DESCHUTES COUNTY BOARD OF COMMISSIONERS
Monday, January 30, 2017
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Tammy Baney, and Anthony DeBone. Commissioner Henderson
was absent. Also present were Tom Anderson, County Administrator; Erik Kropp, Deputy
County Administrator; David Doyle, County Counsel; and Sharon Ross, Executive Secretary.
One representative of the media was in attendance.
CALL TO ORDER: Chair Baney called the meeting to order at 10:00 a.m.

ACTION ITEMS
1. Before the Board was a Public Hearing and Consideration of Signature and First
Reading by Title Only of Manufactured Home or RV as Temporary Residence for
Medical Condition, to Allow an Existing Dwelling in the Exclusive Farm Use (EFU)
Zone to be Used a Temporary Residence in the Case of a Medical Hardship.
Peter Russell, Senior Planner, and Nick Lelack, Community Development Director were
present to review the process leading to this public hearing and the proposed Ordinance.
The hearing was opened and the hearing procedures were outlined. The proposed text
amendment to County Code 18.116.090 would allow in the Exclusive Farm Use zone
only the use of an existing building as a temporary dwelling in the case of a medical
hardship.
At this time, the Board was asked to announce any potential conflicts in this matter.
Commissioner Baney noted she has met with Mr. & Mrs. Bourdeau regarding their
interest in expanding the amendment to include County Forest F 1 & F2 Zones.
Commissioner Baney and DeBone had no conflicts to disclose.
The staff report was given. Discussion held on the date to continue the hearing if the
decision was to include the Forest Zones in the text amendment. The date of Wednesday,
February 22nd was proposed.
County Administrator Anderson asked for clarification on the definition of existing
buildings. Staff responded structures that pre -date the application or could be the date the
ordinance takes effect. Staff will research other county definitions.
At this time, public testimony was taken.
• John McIntire, Concern: Rule Change Medical Hardship:
Mr. McIntyre has lived in the Sisters area for 35 years on EFU property and he
has spoken to the Planning Commission on this issue before. For reasons he has
stated in past, he does have an existing building suitable for medical hardship
housing and is an asset of the property. He commented it makes practical sense to
use existing structures. He also noted the addition of mobile structures to the
landscape creates blight on the land. This would relieve a financial burden in his
case if the rule was changed.
• Jim Julie Bourdeau: Concern: Use of Existing Structure for Medical Hardship:
Mr. & Mrs. Bourdeau live on a 10 acre property in Sisters in the Forest zone.
They have a letter from a cardiologist supporting medical hardship condition.
There is an existing building on the property already connected to utilities. They
noted the added expenditures of an RV or modular home. Their request is for the
Board to consider the inclusion of Forest zones.

Commissioners DeBone and Baney expressed their support of adding the Forest Zones to the
text amendments. Mr. Russell will work with County Counsel on the documents and will re -
notice the hearing for February 22nd
OTHER ITEMS: None were offered.

10:26 a.m.
