WEDNESDAY, JUNE 8, 2016 Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend Present were Commissioners Alan Unger, Tammy Baney and Anthony DeBone. Also present were County Administrator Tom Anderson and Deputy County Administrator Erik Kropp; Dave Doyle, County Counsel; Chris Doty, Road Department; Nick Lelack and Matt Martin, Community Development; and approximately ten other citizens. No representatives of the media were in attendance. 1. CALL TO ORDER Chair Unger called the meeting to order at 10:00 a.m. 2. PLEDGE OF ALLEGIANCE 3. CITIZEN INPUT None was offered. Before the Board was the Reading of a Proclamation, Declaring June 15, 2016 "Elder Abuse Awareness Day" in Deschutes County. Minutes of Board of Commissioners' Business Meeting Wednesday, June 8, 2016 Page 2 of 8 Karen Ruesing, State APD District manager, she introduced four other adult protective services workers (APS Specialists): Kara Simmons, Tasha Holly, Patty Thomason and Danny Cupps. Ms. Ruesing said she has been with the agency for 25 years and started out as the only provider. There has been a big increase in the population and the need over those years. She explained that self-neglect and financial exploitation are the biggest concerns. The aging population in this area is growing a lot. They sometimes work in Wheeler, Lake and Klamath counties as well. Ms. Holly added that they have gotten much busier over time. They offer a 24-hour hotline for callers, and they try to get back to them quickly. They have a great arrangement with both law enforcement and the D.A. They are also on the 2-1-1 registry. Chair Unger said he has an elderly aunt and understands some of the challenges. A lot of this has to do with educating the family and knowing when to intervene. Ms. Ruesing said the Proclamation is meant to bring awareness, and there is a conference planned at St. Charles to include speakers from the Department of Justice, a former protective services specialist, and a Deputy D.A. Commissioner Baney asked if they have an idea of how many cases they handle. Ms. Holly replied that they are getting ten to fifteen new cases every month. Ms. Ruesing added that the receive about 140 calls per month, with about half of those converting into cases. Chair Unger stated that this is an important service and they want to support it. Local governments need to stand with them sometimes to make sure it does not get lost in the process. Commissioner Baney stated that the Board receives a number of requests for the reading of Proclamations, and they make a choice as to which ones are most important. They do not take this lightly. Chris Doty gave a brief overview of the item, and said these agencies have been working together for years. Chair Unger stated that this is a very important organization and he is glad they have finally formalized what they do. BANEY: Move second reading by title only. DEBONE: Second. VOTE: BANEY: Yes. Before the Board was Consideration of Approval of Weekly Accounts Payable Vouchers for the 9-1-1 County Service District (two weeks) in the Amount of $134,522.42. Before the Board was Consideration of Approval of Weekly Accounts Payable Vouchers for the Extension/4-H County Service District (two weeks) in the Amount of $276.64. Before the Board was Consideration of Approval of Weekly Accounts Payable Vouchers for Deschutes County (two weeks) in the Amount of $2,044,981.04. Tom Anderson said that about half of this amount is for road work, mostly for the Powell Butte roundabout program and overlay projects. BANEY: Move approval, subject to review. DEBONE: Second. Before the Board was Consideration of Board Signature of Order No. 2016-023, Establishing and Forming the Deschutes County 9-1-1 Service District. David Doyle said this is the final procedural step required for formation of the new District. They just got the abstract of votes a couple of days ago but it needs to be ratified. The financial vision goes for fifteen years, and they really dialed in on the right amount. Chair Unger thanked the voters for their support. BANEY: Move approval. DEBONE: Second. VOTE: BANEY: Yes. Before the Board was Consideration of Board Signature of a Letter Accepting the Resignation of Sasha Sulia from the Noxious Weed Advisory Board, and Thanking her for her Service. Before the Board was Consideration of Board Signature of a Letter Appointing Jeff Amaral to the Noxious Weed Advisory Board, through December 31, 2017. DEBONE: Move approval. BANEY: Second. Commissioner Baney has been giving a lot of consideration about the marijuana issue and wonders why there are differing deadlines for different aspects. She would like to propose the idea of the Board considering reading next week's regulations by emergency with an effective date more in line with what was already adopted. Minutes of Board of Commissioners' Business Meeting Wednesday, June 8, 2016 Page 6 of 8 Medical marijuana regulations will take effect immediately. The recreational regulations do not go into effect until the ban is lifted. Unfortunately, they have to use the word "emergency", but there are concerns regarding impacts to law enforcement, code enforcement and medical issues. Otherwise, the regulations won't go into place until the opt out is lifted. She would like them to articulate this now, and then talk about the opt out ban ordinance relating to recreational marijuana later in the summer. Chair Unger said he supports with the emergency adoption, because the State has blurred the lines so badly, and created less clarity. Commissioner DeBone stated that having two different sets of effective dates is awkward. There are a lot of questions about what is effective when and why. He is not against this to start, and they will see if they can get there. Nick Lelack and Matt Martin stated that with the help of County Counsel, they can change the language of the ordinances accordingly. Commissioner Baney said that in the past, they have talked about determining an effective date of less than 90 days for emergency ordinances, and instead have it be 30 days like the cities. They have done this on occasion to be more consistent with laws passed by the cities or to comply with State law. She asked if they can set a specific timeframe for these ordinances to be effective. She wants to try to reign in the medical marijuana regulations as soon as possible. David Doyle said that they already adopted the medical marijuana regulations by emergency and those were effective at that time, on June 1. Commissioner DeBone stated that the others just had first reading, so all that needs to be changed for those for the second reading is adding the emergency language. Mr. Lelack asked if the Board needs some kind of additional timeframe between first and second readings, or if they want to just set an effective date after second readings, other than it being immediately. Mr. Doyle stated that they can indicate the timeframe next week. It could be immediately, or some other number of days out. Commissioner DeBone mentioned the opt out passed last year, and said he is not opposed to discussing this some more next week.
