Date for Public Hearing for Petition filed for * ORDER NO. 2016-033
Withdrawal from Sisters -Camp Sherman Rural
Fire Protection District
WHEREAS, in accordance with ORS 198.870, a petition requesting withdrawal of property from
Sisters -Camp Sherman Rural Fire Protection District was duly filed with the Deschutes County Board
of County Commissioners ("Board") on or about February 12, 2016; and
WHEREAS, the Jefferson County Assessor's Office on July 21, 2016, verified that the withdrawal
petition was signed by the real property owner seeking withdrawal; and
WHEREAS, ORS 198.800(2) requires the county board to set a date for a public hearing on the petition
no earlier than 30 days and no later than 50 days from the date of filing; and,
WHEREAS, the next available hearing date within that time frame is September 14, 2016; and
WHEREAS, ORS 198.800 requires notice of the hearing to be given via posting in a public place
and by publication; now therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON,
HEREBY ORDAINS as follows:
Section 1. The petition for withdrawal of property from Sisters -Camp Sherman Rural Fire
Protection District, a copy of which is attached hereto as Exhibit "1" and incorporated by reference, is
hereby accepted for filing.
Section 2. A public hearing on the petition shall be held on September 14, 2016, at 10:00 a.m. at 1300
NW Wall Street, First Floor Hearing Room, Bend, Deschutes County, Oregon.
Section 3. Notice of Hearing shall be given in substantially the form set forth in Exhibit "2," attached
hereto and by this reference incorporated herein. In accordance with ORS 198.800 the Legal Department
shall cause the notice to be published in The Bulletin on two (2) occasions, the first on or before August 30,
2016, and the second on or before September 9, 2016, and posted on or before August 30, 2016, in three
public locations within the county as follows: One notice shall be posted on or near the doors of the meeting
room of the Board of County Commissioners; one notice upon any official bulletin board customarily used
for the purpose of posting public notices within the county; and one notice shall be posted upon any official
public bulletin board customarily used for posting notices within the district. Notices shall be posted for not
less than five (5) consecutive days.

OF DESCHUTES COUNTY, OREGON
On September 14, 2016, at 10:00 a.m., the Deschutes County Board of Commissioners will hold
a public hearing to consider a petition filed by the United States Forest Service for withdrawal of
its property from the Sisters -Camp Sherman Rural Fire Protection District. This hearing will be
held in the Board of County Commissioners' Hearing Room, First Floor, 1300 NW Wall Street,
Bend, Oregon. All interested persons may appear and be heard.
The property Petitioner proposes to withdraw is comprised of several tracts of primarily
uninhabited land in Jefferson County, street address is unavailable. To view maps and legal
descriptions of the boundaries of the proposed withdrawal, contact the Deschutes County
Counsel's Office at 541-388-6622. The purpose of the proposed withdrawal is to remove from
the district certain property that does not use district services.

6. A description of the boundaries of the territory to be withdrawn is attached hereto and marked
Exhibit "A" and depicted on the map attached as Exhibit "B".
7. That said Petition has been signed by at least 15 percent of the electors, or 100 electors,
(whichever number is lesser) registered in the district, or at least 15 owners or owners of 10
percent of the land, (whichever is greater) within the area proposed to be withdrawn.
8. The above listed district has not or cannot feasibly service the territory proposed to be
withdrawn because (brief descriptimn):
— The US Department of Agriculture, Forest Service (USFS), is the primary fire protection agency to
respond, control and mitigate wildland fires within the area of lands that are proposed to be withdrawn
from the Sisters -Camp Sherman Fire District solely within the boundaries of]efferoon County.
The original Camp Sherman Fire District boundary lines were established before being consolidated with
the Sisters Fire District recorded March 15, 1989. The Camp Sherman boundary lines were defined upon
formation to be the same boundaries as the Black Butte School District which reduced the District
formation costs by using existing boundaries of another District that already had the exact legal
descriptions for the Department of Revenue. This procedure may have been Iess expensive but also
brought a vast amount of USFS properties into the Fire District which pays no property taxes to the Fire
District. The majority of the USFS property within the Fire District is very remote with no road access
and it would be nearly impossible for the Fire District to adequately combat a fire with the limited
equipment and personnel they have trained in wildland fires.
Due to the dangers of wildland firefighting and the limited wildland firefighting resources available to
the Fire District for combating forest fires within the established fire district boundaries within Jefferson
County, and that only the most remote lands solely under the responsibility of the USFS without valued
structures on these identified lands that may require a need for a City -Rural Fire Protection District to
provide fire protection, it is the request of the USFS to remove these lands from the Sisters -Camp
Sherman Fire Protection District. The USFS will continue to utilize the Sisters -Camp Sherman Fire District
through "Mutual -Aid" contracts to assist in the protection when structures may be threatened from a
wildfire or forest fire. Sisters Camp Sherman will also continue to be the primary responder for the few
structures owned by the USFS and those privately owned structures that are located on lands leased
from the USFS within the original boundary area.

WHEREAS, the Board of Commissioners of Deschutes County
having received the Certificate of Election from the Sisters
Rural Fire Protection District and the Camp Sherman Rural Fire
Protection District of the fact of an affirmative vote by the
electors of each of the respective districts at the election of
September 20. 1988, upon the question of whether the Camp Sherman
Rural Fire Protection District should be merged into the Sisters
Rural Fire Protection District, marked Exhibit A, and attached
hereto and by this reference incorporated herein;
WHEREAS, Deschutes County being the principal county as
defined in ORS 198.705; now, therefore,
THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY,
OREGON, ORDERS AS FOLLOWS:
Section 1: That the territory within the boundaries of the
Camp Sherman Rural Fire Protection District (Jefferson County),
depicted on the legal description marked as Exhibit C, attached
hereto, is hereby merged into and a part of the Sisters Rural
Fire Protection District (Deschutes County) as depicted by the
boundaries shown on Exhibit B, attached hereto.

RESOLUTION
WHEREAS, An election was held in the Sisters Rural Fire Protection
District, Sisters, Oregon, and the Camp Sherman Rural Fire Protection
District, Camp Sherman, Oregon, on September 20, 1988, and
WHEREAS, the election was held to determine whether the Camp
Sherman Rural Fire Protection District should merge with the Sisters
Rural Fire Protection District, and
WHEREAS, an affirmative vote total of 525 yes to 92 no was
certified by the Deschutes County Clerk as received from voters in
the Sisters Rural Fire Protection District, and an affirmative vote
of 80 yes to 27 no was certified by the Jefferson County Clerk ;1s
received from voters in the Camp Sherman Rural Fire Protection
District.
THEREFORE BE IT RESOLVED, that the Sisters Rural Fire Protection
District acknowledges the affirmative merger of the Camp Sherman
Rural Fire Protection District to the Sisters Rural Fire Protection
District effective June 30, 1989 as approved by the voters of the
two district's.
