Chairman Tuttle called the meeting to order at 9:00 a.m.

TP #631, Sun- Chairman Tuttle noted that there is a
river question regarding surety of the improvement
guarantee.
Mr. Bob Lovlein, Attorney for Sunriver
Properties Oregon Ltd., stated that they are
requesting the County to accept an Agreement
and Guarantee with three additional condi-
tions of approval. Mr. Lovlein stated that
as a condition of approval, the developer
would agree not to sell any lots until such
time as all required improvements have been
completed. Mr. Lovlein stated that, with
Mr. Isham's permission, it be amended prior
to signature, to provide that the developer
would retain the right to post a bond with a
surety authorized to a business in Oregon for
any improvements that might not yet be
completed so sales can be expedited.
Mr. Lovlein stated that a bond signed by
Sheridan Atkinson, President, Sunriver
Properties Oregon Ltd., will be posted,
binding Connecticut Mutual Life Insurance
Company.
Mr. Isham stated that an amendment to the
County Ordinance is in process; however, it
has not proceeded as a result of problems in
the northern part of the County. Mr. Isham
added that what is being offered is an
improvement guarantee which had been accepted
by a bank or a financial institution in lieu
of a surety bond. Mr. Isham added that it is
his understanding that the improvement
guarantee is being offered as a qualified
surety and therefore, thinks that if there is
going to be a release of property under that
improvement guarantee it should be under a
cash bond as opposed to a qualified surity.
After lengthy deliberations, Chairman Tuttle
noted that a modification of paragraph nine
of the Improvement Agreement regarding
Surety Bonds for the sale of lots would be
forthcoming.
MOTION: MAUDLIN moved to sign and accept
the final subdivision plats for
File Number TP #631, Sunriver, for
Deer Park III, Deer Park IV,
Fairway Point Village V, and a
Replat of a Portion of Fairway
"Subdivision", and Improvement
Agreement pending change
in language regarding Surety Bond
for sale of lots.
TUTTLE: Second.
VOTE: UNANIMOUS APPROVAL.
Request for Re- Chairman Tuttle noted that a $60.00 refund
funds/Community has been requested by Randy Schoning who
Development purchased a duplicate permit.
Chairman Tuttle noted that a continuation of Public Hearing
regarding the LaPine re -zone will be held at 10:00 a.m. today.
The meeting was adjourned.
