2016-231-Order No. 2016-023 Recorded 6/10/2016REVIEWED ft nit/ LEGAL COUNSEL DESCHUTES COUNTY CLERK �J X016'731 NANCY COMMISSIONERS' JOURNAL 06/10/2016 01:48:17 PM IIIIIIIIIIIUIIIIIIII311III 2016-231 For Recording Stamp Only BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Declaring the Results of the * Primary Election Held on May 17, 2016 * ORDER NO. 2016-023 Regarding the Establishment and Formation * of a Deschutes County Chapter 451 Service District For Emergency Communication Services; Simultaneous Withdrawal of Property WHEREAS, an election in Deschutes County, Oregon and Jefferson County, Oregon was held on May 17, 2016 on the measure set forth in Exhibit A concerning the proposed formation of an ORS Chapter 451 county service district for emergency communications ("District"); and WHEREAS, an Abstract of Votes, a copy of which is attached as Exhibit B, shows that a majority of those persons voting voted to approve the measure; and WHEREAS, ORS 198.820(1) requires the Board to canvass the votes and enter an Order establishing and forming the District if the Board determines that the majority of the votes cast were in support of formation of the District; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. At the election held in both Deschutes County, Oregon and Jefferson County, Oregon, on May 17, 2016, as evidenced by the Abstract of Votes, a copy of which is attached as Exhibit B and incorporated by reference herein, 48,782 electors cast ballots on the issue of formation of the District (with simultaneous withdrawal) and, of those electors, 34,932 electors voted YES, and 13,850 voted NO on the measure captioned FORM 9-1-1 DISTRICT WITH PERMANENT RATE, WITHDRAW FROM EXISTING DISTRICT, as set forth in the attached Exhibit A, incorporated by reference herein. Section 2. Because the majority of electors voted in support, the measure is declared to have PASSED. Page 1 of 2 ORDER 2016-023 Section 3. Consistent with, and pursuant to ORS Chapter 198: a. The District is hereby established and formed and shall be known as: "Deschutes County 9-1-1 Service District." b. The District's purpose is to take all necessary and proper steps to plan, establish, furnish and maintain a 9-1-1 emergency communications system within Deschutes County and to construct, maintain and operate any related facilities pursuant to ORS 451.010 et seq. c. The District Boundary shall be substantially as legally described in Exhibit C and depicted on the map attached as Exhibit D. Section 4. The County Legal Department shall cause certified copies of this Order to be filed with the Deschutes County Clerk and Assessor and the Oregon Department of Revenue and Secretary of State pursuant to ORS 198.780(1). Should a new 9-1-1 district be formed with a $0.425/$1,000 permanent tax rate beginning 2016-2017, and current district territory withdrawn? Summary 175 words which concisely and impartially summarizes the measure and its major effect. Since 1990, the 9-1-1 Service District has depended on temporary tax measures to fund 9-1-1 emergency and non -emergency call -taking and police, fire and EMS dispatch services for District residents. The 9-1-1 User Board, comprised of all local police and fire chiefs, adopted a strategic plan to improve 9-1-1 service and replace the end of life radio communications system by establishing stable funding prior to the expiration of the existing, temporary operating levy in 2018. Stable funding would assure the continuation of quality, responsive 9-1-1 emergency service responses for everyone in the District. This new tax would replace both the current permanent tax rate of $.1618 and the expiring temporary rate of $.20. The Governing Board has committed to maintaining the levy rate at $.3618, the current level, for the next two years. The maximum levy rate of $.4250 is not expected to be reached until 2030 or later. If levied at the maximum amount, the total increase over the current levies on a property with an assessed value of $200,000 would be $1.05 per month.
