MINUTES OF BUSINESS MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS.
MONDAY, OCTOBER 17, 2016
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Alan Unger and Anthony DeBone; Commissioner
Tammy Baney was out of the office. Also present were Tom Anderson, County
Administrator; Erik Kropp, Deputy County Administrator; Dave Doyle, County
Counsel; Nick Lelack, Anthony Raguine and Paula Mason, Community
Development; and six other citizens.

Chair Unger called the meeting to order at 10:00 a.m.

Citizen Susan Whitney Kurtz of Tumalo spoke about her history living in Bend
since 1977. She encouraged the Board to support Troy Field staying as public
space. It existed before Deschutes County (she presented historic photos).

She indicated that it was donated for public use many years ago. She feels there
is no leadership in the City of Bend that holds this vision. The County owns
Reid School next door and she thinks that the County should be involved in this
issue. This civic space is threatened by development. She would like to see
the County do a land swap for this parcel, perhaps land for future school sites.
Chair Unger indicated that he would like to see this on a future Board agenda
for discussion. Commissioner DeBone added that this is the way things should
begin.
Before the Board was Consideration of Approval of the Consent Agenda.
DEBONE: Move approval with a minor change to the minutes, regarding the
number of pre -application marijuana business meetings held by
Community Development.

ACTION ITEMS
13. Before the Board was a Public Hearing and Consideration of Board
Signature of Document No. 2016-661, a Noise Permit Requested by ODOT
for Nighttime Pavement Preservation Work on Highway 20, South of
Sisters.
Anthony Raguine provided a staff report on the item and the hearing process.
There were no disclosures of bias, ex parte contacts or conflicts of interest, and
no challenges from the audience. He referred to a PowerPoint presentation
showing the map involved, as well as the conditions of approval. Work will
take place between May 1, 2017 and the end of September 2017.
Bob Townsend of ODOT clarified the location and name of the quarry for
material. They will do all they can in the daytime, but on a highway such as
this one, with a two-inch inlay of asphalt, it could result in delays of up to an
hour. Therefore, they will do the main work at night.
He said they will try to set a range of time for noticing citizens who live nearby
of the impact, but this can change due to weather or other issues.
Citizen Lisa Shaddox, 17440 Cascade Estates Drive, said she understands this is
a large project but she is concerned about safety issues. She asked if there are
plans to make safety improvements such as adding turn lanes or widening
shoulders. She feels this is important based on the increasing amount of traffic.
Mr. Townsend said this is a common discussion when they are doing
preservation work. The funds are for surfacing the roadway. If they tie
additional safety work to this, it delays the project by years. The centerline
rumble strips are going to be added and they are very effective.

He added that Highway 20 is part of the corridor safety study, and there are a
lot of crossroads to address. This is an ongoing study but would likely only
affect areas where there is crash history. This is a difficult situation and they
are constantly looking at this. It won't be wasted money, since improvements
can be added as funds are available.
Chair Unger noted that he knows solutions are being examined because of
increased use. This is something that ODOT is trying to address. He said this
part of the highway has had some weather heaving. Mr. Townsend said they
are using a different type of material to minimize this.
Being no further testimony, the hearing was closed.

14. Before the Board was a Public Hearing and Consideration of Board
Signature of Document No. 2016-675, a Noise Permit Requested by ODOT
for Nighttime Pavement Preservation Work on Highway 20, North of
Sisters.
Chair Unger opened the hearing at this time.
.Paula Mason provided an overview and a PowerPoint presentation. This noise
variance is for Highway 20 north of Sisters. There were no disclosures of bias,
conflicts of interest or ex parte contact, and no challenges from the audience.
The presentation detailed the location of the work to be done. ODOT will need
to do nighttime construction. A centerline and rumble strips will be added.
Work will begin on May 1 and end by June 1, 2017, and will entail four nights
of work.
Chair Unger asked if the Nugget Newspaper will be used to notify Sisters
citizens. Ms. Mason said that all affected property owners have been
specifically notified. They will also be paving inside city limits. Mr.
Townsend added that there has been a massive campaign about road work
around Sisters, and the community has been very involved. This is being
arranged to help avoid future backups of traffic into Sisters.

Tom Anderson said they are doing a remodel at the Road Department to add
meeting space, lockers for workers and other badly -needed improvements.
