority of businesses have five or fewer employees. There is very limited employment in these areas, and the unemployment rate ranges from about 7% to 28%. There are three traded sector employers in Sunriver now. These areas are ideal for tech companies or light industrial use. There would be no zoning changes required, so this results in little impact to the character or traffic patterns in the area. The tax abatement is also for a limited period of time. A public hearing of the taxing districts is scheduled for April 5 at Sunriver in the evening, hosted by EDCO. The County is being asked to address this by resolution on April 13, the same day that La Pine does the same. She has not received any feedback from the taxing districts, but has heard support from other businesses. Chair Unger stated that this is temporary and they are not getting anything today anyway. Within a few years, it will result in a tax benefit. He said that Redmond has a very successful enterprise zone that has been expanded to Sisters. Chair Unger stated that he is supportive, as is Commissioner Baney. Commissioner DeBone encouraged this effort as well. Minutes of Board of Commissioners' Work Session Wednesday, March 30, 2016 Page 2 of 6 2. Other Items. Nick Lelack discussed the results of the Planning Commission interviews. There were nine applicants. One withdrew, and Hugh Palcic, who is an at -large member now, has indicated he would like to step into the south County seat which has been vacated, since he lives in that area. This would free up an at large position. The interviews were for the Bend position, since the current Bend member will have reached the end of his term in June. Mr. Lelack suggested that they make all the term dates the same but staggered by year, which would help avoid having too many members reach the end of their terms at the same time. They are four-year terms. They can fill the portion of terms as they exist. Therefore, Mr. Palcic would complete the south County term through 2017. He is eligible to apply for another term after that. Tom Anderson noted that some other agencies have decided that Planning Commissioners need to reapply at the end of their term if they want to continue. It was felt this allows other people the opportunity to apply or make a change if this is prudent. Mr. Lelack stated that usually they are asked if they want to continue and, if so, the Board just reappoints them. However, it can be handled differently if the Board prefers. Mr. Lelack stated that one of the candidates interviewed wanted to focus only on a single south County issue. The others wanted to address broader issues. Mr. Lelack said they have some good candidates for the Bend position, who might be interested in the at -large position. There were four top candidates, which were broken into tier 1 and tier 2. They were all very promising and interviewed well. Commissioner DeBone likes the mix on the Planning Commission now, and he felt any of them would be good. The Board decided that Commissioners Unger and Baney will interview the top two candidates individually, and they asked that Mr. Lelack be there. Mr. Lelack stated that the one selected for the Bend seat should be formally appointed in April, with an effective date of May 15. They can open a short application period for others who might want to apply for the at -large position. The interview panel can go through the same process with them. That position becomes vacant on June 30. Minutes of Board of Commissioners' Work Session Wednesday, March 30, 2016 Page 3 of 6 Chair Unger indicated they have geographic representation now, and asked if there are other things to consider to result in a good balance. Commissioner DeBone replied that each represents the whole County. Mr. Lelack added that there could be no more than two from the same profession. One of the applicants for the Bend seat lives in Tumalo, which is not represented. Two others live on the east side and another lives in town. Expertise that is helpful is real estate, agriculture, education, and business management. They are across the political spectrum: moderate, conservative, activist and progressive. Commissioner Baney joined the meeting at this time. She was updated on the previous discussion. Chair Unger stated that he would like to get the interviews for the at large position down to five candidates maximum. He would prefer to review applications and not interview everyone. They should not have to re -interview the applicants for the Bend position. Whitney Hale said that she has drafted the 'in my view' newspaper piece as requested. She asked if this should wait until after the Marijuana Advisory Committee presents its report. The Board indicated it should wait. Mr. Lelack discussed the recent Bend UGB meeting. They came up with unanimous support after four hours, but not all parties are happy with the outcome. This related to the west side of Bend and OSU. He made it clear that the County does not want to preclude any other options for the County -owned property. The discussion had to do with the maximum number of properties to include. Chair Unger asked how Bend is going to service the area. Commissioner DeBone stated that they have a consultant working on all of this in the background. Mr. Lelack said that this would change the designation of the County's property if it goes forward. Nothing has been predetermined. Minutes of Board of Commissioners' Work Session Wednesday, March 30, 2016 Page 4 of 6 This requires a UGB expansion plus a conversion of the General Plan. They are reformatting how this is done, and it is very complicated. There are 113 policies detailing how much housing there would be, what kind, and so on. The current urban reserve designation is not statutory. The City will have to grapple with a fifty-year urban reserve plan or do another UGB expansion. Urban reserve and exception lands are now looked at in the same way by the State. The City might go directly to a UGB expansion as they are not required to have an urban reserve area or go to that first anymore. Redmond, on the other hand, has statutory urban reserves that provide more certainty to property owners. Mr. Anderson added that urban reserve is the remnant of the original UGB that the City was required to shrink. Mr. Lelack said that the County still has control over anything outside of the City. David Doyle confirmed that the Board is ready for the Dowell decision. He wants to put this on the April 13 business meeting agenda. A discussion occurred regarding the estimated timeframe for the Board to address various significant land use issues. Chair Unger said that a representative of Tumalo Irrigation District met with him regarding various issues. He feels TID does not have a good grasp of land use law, and their attorneys are not helping to make this clear to the District. Mr. Lelack noted that there is a long list of violations against TID. There is a meeting before the Hearings Officer on April 5. This will be similar to a court proceeding, and maybe it will help to provide some clarity. The Latham mine issue has been delayed due to a lack of courtroom space and a judge for three consecutive days. They may hire a reference judge to decide this, who would have more time than a sitting judge. 3. Adjourn. It is a property tax abatement on new plant and equipment investments for three to fifteen years for new or expanding non -retail businesses in a designated zone that are investing a minimum of $50,000 in fixed capital improvements and growing their workforce by 10%. To qualify for a boundary expansion to an Enterprise Zone the following conditions must be met: 1) The area(s) to be added are generally the same or a lower household or personal income, or a higher unemployment rate, or otherwise equivalent or more severe economic conditions, compared to the original enterprise zone. 2) Supported by all the zone sponsors (Deschutes County and City of La Pine). 3) Does not exceed 15 square miles, and a maximum lineal distance of 25 miles. 4) Possesses undeveloped land that is appropriately zoned. 5) Description and supporting data of justification for boundary change. Economic Overview: The Deschutes County Rural Enterprise Zone was originally designated in 2008, during an economic recession. Economic conditions are only starting to recover over the last year in South Deschutes County. Unemployment and poverty rates in South Deschutes County remain elevated in comparison to other areas of Deschutes County. Economic Development for Central Oregon 16345 Sixth Street La Pine, OR 97739 541 536 1432 www.edcoinfo.com ERGO MOVE START GROW While the Deschutes County unemployment rate has fallen to 5.8% (November 2015), the employment rate in South Deschutes County remains elevated at 10.8% (zip code 97739) and 15.86% for Census Tracts 2 and 3 (Three Rivers South). While zip code 97707 includes Sunriver, Caldera Springs, Crosswater and Vandervert Ranch, many of the full time residents outside of these areas, such as Three Rivers South, are low income and depend on jobs in South Deschutes County. Another indication of South County economic hardship is the student rate of economically disadvantaged children at 72% for the five South County schools, compared to a 44% average for the Bend -La Pine School District. South Deschutes County lags behind other areas of Deschutes County in attracting new businesses, and with the exception of Sunriver Brewing Company there have been no new major employers locating in the area in the last four years. Quicksilver Contracting Company (Wood Products) is the first and only company that has applied and qualified for Enterprise Zone incentives. Quicksilver received it authorization in August 2015 for an expansion to its current business, and will invest almost three million dollars in new equipment and machinery with will allow it to increase productivity and increase its ability to serve new customers. Quicksilver has already met the hiring requirement and has added five new employees. Quicksilver hopes to add additional new employees in 2016. Expanding the Deschutes County Rural Enterprise Zone to include Sunriver Business Park and Spring River Plaza would offer the following advantages: • Sunriver Business Park and Spring River Plaza are ideally suited to light industrial or tech businesses. • Buildings are already available in the Sunriver Business Park, in comparison to Finley Butte Industrial Park in La Pine where there are no commercial/industrial buildings currently available to lease or buy. • The Enterprise Incentives would help attract businesses. • Having more businesses with family wage jobs locate in these areas would offer more employment, and more diverse employment, to South County residents. • It is becoming increasingly difficult to find industrial land in Bend, and Sunriver Business Park and Spring River Plaza would offer an alternative which is still close to Bend. Fiscal Impact: The expansion of the Deschutes County Rural Enterprise Zone would include a 3 -year tax abatement on property improvements, and therefore impact the general fund. Consideration of a Resolution by City Council is scheduled for April 13. Staff is seeking direction from Deschutes County Board of County Commissioners on whether to move forward with an Enterprise Zone Boundary Expansion. If the Board of County Commissioners directs staff to move forward with an application for a Boundary Expansion to the Deschutes County Rural Enterprise Zone, the Board of County Commissioners will be formally asked to consider and adopt a Resolution supporting the application on April 13, 2016.
