Board of Commissioners present were Albert Young, Robert Paulsen, and Clay Shephard Agenda: County Counsel noted a letter to the applicant for the Starwood development was sent on behalf of the Board of Commissioners on July 6, 1979 asking questions suggested from the review of the record. Once the Board reviews the responses a date will be set for a proposed Order. Applicant, Mr. Pickett, was asked to give any comment related to this matter. The questions to the applicant were as follows: • First question was Starwood to be a destination resort as is Sunriver. The response it that it would be a permanent residence and not tourist destination. The response was a discussion on compliance with lands use requirements. Ordinance PL5 was reviewed. According to the applicant, this is not a planned unit development but is a mobile home subdivision. • Is a planned unit development permitted conditionally in an Al Zone? The applicant stated the development is not in that area. The applicant stated he believes an Al Zone is the same as an R1 Zone and this development is permitted. Are R1 Zone conditional uses in an Al Zone. The applicant stated yes because going from Al to R1 the conditional uses are the same. • Have the five criteria of PL5 been established. The applicant stated the development is not in that section. The applicant recalled his dealings with the Planning Commission and considers the development to be legal. Questions raised on zoning and county ordinances. Discussions held on mobile home subdivisions. Discussion held on whether appropriate to bring before the Planning Commission or Hearings Officer. The applicant stated in his opinion the Board doesn't not have jurisdiction to hear this case. In order to meet LCD requirements and standards regarding urban sprawl this project needs to have commercial uses in order to be approved according to the applicant's attorney. Commercial uses may not have been addressed with the hearing's officer. Discussion held on the site plan map for the mobile home park and identified as exhibits 10, 11, and 14. Commissioner Paulsen noted the actual site plan map on approving the mobile home subdivision is not included in the record. Discussion held on appropriate fencing for the site. Purpose of today's meeting was to clarify the issues with the mobile home subdivision. An order was proposed for consideration. Page 2 of 3 Transcription of Audio Recording of July 23, 1979 MOTION: Commissioner Young proposed that due to the fact that the April 27, 1979 Order was illegal and unconstitutional and due to the fact that this Board does not have the jurisdiction to do what they are doing and due to the fact that there is a conflict of interest by one member of the Board, moved that this proceeding be discontinued post haste and the decision by the Planning Commission be sustained. No support to the motion was made. Commissioner Shephard noted he took exception to the comment made that the Order was unconstitutional and also that one member had a conflict of interest as the State's Ethics Commission felt Commissioner Paulsen ruled that he is fully capable of participating. The applicant's attorney requested a copy of the letter to the Ethics Commission. Commissioner Young strongly objects with this entire hearing. Commissioner Shepherd reiterated the next step would be to propose an order. The Order will be drafted and a public hearing will be scheduled for Friday, August 10, 1979. Discussion held on whether or not it was previously approved under the zoning classification of RH8.
