BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
ACTING AS THE GOVERNING BODY OF THE SUNRIVER LIBRARY COUNTY SERVICE DISTRICT
A Resolution Initiating the Dissolution of the * RESOLUTION NO. 2016-047
Sunriver Library County Service District.
WHEREAS, the Sunriver Library County Service District ("District") was formed in 1994 for the
purpose of financing capital construction of library facilities in Sunriver; and
WHEREAS, the final payment of $92,565 for the District's general obligation bond was paid on June 1,
2016; and
WHEREAS, as of the date of this order the District levied taxes in the amount of approximately $89,955
for the 2015-2016 tax year; and
WHEREAS, the only asset the District has remaining is approximately $3,020 in funds that the District
received from tax collections in excess of the money required for the final payment on the District's bond; and
WHEREAS, because ORS 198.930 allows the transfer of all assets of a dissolving district to a district
which has authority to and agrees to continue to furnish similar services to the inhabitants of the district, this
dissolution plan includes transferring the above described approximately $3,020 to the Deschutes Public Library
District ("DPLD") for capital expenditures for libraries in Sunriver upon receipt of a resolution from the DPLD
that it agrees to use such funds only for that designated purpose; and
WHEREAS, on June 22, 2016, the DPLD submitted to the County a resolution in which the DPLD
agreed to accept the transfer of funds and restrict them to library capital improvements within Sunriver; and
WHEREAS, the District has no other outstanding bonds, coupons, or other indebtedness, interests in
real property, uncollected tax assessments or charges, personal property or any other assets; therefore, no other
plan for dissolution is necessary; and
WHEREAS, the estimated cost of the dissolution is less than $6,000 because the only costs incurred will
be for the staff time of the Deschutes County Finance, Assessor and Legal Departments incurred in preparing
the dissolution resolutions and orders and to transfer the above described excess funds to the DPLD; and
WHEREAS, pursuant to ORS 198.940(4), the Board of County Commissioners may declare a County
service district dissolved when "the district is no longer necessary for the purpose for which it was formed...";
and
WHEREAS, because the construction of the building housing the library is completed and all bond debt
service and payments will be completed as of June 1, 2016, the remaining approximately $3020 will be
transferred to the DPLD and the District has no other assets or indebtedness, the District is no longer necessary
for the purpose for which it was formed; now, therefore,

THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ACTING
AS THE GOVERNING BODY OF THE SUNRIVER LIBRARY COUNTY SERVICE DISTRICT, HEREBY
RESOLVES as follows:
Section 1. On or before June 30, 2016, the Deschutes County Finance Director or the Director's
designee shall transfer the District's excess funds to the DPLD after the final District bond payment.
Section 2. The District recommends to the Board that the District should be dissolved as of June 30,
2016.

RESOLUTION
DESCHUTES PUBLIC LIBRARY DISTRICT
LIMITING USE OF FUNDS RECEIVED FROM DESCHUTES COUNTY AS A RESULT OF THE
SUNRIVER LIBRARY COUNTY SERVICE DISTRICT'S DISSOLUTION
WHEREAS, the Deschutes County Board of Commissioners, acting as the governing body
of the Sunriver Library County Service District, has determined that, after the final payment of
outstanding bonded indebtedness and the County's costs of dissolution, there will be excess funds
remaining in the account of the Sunriver Library County Service District; and
WHEREAS, ORS198.93o allows the transfer of the assets of a dissolving district to a district
which has authority to and agrees to continue to furnish similar services to the inhabitants of the
District; and
WHEREAS, the transfer of funds is conditional upon Deschutes Public Library District
agreeing that the funds shall be used only for library capital expenditures within the boundaries
of Sunriver,
NOW, THEREFORE, BE IT RESOLVED by the Deschutes Public Library District that all
funds received from the Sunriver Library County Service District resulting from the dissolution of
the Sunriver Library County Service District shall be segregated and expenditures of those funds
limited to library capital expenditures within Sunriver.
ADOPTED this 8th day of June by the Deschutes Public Library District's Board of
Directors.
