Audio Cassette Recording Titled: Special Meeting after Executive Session
December 21, 1982, 4:40-4:50 PM
A meeting of the Board of County Commissioners was held on December 21,
1982. Commissioners present were Albert Young, Robert Paulsen, and Clay
Shepard. Also present was John Anderson; Rick Isham and media representatives
from KBND Radio and the Bulletin.
This meeting followed a long executive session regarding litigation involving
surface mining and R.L. Coats Company, which supposedly is conducting
operations without an approved site plan from the County.
Mr. Shepard moved that the County attorney file an injunction against the
operation. Mr. Paulsen seconded.
A discussion then took place. Mr. Paulsen said that there is great risk to the
County to let this continue. This will force the company to shut down. Mr.
Shepard stated he wants to take him to court to find out if the County is correct in
this instance.

Mr. (sham said he would ask the Court to declare that Mr. Coats has a duty to file
for a site plan. There could be an injunction.
Mr. Shepard stated that he wants a court ruling, so he withdrew his motion.
Mr. Paulsen emphasized that this operation needs to shut down and comply with
the County ordinance. Mr. Jones agreed that he should be shut down until there
is a site plan. He needs to conduct business like anyone else.
Mr. (sham said he needed a little time to write a proper motion. After a few
minutes, Mr. Shepard said the following.
Move that counsel prepare a complaint for injunction and a declaratory judgment
regarding the failure of R.L. Coats to file a site plan with the County on his
operation near Tumalo rim.
Mr. Paulsen seconded.
The votes were Shepard, yes; Paulsen, yes; Jones, no.
