Deschutes County Clerk Certificate Page BOARD OF COMMISSIONERS September 17, 1979 - Hearing for Conditional Use for Bend Airport Chairman Shepard opened the meeting at 10:00 a.m. with all Commissioners present. Chairman Shepard then outlined the procedure in which the hearing would take place: as follows: City of Bend --25 minutes to state their case and give Com- missioners their information. Opposing side would have 25 minutes to state their case and give Commissioners their information. City of Bend would have 5 minutes for rebuttal as would the opposing side. Ron Marceau, City Attorney for Bend started the hearing by introducing Jay Turley to discuss some maps he put up for the Commission's information. Mr. Turley showed the Board where the present airport is and where the present hangars are; Mr. Turley also showed where the proposed hangars will be going. Mr. Turley is the assistant City Manager. commissioner Paulson asked long the old hangars had been in existence. Mr. Turley informed him:about 8 months. Commissioner Paulson asked if the city had gone through the same procedure to get the existing hangars up; Mr. Turley said yes they had. There being no questions, Mr. Turley turned the hearing back over to Mr. Marceau. Mr. Marceau said that the master plan had been prepared sdi.stqechnical advisory committee with 24 members with 3 area residents. There were six meetings of that committee•;. 2 meetings with the County Planning Commission February 20, 1979, April 17, 1979. One meeting with the County Transportation Committee June, 1978; meeting with area homeowners May 1978; one meeting with County Comissioners April 1978; two meetings with the city commission. A total of 17 public meetings were held before the plan was adopted. The plan shows the location of the hangars that are being discussed within an area proposed for future hangar development. Siting of the hangars has been determined with reference to the master plan. Mr. Marceau said that in addition to being presented to the Planning Commission & the County Commissioners, it has been approved by the Aeronautics Commission, and the State Board of Aeronautics. Mr. Marceau said that the airport land is clearly not developed and the findings conclude that. Mr. Marceau brought up the fact that the land is zoned airport on the Comprehensive Plan and is now zoned A-1 Farm Use. Staff report (Planning Commissiong) contair.: information that the conditional use does conform to requirements of Article 7, Section 7.015 of Deschutes County Zoning Ordinance. Mr. Marceau finished with his presentation; Chairman Shepard asked if there was anyone else in favor of the City. There being no one, Chairman Shepard asked for opposition. Sherry Waterman; in opposition of the airport. Ms. Waterman stated that several of the residents were not involved at all with the adoption of the plan and Bob Bookenoogen(spelling) were not asked or involved with the adoption of the plan and were not asked to be. Mr. Bookenoogen had his attorney write up a protest against the airport plan. That land is still zoned AG -1. Ms. Waterman asked how can the city build an airport on farm use land and these people involved cannot. Concerning the new hangars Ms. Waterman asked how the city can build on county property and have private owners. Ms. Waterman asked how the city can lease county property to private owners. Ms. Waterman stated that the city had said that this airport would be for light airplanes not for big jets that are landing at this airport. Ms. Waterman asked why does it state in the master plan that there will be four business jets by the year 2000? Ms. Waterman addressed the noise problem. There is supposedly a 700 foot noise bumper; planes are heard further away than that. Ms. Waterman stated that the airport is a fire hazard and a local junkyard. With all the fueled planes and the weeds growing around them it is a dangerous area. Ms. Waterman stated that the more the airport is built up the more it lessens the value on residential property. Ms. Waterman stated that there is also danger in the air traffic in the sky above the airport. She stated that the hangars were also an eyesore. Bill Pruitt, 63050 Wall Rd., Bend. Mr. Pruitt ,ras' the ,prssidaiatc.Of rhe`Property Owners Association for the airport area at the time the planning of the airport was done. Mr. Pruitt said the airport was to be limited to its own specific area; it would only have light aircraft flown in and out. Mr. Pruitt believes there is an Environmental impact up to that point. Mr. Pruitt says that the airport is going to a greater degree of expansion and a greater degree of aircraft. This airport is based on light aircraft --it is a very busy airport with a survey done. in 1977 that showed a plane either landing or taking off every 6.5 minutes day or night. Mr. Pruitt says that if the airport takes on big commercial planes it will become much bigger than ever expected. Mr. Pruitt says that no residents were notified,to his knowledge, that there would be air traffic above their houses. He says all the city of Bend did was to propose an alternative runway away from houses. Mr. Pruitt says the hangars have changed the area for the residential community. The hangars are now two-story where they were supposed to be one- story. Mr. Pruitt stated that the noise caused by the airplanes have been proven to change breeding habits in cattle and with the operation of farming. Mr. Pruitt pointed out the fact that he did not see where the Bend airport was trying to be a good neighbor to the residential section of land. He says the airport does not maintain their fences; they do not maintain their gates. He feels the Board should reject the conditional use now before it goes on further. Ken Cale, 1126 McGrath Road, Bend. Mr. Cale stated that Mr. Marceau told the Board that when the first hangars were put up the residents of the area were notified and the same procedure was gone through. Mr. Cale does not remember the city ever notifying him. He said that at the time that he started to live there the airport was there but it salicin the comprehensive plan that the airport was to be kept small. Mr. Cale strongly wants the Board to reject the conditional use. Don Pederman. Mr. Pederman owns property in the airport area. He stated that the value of his land is going down and is getting worse. He also stated that he was not notified of the Transportation Committee meeting as stated by Ron Marceau. Al Holden, 62975 Pale Butte Road, Bend. Mr. Holden is located right across from the hangars and says they are an eyesore. He told the Board that there are four concerns in this project. One is the safety of the people who live around the airport. Another is the property value for the residential area. Air traffic safety for the miscellaneous fliers. Mr. Holden is also concerned with the people who live in the city and the dangers there are to them. Ron Marceau then had time for rebuttal. He talked of all the things mentioned by the concerned citizens. Mr. Marceau says that the airport wants to be a good neighbor and is trying to be one. Mr. Marceau says that the City of Bend will not close down the airport completely but will try to cooperate with the citizens. He feels this airport is important to Bend. Mr. Marceau says the purpose of the airport is to concentrate the air traffic to one area rather than all over. Mr. Marceau brought forth a resolution entered into between the city and the county in which the county said it would help the city with this airport. Mr. Marceau said the airport was a very busy airport but that in the sense of an air tower it wasn't big enough to consider having one. The FAA is the one who controls whether there is enough air traffic to necessitate a tower. Ms. Waterman then spoke again regarding airport size. She said that the airport was to remain small and would not grow into a large commercial airport to be able to handle jet aircraft. With that rebuttal as a final one, Chairman Shepard closed the hearing. Commissioner Paulson had a question he directed to the City: Are these proposed hangars to be for private persons to lease or rent for private planes and if so how does the city propose to do this? Mr. Marceau answered that the airport plans to lease ground to private citizens in Bend to house or tie down their private aircraft. In anwer to Ms. Waterman's statement that the airport was not supposed to grown, Mr. Marceau said that no commitment was given by the City that the airport would not grown. Commissioner Young mentioned throughout the hearing that the Redmond airport would be the one airport where all the commercial traffic would come in and out. Bend's airport would be small and kept only for private use and small craft. Chairman Shepard said that if that was all the questions that were going to be asked and if there were not further discussion, he felt that the Board should look over the findings of fact as put out by the planning department and decide through those findings and findings of counsel, a decision could be reached. A meeting date of September 24, 1979 was set for the final decision. Jill Thompson, Assistant County Counsel, asked Mr. Marceau a discussion question that he would answer to her at a later date regarding the A-1 zone and the LCDC Agriculture goal.
