DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
February 16, 1982, 8:30-11:15 AM (two tapes).
A meeting of the Board of County Commissioners was held on February 16, 1982.
Commissioners present were Albert Young, Robert Paulsen, and Clay Shephard.
Also present were various staff and representatives of the State Highway
Department and the Forest Service.
Mr. Young stated that the first item he wanted to discuss is a matter of great
importance, which is the campaign for a nuclear arms freeze. This group will be
holding a press conference today, and asked if the Board would adopt some kind
of approval prior to then. (He then read a letter from the group.)
Mr. Paulsen moved approval. Mr. Shephard seconded, but wanted to be sure
that the public understands that they usually do not take action on items while in
a work session. He feels it could be ratified tomorrow. He supports this if it is
solely on the topic of nuclear arms. The motion was unanimously supported.

There were no amendments to the agenda.
Discussion of an environmental assessment on South Century Drive.
Representatives of the Forest Service and State Highway Department were
present. There has been an assessment but a lot of letters have been written to
the Board and others regarding concerns about potential noise from logging
trucks going through this site. They need to decide if a full environmental impact
study is necessary, or just an assessment. The Department of the Interior is
recommending all kinds of things, and some of them are not practical.
By putting in a new bridge, they are adding a lot of traffic back on the road. The
old one-way bridge had been shut down years ago. The thought was to have an
informal hearing and take testimony. If they put in the new bridge soon, the old
General Patch Bridge as rebuilt in 1958 might be saved for aesthetic reasons.
They have to build a new bridge at some point, no matter what. The structure is
deteriorating and maybe has three or four years left, at best.
There was a long discussion about the pros and cons of an environmental
assessment and the costs involved. They can expand the assessment to minimize
the cost.
Mr. Young said there were six letters coming from four families, who live
downstream. There is another development in the area but no one from there
has expressed concerns.
A notice was put out to receive comments, which have been received. Now the
decision is whether to hold a hearing to find out if there are more comments. The
Department of the Interior will decide what level of environmental work is
necessary. It was well publicized.
Mr. Young feels that a hearing is not necessary. (There was a long discussion on
this issue.) It was decided that they would have an informal hearing as part of a
regular Board business meeting.

Discussion of 1982 local improvement districts.
Neil Hudson said the first LID is the extension of Knott Road from China Hat Road
to Baker Road and Highway 97. Brooks Resources owns the property, and it is
known as Sunnyside. They are in litigation at this point under the old LID, but this
is a new effort. A new big is necessary anyway due to the litigation. It is fairly
straightforward.
Williams Loop is off NW Way outside of Redmond. The developer wants to pave
the roads. They are excluding the lots that were already sold. The new owners
will decide whether to be included. This should proceed to get rid of the potential
liability.
Hunnell Road is the next LID, from Cooley Road and the KOA to the Old Bend -
Redmond Highway, including Rogers Road. The road needs to be straightened
and improved. It is a full road construction. A lot of the area is rock piles. It
would tie into other improved roads. It is an established County road, and
perhaps the County should pick up the incidental costs. The County is supposed
to be maintaining it anyway. It helps with circulation in the north corridor area
and would be easier for the County to maintain if paved. The overall cost might
be $150,000, and the incidental costs would be around $50,000.
(There was a long discussion regarding the properties served and other factors.)
It can be done as one LID or three LID's. It makes sense to combine them. They
would like to get all the LID's done this summer so it is more cost-effective. The
department will come back with more firm numbers and information in the near
future.
McGill LID has been opposed by someone who doesn't want to see commercial
property in the area near the KOA. This issue is in the land use process at this
point. They should wait until the land use process is complete to decide on the
LID.

Brightenwood LID is a development LID that the developer has asked the County
to fund. It goes into the existing Woodside Road and Knott Road area. It is a
recorded subdivision. Part of this would be funded under the hazardous
intersection program.
The department head will return in a couple of weeks so they can all be approved
at once.
Removal of County owned bridge off a COIC canal.
Several years ago, when Brooks got rid of a logging road, it was offered to the
County. At that time it was put on the comprehensive plan and the general area
plan, from the mill south to Romaine Village, and south to China Hat Road. The
County acquired the right of way from McClelland Road south to the north line of
Romaine Village. Others acquired the rest of the road. The piece that was left
was shown on the general area plan as a parallel route to Highway 97 to go up to
the city from Deschutes River Woods.
When the County took this route over, there was an existing wooden bridge over
the canal just west of the concrete bridge on Blakely Road. It was used by
motorcyclists, pedestrian and others. It is deteriorating and a suggestion was
made to close it last year; it has been since some of it has since caved in. The
COIC people would like to see it removed from the canal. If the arterial route is
ever constructed, a new structure would be needed anyway.
The Board was supportive of this taking place.
Discussion of Closure of Bend Silviculture Lab.
Mr. Paulsen explained that someone contacted him with concerns about the
impacts of this closure on the community and local forest lands. He said the lab
was able to help him make his timberland more productive. Mr. Paulsen said
there are a number of companies around that can do this same work.

However, some of the research has been taking place for twenty or more years,
and it is a shame to see it go. The Board can't tell the federal government how to
balance its budget. The request was for the Board to send a letter to the
Congressional delegation, to indicate support of keeping the lab open. Mr. Young
said there will be more of these things coming up. Mr. Paulsen noted that there is
probably not anything in the federal budget that wouldn't impact someone,
somehow. He doesn't think it helps the process to have every little government
putting in their two cents' worth. Mr. Young thinks they should do what they can
to encourage something that has been an important part of the area's needs and
economy. The Board decided that a letter of support would be appropriate.
Mr. Young said he wants to write another letter to support bus service to
Chemult. Amtrak says the bus will stop in May, and since they only allow so many
stops along the train route, Chemult is on the chopping block for Amtrak to stop.
Evidently there is not enough bus usage. The Board will send a support letter.
Vandevert Acres Special Road District Board of Directors Appointment.
The SRD suggested the appointment of Mr. Hanna, Mrs. Miner (?) and Mr. Pratt,
with recommended term dates. The Board was supportive.
River Forest Acres Special Road District Board of Directors Appointment.
Mr. Eirser wrote to recommend that Eugene Price be reappointed to their board.
The Board was supportive.
Ordinance 82-005, amending Ordinance No. PL -9.
Mr. Isham said this is to update some zone changes. The Board was supportive.

Resolution No. 82-004.
This has to do with a Resolution, 82-04, to authorize staff to enter into contracts
with businesses to perform some activities the County is not qualified to do.
In this instance, the people they will hire are engineers with expertise on thermal
engineering. The language needs to be written to be appropriate for Central
Oregon structures. There was a long discussion regarding contracting and who is
allowed to do it, whether there is workers compensation coverage needed, and
so on. Mr. Isham was instructed to work it out as appropriate. It is limited to
$1,000.
Agreement with Diamond International.
Mr. Isham said that Diamond International had leased four 40 -acre parcels that
they failed to pay lease fees to the County last year. The lease policy was
amended to give them an opportunity to sign amendments to the leases and
reduce the rent. They never signed the amendments, but just paid the reduced
rate for last year. Harry Brooks sent two signed amendments for two of the four
leases, and they would like to terminate the other two leases. The question is,
what the Board would like to do about the leases and the terminations.
Technically they are breaking the lease on the two properties. They have to offer
for lease the properties to someone else. The County has not forced the issue in
the past. The same thing might happen with a lease near the Airport in Redmond,
off Antler Road. (There was a lengthy discussion about the condition and location
of the properties, whether the amount is worth pursuing legally, and whether
allowing cancelation will set precedence.)
Mr. Isham said that the Diamond International amount is about $3,000. He will
contact Mr. Brooks again.

The Board will address this at tomorrow's Board meeting.

Other.
There was a brief discussion about the Don Hall situation regarding a Portland
attorney. They can extend the timeframe to allow for more information. Mr.
Shephard said they are speaking about an executive session issue and should
refrain from doing so in regular session.
