DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: Work Session on a Hydroelectric Ordinance.
October 17, 1983, 10:00-11:00 AM.
A meeting of the Board of County Commissioners was held on October 17, 1983.
Commissioners present were Albert Young, Lois Prante and Larry Tuttle. Also
present were members of the public and the media.
It was explained this is not a hearing so no comments from the audience will be
allowed.
Commissioner Prante said she would like more time to review it. She feels they
are closer to a final version that will protect the Deschutes River. They are
developing an understanding of the impact and ramifications of their decision.
She said she wants to move that they reconvene a week from tomorrow at 9:30
AM, October 25.
She has been heavily involved in a lot of other areas, and wants to spend some in-
depth time with Legal Counsel. She wants people to submit any suggestions they
might have to the Commissioners, so they can come to a finalized preliminary

ordinance. She supports a study whole-heartedly and has no ambivalence on the
need for a study before they can proceed.
She hopes on October 25 they can really get into a work session with a timeframe
as to when they can finalize the document.
Commissioner Tuttle agreed that they need to set a timeframe for the whole
process. He does not want to see it open-ended.
Ms. Prante said that next time she feels they can come up with a firm timeframe
to set a date to act on the ordinance. She doesn't want to say a specific
timeframe yet. She will have a good feel for it next week.
Mr. Tuttle asked what kind of things she wants to see them do, individually and
collectively, during the next week. Ms. Prante stated she wants them all to share
comments they have received and might receive.
Mr. Tuttle seconded the motion.
He said there was a resolution passed in July that laid out a whole series of things.
He asked if she feels there are major conflicts with the resolution at this point.
Ms. Prante said they determined to proceed to protect the River with a strong
ordinance. She has not conflict with the original resolution.
Commissioner Young said he would like to make comments in regard to some
changes he has recommended to the draft ordinance. There are people listening
and he feels his comments might be good food for thought for additional changes
that other people might have in mind.
The vote on another work session was unanimously in favor. It won't be a
hearing.
Mr. Young said he studied this extensively and it is important. He was concerned
by the original draft, which was too broad. The basic change he wants was
deleting the word 'combining' from the ordinance, in reference to the Deschutes
River combining zone. He wants an ordinance that will control the development
of hydroelectric projects on the River and nothing else.

He read the original language and his preferred language. It will not have an
effect on any other zoning in the County.
He struck "improved" river flow from the language. They lose 50% of the water
from Wickiup to Bend due to cracks in the rocks. To this, it seems that someone
might have to go out and plug up those holes.
"To conserve and protect in adjacent areas" is too broad. He wants 'adjacent' to
go. He wants this to apply just to the Deschutes River zone. They are not
rewriting the comprehensive plan. They are trying to get a zone here to protect
the river in regard to hydro development.
He also has struck the word 'enhanced'. It should be 'maintained'.
He removed the area that refers to all land uses and the comprehensive plan. He
does not want to redo the whole thing. He wants to talk only about the River.
He struck the wording regarding an overlay zone. It is not needed since they are
only zoning the River. He changed wording from "all uses" to "all hydroelectric
uses".
Mr. Tuttle stated that it appears that he and Mr. Young will have some differences
in this language. He believes that what would happen with these changes would
be less control than they have now. There can be some adjustments but some of
it defines what they already want to have in place — much is already in the
comprehensive plan. He feels he can demonstrate that by altering the ordinance
slightly, they can be in a position to not create a hardship to those who want to
develop under the law in the combining zone.
Mr. Young said he will not accept this, since they are here to write an ordinance
just regarding hydro. Mr. Tuttle feels they can rewrite it to make it clearer.
