DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: Board Meeting, Continued from December 9,
1981.
December 10, 1981, 9:55-11:35 AM.
A meeting of the Board of County Commissioners was held on December 9, 1981.
Commissioners present were Albert Young, Robert Paulsen, and Clay Shepard.
Also present were Secretary Sue Stoneman; County Counsel Rick Isham, Glen (?)
of the Building Department, and one other citizen.
It was pointed out that part of this meeting will be to discuss a possible zoning
violation. Also, discussion already began on December 8 regarding the names of
Pinewood Road and Pinewood Drive, per Clay Shepard.
A woman said her City Commission met on the renaming of these streets now
that they are in the City limits. The people living there did not want to change the
name. The City would like to let them keep the name, which preceded the name
of the other street, and wants the County to reconsider. One is Pinewood Road
in Woodriver Village and nine people live there, in the County. The other is in
Wiestoria addition in the City, off Revere.

Mr. Shepard feels that the original should be able to keep the name. Mr. Paulsen
asked if they should change the name of the other to something else. This issue
has been discussed long enough, for months. They will talk about other potential
names soon.
Mr. Shepard made a motion to change the name of Pinewood Road in the County
to another name. Mr. Paulsen seconded. Abe Young voted no.
The next item was a possible zoning violation. Mr. Paulsen said there were two
motions made yesterday, but they were unable to get a second. This is in regard
to the operations of Deschutes Ready -mix near Tumalo. The owner/operator has
started up operations, but Mr. Coats doesn't have a site plan as required. A
motion was made to place a stop work order, but was not seconded. They talked
about waiting until the 21st to see if there is a site plan filed by then. That motion
also was not seconded.
The operator removed 100,000 cubic yards last August and they are drilling holes
for future blasting. According to employees, there are about 300,000 cubic yards
of material on the hillside. Their intent is to remove the rest of the material.
There was a long discussion about the potential violation. Glen said that the
Board has directed the department to not issue stop orders without specific
instructions from the Board. A decision on this has not yet been made.
Mr. Paulsen said he doesn't see this as being any different than someone building
a house without permits. This is causing problems for local residents.
Mr. Young moved that Planning place a stop work order on the property. Mr.
Paulsen seconded. Mr. Shepard voted no.
Signature items were then addressed.
Resolution No. 81-84 regarding fees was approved.

Regarding the Chevron property on Highway 97, the original deed had a
reversionary clause stating that property could not be sold or leased to Orientals.
They could not even be a guest on the property. This is in the abstract from the
early 1900's for that subdivision.
Ordinance No. 81-055 regarding PL 17 concerning Sisters needs to be approved by
title only. Mr. Young suggested they do both first and second readings. Mr.
Shepard said they can't do this; just the first reading. The first reading was
approved and done.
A motion approving the second reading was made and approved. The second
reading was conducted. The Ordinance was passed.
Discussion took place about selling property at cost to a local church. They could
not come to agreement regarding donating it. There was discussion about giving
equal time for taverns.
Next was Ordinance No. 81-044, to be read by title only. It will amend the Bend
Area Plan to redesignate property within the UGB. They did the first and second
readings by title only. Mr. Isham said this affects only the areas that changed on
the maps because of annexation. It was unanimously approved.
Next was Ordinance No. 81-045 regarding PL -11, the Bend Area Urban Growth
Boundary. Mr. Young moved first and second readings, and Mr. Paulsen
seconded. There was a unanimous vote. The Board then discussed how
ludicrous it is to have to do two readings. Mr. Isham pointed out that the State
has to read laws in full. Approval was moved and seconded, and passed by
unanimous vote.
