DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, JUNE 20, 2016
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Alan Unger, Tammy Baney and Anthony DeBone.
Also present were County Administrator Tom Anderson and Deputy County
Administrator Erik Kropp; Dave Doyle, County Counsel; Whitney Hale,
Communications; Christina Partain, Finance; Sgt. Nathan Garibay and Capt.
Deron McMaster, Sheriff's Office; Matt Martin, Community Development; and
approximately a dozen other citizens. No representatives of the media were in
attendance.

4. Before the Board was Consideration of the Reading and Board Signature
of a Proclamation recognizing Amateur Radio Week.
Sgt. Nathan Garibay gave an overview of the services provided by amateur
radio operators in the area, who donate hours of their time to support law
enforcement and emergency services organizations. They offer a great
contingency plan in times of serious disasters.
Commissioner DeBone encouraged people to learn more about what this group
does. Mr. Garibay stated they are hosting a field day in Sisters this coming
weekend for the public to see what they do. Commissioner Baney added that
the ham radio folks provide a very valuable service that many people do not
know about.
Commissioner DeBone read the proclamation at this time, a copy of which is
attached for reference.

5. Before the Board was the Bicycle & Pedestrian Advisory Committee
Annual Presentation of "Big Chainring" and "Safe Sidewalks" Awards.
Cheryl Howard explained the role of BPAC and its history. They have evolved
over the years, and this is a hard-working committee that advocates alternative
transportation, such as bicycling and walking. She then listed the members of
BPAC. They have three standing sub -committees and some members sit on
other committees regionally with various agencies and private companies.
They are a part of COACT for the tri -county area. They have also been able to
identify champions of BPAC in other counties.
The sixth annual bike -ped summit will be focused on La Pine, which is dealing
with many issues common to all communities, including a major highway going
through it. The summits allow them to measure how they are doing and enable
them to share resources and ideas. The State summit is being patterned after
what is being done here on a regional basis.

They could not do this by themselves, and rely on community and agency
support. They recognize those businesses and organizations that not only meet
certain goals, but exceed them. Both nominations came under the community
of Sisters.
A Safe Sidewalks Award is going to Bi -Mart, which provides clear and safe
access all year long. Mary Ellen Wheeler, Manager of the Sisters Bi -Mart,
accepted the award. The other Safe Sidewalks Award went to Melvin's First
Street Market in Sisters. (No one was available to accept this award.)
The Big Chainring Award has been in place since 1996. The winner, Therese
Madrigal, is the Chair of Commute Options but was unable to attend today, so
Jeff Munson was present to accept the award. Ms. Madrigal has worked
tirelessly to enhance bicycling in the region. Mr. Munson said that they just
had their 25th anniversary at Commute Options.
The remaining winner was nominated by ODOT, for active transportation
redesign. BPAC decided that Bob Bryant of ODOT should get a Lifetime
Achievement Award for all of his contributions over the years. Many projects
are still coming forward that Mr. Bryant has championed. Mr. Bryant thanked
the Board of Commissioners since much of this work would not have been
accomplished without the support of the County and many others.
Ms. Howard thanked the Commissioners for their active support, and Matt
Martin of CDD; as well as the other members of BPAC past and present. Chair
Unger thanked Ms. Howard for her continued leadership and the work of the
other members. He also acknowledged staffs efforts as employees and active
participants.
6. Before the Board was Consideration of Board Signature of Document No.
2016-345 Amending an Agreement with Telmate for Inmate Telephone
Services.
Tom Anderson explained the item, which provides for phone services for
inmates in the jail. With this document, the rates can be changed based on FCC
adjustments to law.

7. Before the Board was a Public Hearing and Consideration of Adoption of
the Deschutes County FY 2016-17 Fee Schedule through Board Signature
of Resolution No. 2016-014.
Christina Partain said that the fee schedule was reviewed by the Board a few
weeks ago. Adjustments were made to various fees as appropriate. The Fair &
Expo fees have been added this year to cover charges for use of the facilities, as
negotiated and at the discretion of the Director. David Doyle had advised that
the Internal Auditor felt these should be listed, so this is somewhat of a
compromise. Mr. Anderson stated that the facilities are used by nonprofits, but
the other users of the facilities often want to negotiate a rental rate that the
Director is well suited to handle, based on demand and competition.
Chair Unger opened the public hearing.
Carol MacBeth of Central Oregon Landwatch testified that they feel the appeal
fees are misallocated, and should be allocated towards those who are asking for
land use approval and not across the board. These should apply to the people
who are applying for the permit. The applicant is the one receiving the benefit
of the fee. The Supreme Court has heard this kind of issue a couple of times.
The County cannot charge a fee for a generalized benefit to everyone in the
County. The hearing itself is an individualized benefit and should be for just
that applicant.
She said it cost $250 to appeal to the Commissioners in Harney County.
Applicants have to exhaust their remedies before LUBA will hear something.
However, the fees are so exorbitant in Deschutes County that no one can pay
them. Others charge $400 to LUBA, or $373 to the Court of Appeals, so she
asked why the County's fees are so high. ORS allows the County to charge
fees but these are too high for most people.
This cost must be related to the actual cost of service. If an Administrative
remedy is not the only way to exhaust remedies, they are supposed to have
other avenues, but most people cannot afford the hearings process at the
County. They are required to come to the County but most people cannot
afford the cost. This is almost a guarantee that they cannot move forward.

The fees for individual actions should benefit the applicant and not be thought
to benefit everyone and therefore result in high costs. She feels this violates the
Oregon Constitution, since this means justice is for sale, and it should not be.
Just become someone is poor does not mean they should not be able to get
justice under the law. But Deschutes County makes this unaffordable to many.
She said that this cost can be around $11,000, about what it costs for one year
of college.
Commissioner Baney said they work diligently towards hearing public
testimony and outreach to get questions answered early in an issue. They also
try not to use tax dollars to offset costs of service. They don't want to charge
more for some things to handle appeals. She sees that the cost of an appeal is
$2,600. There is a lot of work that goes into preparing information for appeals.
With applications or appeals, they want to recover the actual cost of services so
as not to have others support a certain case. She is not sure how Harney County
could charge so little. She asked if the $11,000 is a true price tag.
Nick Lelack said the fee is $2,600 plus 20% of the original fee. He does not
know where $11,000 came from for this applicant but will find out. $2,600 is
the base fee for twenty hours of legal processing of an appeal for the Board.
There can be a lot of work put into this. The 20% comes from the staff time to
assemble the record and participate in the meetings and more. These cases are
becoming more complicated and that drives up staff time and the cost.
This is a financial and policy decision of the Board. CDD issues about 96% of
all land use decisions administratively. The initial appeal to the Hearings
Officer requires a $5,000 deposit. There are times when that cost is higher and
the applicant or appellant has to cover it. Alternatively, if they use staff time
for one applicant, they have to reallocate resources away from other applicants
and work.
Mr. Kropp asked if the fee before the Board is proposed to be higher. Mr.
Lelack said they did not propose this fee go up, but the 20% of the original fee
would because other fees are going up that affect the 20%.
Ms. MacBeth stated that the County keeps accurate records and knows how
many times certain issues are appealed. This could be averaged out. The
destination resorts often benefit the most, while the smaller property owners
cannot afford to go through an appeal or a hearing. Destination resorts know
this is a cost of doing business. For the individual, the high cost is a huge
barrier.

Mr. Lelack replied that this would mean those cases that are not appealed would
still end up supporting the costs for others that are appealed. Commissioner
Baney said that the destination resorts often pay more because their cases are
very complicated. She would like to see some of the costs negated whenever
possible.

BACKGROUND AND POLICY IMPLICATIONS:,
The Deschutes County Bicycle and Pedestrian Advisory Committee (BPAC) has selected the 2016 "Big
Chainring" Award recipients. Since 1996, the Big Chainring Awards have been awarded annually to
honor individuals, businesses, public agencies, and advocacy groups that have made significant
contributions in the support of better bicycling and walking in Central Oregon.Staff and BPAC
members request that the Board assist in the presentation of two awards this year including the
following: the Big Chainring awards to Therese Madrigal (Individual Category) and Bob Bryant
(Lifetime Achievement Category).
The BPAC has selected the 2016 "Safe Sidewalks" Award recipients. Since 2006, the Safe Sidewalks
Awards have recognized those businesses and property owners who not only fulfill, but also often
exceed the legal requirements of keeping their sidewalks safe and clear of debris and hazards this past
year. Staff and BPAC members request that the Board assist in the presentation of 2 awards this year.
The winners are Sisters Bi -Mart and Melvin's Fir Street Market.

DECLARING AMATEUR RADIO WEEK - JUNE 20-26, 2016
WHEREAS, Amateur Radio operators are celebrating over a century of the
miracle of the human voice broadcast over the airwaves; and
WHEREAS, Amateur Radio has continued to provide a bridge between
peoples, societies, and countries by creating friendships and the sharing of ideas;
and
WHEREAS, Amateur Radio Operators have also provided countless hours
of community services to emergency service agencies and to other local
organizations throughout these decades; and
WHEREAS, the Amateur Radio services are provided wholly uncompensated;
and
WHEREAS, the County of Deschutes also recognizes the services Amateur
Radio operators provide to the Deschutes County Emergency Management and to
our many civilian Emergency Response organizations, including the American Red
Cross, the Oregon Department of Transportation, and the region's hospitals; and
WHEREAS, these same individuals have further demonstrated their value
in public assistance by providing free radio communications for local events such
as bicycle events and marathons where no other communications are available, and
participate in disaster preparedness presentations throughout the county; and
WHEREAS, the County of Deschutes recognizes and appreciates the
diligence of these "hams" who also serve as weather spotters in the Skyward
program of the US Government Weather Bureau; and
WHEREAS, the American Radio Relay League (ARRL) is the leading
organization for Amateur Radio in the USA; and
WHEREAS, the ARRL Amateur Radio Field Day(s) exercise will take
place on June 25-26, 2016, and is a 24-hour emergency preparedness exercise and
demonstration of the Radio Amateurs' skills and readiness to provide self-
supporting communications without further infrastructure being required;
NOW, THEREFORE, BE IT RESOLVED, that we, the Board of
Commissioners for the County of Deschutes, do hereby recognize and designate
June 20-26, 2016, as Amateur Radio Week in Deschutes County.
