DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, OCTOBER 31, 2016
Present were Commissioners Alan Unger, Tammy Baney and Anthony DeBone.
Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy
County Administrator; Dave Doyle, County Counsel; Chris Doty and George Kolb,
Road Department; Peter Gutowsky and Peter Russell, Community Development;
James Lewis, Properties; Whitney Hale, Communications; and eight other
citizens including media representatives Hilary Corrigan and Richard Coe of The
Bulletin.
Chair Unger opened the meeting at 1:30 p.m.
1. Update on South County Economic Development Activities.
Janet Burton of EDCO gave a PowerPoint presentation and explained the
three-year strategic plan for south County. The last year was a year of growing
up, when compared with other regional cities that have been established for a
long time. They put in some good foundational pieces and decided what they
want to achieve in order to move forward.
She referred to her presentation to go over the details. They worked on
developing a voice and a brand for the La Pine area: "small town strong".
Commissioner DeBone added that this activity included representatives of all
entities in La Pine to help address any potential issues of undertow or
dissention.

Ms. Burton noted that they had one company start, one move into La Pine and
one expansion, adding 20 new jobs. This has brought about interest in the
industrial park as well. This could result in almost $500,000 in revenue for the
purchase of land if the option agreements are brought to a successful
conclusion. They worked on a template to provide guidance for handling land
sales. Once a purchase is made, the buyer has to build within a certain
amount of time.
There have been about 65 requests for assistance from businesses in the area.
New marketing materials are available on the website as well. They have
increased the level of information on the available land, what the
requirements are for development, and other details.
They had a good turnout at the first annual South County luncheon meeting.
Many people said they did not realize how much was going on. Sunriver-La
Pine Economic Development kicked off in July and now has 11 contributors.
The plan is to do more diverse outreach and marketing; workforce
development, attraction and retention; and additional outreach to the local
community. South County is a good option to the cities where the price of
land is becoming unreachable. Filling positions is difficult because many
potential employees live in Bend and do not want to commute; or they want
more activities like those found in the cities. They hope to do more outreach
to the schools and COCC. Commissioner DeBone noted that some people
purposefully want a more rural lifestyle and this is a good option for them.
Chair Unger said that the cities have a list of requirements for the purchase of
industrial property, because it was originally public land. Commissioner Baney
asked what property remains available. Ms. Burton said there are 126 acres
but some of this is not yet developed with infrastructure.
Commissioner Baney feels that the model being used is efficient and helps to
build partnerships. Small communities often have difficulty with change, but
Ms. Burton has made some good strides. Chair Unger thinks this is the right
path, and is grateful the County realized that the industrial park was needed
and developed the right partnerships to focus on the future there.

Commissioner DeBone thanked Ms. Burton for her assistance, and he is sorry
to hear she has announced she will be leaving EDCO.
2. Discussion of Parking Issues at Federal and State Parks.
Representatives of the U.S. Forest Service (Bill Munro, Amy Tinderholt, Kevin
Larkin and Jana Johnson) and Oregon State Parks (Scott Brown and Chris
Parkins) introduced themselves.
Chris Doty indicated that this group wants to address parking issues at some of
the local recreational facilities. There are some key problem locations, and
some are more challenging than others. He referred to a PowerPoint
presentation at this time.
There has been a strong increase in demand and the capacity for parking is no
longer there, so the road system has started to be used for overflow purposes.
The roads are not designed for this, especially where there are also
pedestrians and bicycles.
Smith Rock State Park, Cascade Lakes Highway, Big River Boat Launch and
Harpers Bridge.
Smith Rock State Park has up to 200 vehicles parked along the roads on
weekends. This is a safety problem; and a livability issue for local residents.
One hundred more spaces were added on site in 2016, but that was not
enough. They need to eliminate some of this parking on NE Wilcox on various
intervals. State Parks is going to update the site's master plan to determine
capacity for the park itself.
It was pointed out that they can't get around the safety issues there. Mr. Doty
added that there is no parking on parts of Crooked River Drive already.
There is growth in most of the parks, not just this one. Commissioner Baney
asked if Travel Oregon was consulted, because they have been heavily
advertising Smith Rock. She was advised that State Parks was not asked, and
some visitors are coming from as far away as other countries.

They surveyed 600 visitors this spring and asked about the distance traveled.
In general, this is a northwest and international destination, in particular for
wildlife observation. They are working on a multi-year plan to study capacity,
so they can protect the resource and decide whether to provide additional
facilities.
Chair Unger asked if there is a short-term solution in the meantime. Perhaps
some of the local pastures can be used for parking. Mr. Anderson noted that
this would involve a land use process. Mr. Doty said that they can prohibit
some parking. It is not known what the study will find.
Commissioner Baney stated that this doesn't solve the problem, it just takes
away. People might drive 100 miles and find they have to turn around or park
illegally. She was advised that it is more of a safety and neighbor issue at this
park, and not so much capacity at this time. Some are concerned about
damage to the resource eventually as well, but this is part of the master plan
process.
Cascade Lakes Highway.
Mr. Doty said that the parking lots become overrun with improper parking,
and people end up on the sides of the road. This is more than impacts to
parking and safety; there are impacts to resources and the scenic corridor as
well. There is also a lot of bicycle traffic. This area includes the Green Lakes
trailhead, Sparks Meadow and the Devil's Lake trailhead. Some of the parking
has taken place on curves in the highway, which is hazardous for foot traffic.
They can propose a prohibition of parking in this 2.5 -mile stretch of road. It
would be enforced by the Sheriff's Office.
It was pointed out that the trailheads are an issue. If there are vehicles on
both sides, there is no place for Search and Rescue or an ambulance to park.
They could limit it to one side. This is the third year of experiencing 20%
growth annually, and it is not tapering off. They would have to restrict it for
safety reasons. They have been working with Visit Bend and COVA to convey
messages regarding the rules. They are working with COIC on transportation
ideas, but there is not much to go on yet. A shuttle system is one idea. The
Welcome Station might help with the educational part. Visitor safety is their
first concern.

Ms. Tinderholt stated that wilderness planning has started, and use is already
outside acceptable levels for some areas. This might guide some user capacity.
They are working with Mt. Bachelor to direct people for transit and other
activities, and for an alternative summit route other than South Sisters. They
will work with the County and others over the winter on a communications
plan for a recreational application, to keep people informed about
alternatives.
Commissioner Baney asked if they can do something with speed limits,
technology or signage to inform people ahead of time. If they get there, they
will find a place to park. This needs to be managed in advance. Other places
have permitting systems. She does not want to see cars being towed.
Mr. Anderson asked if they can provide options, such as a shuttle or traffic
calming measures. He was advised that wilderness planning is a joint effort for
the National Forests, and it will likely lead to a permit system here eventually.
Some National Parks have a mandatory shuttle system now. Ms. Tinderholt
added that permits and a shuttle almost have to go hand in hand, or other
difficulties can arise.
Chair Unger stated that with all the marketing of this area, there has been
good and bad resulting. The timing is off in regard to solutions. They don't
want to invite people here just to have them end up frustrated. He was
advised that the groups are working well with COVA and others, and common
ground is being found. It will take a while to work this out.
Big River Boat Launch and Maxwell Bridge.
Mr. Doty indicated there are issues with the neighborhoods. This is a newer
issue and they have put up warning signs of congestion ahead. A lot of use is
focused in one area, which is multi -modal and vehicles travel at a high rate of
speed.
Mr. Doty said that the Board would have to sign an order relating to no parking
or a change of speed limits.

Commissioner Baney stated that she is not ready to make a decision. They
have no capacity to tow, and maybe not even to cite. If they don't, people will
figure it out. She was advised that there has been some success with ticketing,
which results in a $110 fine.
Commissioner Baney noted that they are not mitigating the problem of inviting
people here. They need to work on a marketing effort, shuttles or other things
to handle this. Let people know there might be a problem with capacity or
road safety. Chair Unger added that they need public outreach, not surprising
them at the last minute.
Commissioner DeBone said that there is a residential impact, such as at
Harpers Bridge and Smith Rock. Some places ae very restrictive. They need a
bus system that is working well, at least seasonally. Commissioner Baney
asked about creating a pilot program. She doesn't want to just surprise people
with signs and enforcement. There needs to be more involvement and ideas.
Mr. Anderson stated that they have not heard from some who may be
impacted, such as the Sheriff's Office. A public meeting might be a good idea
so that neighbors and agencies are involved. They want to avoid angering
people if there is not a good process in place. Travelers from other areas
might look at the COVA website ahead of time, but the locals won't. A shuttle
is not ideal, but is better than closing off the roads.
Commissioner Baney suggested that they contact Visit Bend. They want to
protect the natural resources, too. There is only so much capacity inside the
parks as well. Something needs to be done sooner than the master planning.
Chair Unger agreed that they need short-term solutions and a safety valve.
Groups have worked well together on other issues, and maybe there needs to
be a community conversation.
Commissioner DeBone asked if the agencies know how many visitors there are
per day, and what a healthy maximum number is. He was advised that the
natural resource levels are lower than traffic and parking, and they will
determine a saturation level with the plan.

Mr. Doty said he needs to know how this will work before throwing a bunch of
signs out. The Sheriff's Office was consulted and support whatever solution
the Board determines is best. Commissioner Baney said they should use
'congestion ahead' signs liberally, and establish clear zones around driveways.
They need to increase community awareness and involve community groups.
The Board said this is early in the process, and asked to hear further about
alternatives and ideas.
3. Other Items
In regard to the Sisters Eagle Airport, the Board discussed sending a letter to
the Nugget Newspaper. Commissioner Baney observed that there still isn't an
application. Peter Russell explained that he received materials, but the Airport
is waiting until after the election to do more. Commissioner DeBone said that
he has been at Economic Advisory Committee meetings, and this has gone
down other paths. They have a limited amount of time to extend water lines
and deal with other infrastructure.
Chair Unger asked if they should let the community know that the County can
help. Commissioner DeBone noted that the Airport is in the City of Sisters but
the housing being affected is not. Mr. Anderson said that the letter would let
the public know where the County is in the collective process. The issues are
expanding the boundary through the Oregon Department of Aviation process;
a runway extension beyond the footprint and into the homeowners'
association common area and outside the UGB; and parachutes landing on
public property within the County's jurisdiction, without a permit. The County
can address only some of this.
The Board discussed a letter to the Farm Bureau Federation regarding
cannabis operations, greenhouse lighting and dark skies regulations.
Commissioner Baney said she supports the letter as -is. The other
Commissioners agreed. Commissioner Baney indicated that she does not want
to revisit this part. It was very clear during the process. Chair Unger agreed
that the night skies regulations need to stay as they are.

The Board went into executive session at 3:20 p.m. under ORS 192.660(2)(e),
real property negotiations. The session adjourned at 4 p.m.
Whitney Hale presented a draft United Way welcome message from the
Board, to go on the website. The program kicks off this week. Commissioner
Baney said she struggles with the idea of supporting one nonprofit. People
need to be thanked for supporting nonprofits in general and not specifically
just one. Mr. Anderson noted that United Way is the global entity for
supporting a variety of agencies. Ms. Hale said that this is the message for the
United Way portal and not the message that goes direct to employees.
Ms. Hale reminded the Board of the veterans' event program. They will set
the stage ahead of time at 8 a.m. Discussion occurred regarding how to move
the various segments along smoothly, and about inviting first responders as
well. Commissioner Baney wants to acknowledge specifically those people
who cannot be there. Commissioner DeBone suggested that they include a
map showing the locations of the signs.
Commissioner. DeBone stated that the La Pine Chamber would like the Board
to be the agenda for their January meeting. The Board is open to this.

We want to let you know that your County Commissioners are aware of the issues involving the
Sisters Airport. That said, it is important to understand that the airport proper is located within
the City limits of Sisters, and that the Oregon Department of Aviation (ODA) has primary
jurisdiction regarding the actual boundary of the airport.
Deschutes County has no jurisdiction or authority with regard to flight operations (including
flight paths). Those matters are handled by the Federal Aviation Administration (FAA) and ODA.
Deschutes County does have code enforcement jurisdiction with regard to the sky diving
operations. In the past week or so Deschutes County has entered into a compliance agreement
with the operator including a mandate that all sky diving operations cease by November 30,
2016.
The runout adjacent to the end of the runway appears to have been installed without required
county permits. Community Development staff continues to work with the airport operator
and adjacent homeowners to address this issue.
The Sisters Airport is seeking to secure upgraded status from ODA. This public processoutlined
under Oregon Administrative Rule (OAR) 738-090-0040(2), requires ODA to ascertain the
present boundary of the airport. The final boundary of the airport is determined by Oregon's
State Aviation Board. Once that process is completed, the airport operator will be able to
proceed with local (city and county) applications to expand the boundary consistent with
Oregon Revised Statute (ORS) 836.610. The allowed land uses must be consistent with those
identified under ORS 836.616.
