Board of Commissioners present were Albert Young, Robert Paulsen, and Clay Shephard Chair Young called the meeting to order. AGENDA: Appeal Hearing on Mountain High Hearings Officer report requests a hearing. Confusion whether this hearing is on a plat MP 79-132. Decision of planning commission on approval of plat 538 Sunnyside Boulevard caused confusion of requirement of lot 600 be added to the plat and as a result the Sunnyside Boulevard would abut to the plat. The Board is being asked to consider the appeal of the Planning Commission's decision. Chair Young asked if there were any challenges to come forward. Hearing none, he opened the hearing. Report heard on the Sunnyside Boulevard development and the concerns of public safety. The Hearing's Officer questions whether the county has authority to acquire conditions on the construction of Sunnyside Boulevard. County Counsel's opinion regarding this matter the portion of traffic impact report is the maximum impact is to increase traffic on Murphy Road to a 33% increase of traffic. The other item to consider is legal authority for subdivision improvement requirements and off-site improvements can be required to consider cost share with road improvements. With the top priority being the completion of Murphy Road, the recommendation is to impose a cost share program for the road improvement. The question of the appeal is whether the subdivision has adequate access. Discussion held on traffic concerns and the concerns of legal issues with the subdivision. MOTION: Commissioner Paulsen moved approval of plat 538 contingent on a major partition being applied for and received with Sunnyside Boulevard right of way being granted as a condition with no construction requirement relating to the approval of Mountain High. Commissioner Young supported. VOTE: PAULSEN: Yes SHEPHARD: Yes YOUNG: Chair votes yes. Motion carried. Discussion regarding appointment of Juvenile Commission: With the recent passing of the Juvenile Services Act, the request is to proceed with advertising for applicants and appointing a commission. Commissioner Shepard supported. VOTE: PAULSEN: Yes SHEPHARD: Yes YOUNG: Chair votes yes. Motion carried. Citizen Input: Zoning of Commercial Property: Citizen Mr. Arnst brought a property concern to the Board. Discussion held a concern from Mr. Arnst on commercial zoning in property location not specified for the record. Procedurally any zoning change has to be applied for through the Planning Commission. Zoning of Trailer Court: Developer of a trailer court brought concern of zoning before the Board. Developer requests the property north of Bennett Butte Road and east of Highway 97 to be included in the compatible zone. The current trailer court has been there for 25 years and was never included in the zoning. Personnel Request: A discussion held on the need for temporary help in a department where a staff member was injured in an accident on work time. Commissioner Shephard supported. VOTE: PAULSEN: Yes SHEPHARD: Yes YOUNG: Chair votes no. Motion carried Deschutes County Deed to Kenneth J Roth: Deed for property purchased on a recent Sheriff's Sale. MOTION: Commissioner Young moved the deed be executed. Commissioner Paulsen supported. VOTE: PAULSEN: Yes SHEPHARD: Yes YOUNG: Chair votes yes. Resolution to set Hearing: Chair Young read the Rural Fire District #2 annexation resolution into the record to set a hearing for April 2, 1980. MOTION: Commissioner Young moved adoption. Commissioner Paulsen supported. VOTE: PAULSEN: Yes SHEPHARD: Yes YOUNG: Chair votes yes. Motion carried.
