Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy County Administrator; Dave Doyle, County Counsel; George Kolb, Road Department; Nick Lelack and Matt Martin, Community Development; and two other citizens. A representative of KTVZ TV was also in attendance. 1. CALL TO ORDER Chair Unger called the meeting to order at 10:00 a.m. 2. PLEDGE OF ALLEGIANCE 3. CITIZEN INPUT None was offered. Minutes of Board of Commissioners' Business Meeting Monday, August 1, 2016 Page 1 of 6 Chair Unger allowed a citizen to speak about something that he thinks may be slightly related to an item on the agenda. Janet Dorgan of Redmond said she has been studying proposed Measure 97 and how it might impact the marijuana industry. It will be on the ballot in November. It is meant to make large industries pay their own way, starting out at $25 million before they pay the costs of equipment, materials, payroll and other expenses. Farmers will be impacted. She thinks this will force people to the black market because that will avoid the taxes and maybe they can stay in business. She is worried about this going underground. Then, regulations won't be meaningful. She wants the marijuana people to understand the implications of Measure 97. Chair Unger asked that she provide more information via e-mail or letter. Ms. Dorgan stated that in her husband worked in the pulp and paper industry, where odor, water, and other negative impacts were a problem. The industry voluntarily worked to mitigate this. She wonders how many people would tolerate that kind of business here. It is highly regulated and a viable industry. Commissioner Baney said that the marijuana industry is already here, and they are trying to find a balance. The County operates under the State, and is trying to find ways to have everyone work together. Ms. Dorgan wanted to see the Board exercise the opt out and let the voters decide. Commissioner Baney said that this is already a legal business and much related to it is outside of the control of Deschutes County. Ms. Dorgan asked about the Tumalo sign, and why it is being paid for by public funds. She does not like how it looks. (Item #6 on the Consent Agenda.) Chair Unger said the County can use discretionary lottery funds for nonprofits and projects that help enhance business in Deschutes County; for this project, through an application from the Tumalo Business Association. Therefore, the business community applied for and received a small grant to allow them to complete the signage project. Commissioner Baney said that Tumalo does not have a city council or any other way to support businesses there, so this is an appropriate use of economic development funds. Before the Board was Consideration of Chair Signature of Document No. 2016-427, a Notice of Intent to Award Contract Letter to Knife River Corporation for the Paving of Dodds Road. George Kolb gave a brief overview of the item, noting that there were three bidders. He recommended issuing the notice of intent to award to Knife River. Before the Board was Consideration of First and Second Readings, by Title Only, and Adoption by Emergency, of Board Signature of Ordinance No. 2016-012, Rescinding the Opt Out regarding Marijuana -related Business as Established by Ordinance No. 2015-009. Nick Lelack provided some details of this item, referring to his staff report. Commissioner Baney stated she spoke with a City Councilwoman who said the City uses thirty days for adoption of ordinances. Commissioner Baney added that this is consistent with the cities. Commissioner DeBone stated that this coincides with the marijuana regulations that are already in place. Chair Unger said he doesn't know why the County has a ninety -day emergency clause, perhaps tied to the State. He is comfortable going forward with this now. A lot has changed from last December. The County is ready to address the problems and to create an atmosphere of allowing opportunity but also protecting rural lifestyles. Commissioner Baney appreciates the incredible amount of work done by the team. They won't be able to take care of all of the black market issues or solve all problems, but this is a new, legal industry and they hope to find balance. Commissioner DeBone said that there have been a number of State bills that deal with this. The voters passed Measure 91. There has been a tremendous amount of work for everyone to adjust to this, to figure out what enforcement looks like, and how to live together as a community. There are a lot of pieces to still come together. Chair Unger said he appreciates the County Health Department's work towards appropriately educating the public as well.
