Commissioners present were Lois Prante, Larry Tuttle and Dick Maudlin. Also present were Rick Isham, Sheriff Jim France, and various County staff. For the next business meeting: Contracts for the South County overlay project. Memorandum from Dave Horning regarding the final engineer's report for Special Road District #4. Local Improvement Districts for Special Road District #4 and 16th Street. Mr. Isham said that they need to get these done due to deadlines. These are lump sum bids, and the work is not yet completed. Transcription of Audio Recording of Work Session, Sept. 9, 1985 Page 1 of 7 Mr. Isham stated he got a letter from an attorney who is claiming there is no benefit to a piece of property there. The lot value was $18,300, but after they got assessment notice, they went to the Assessor's Office and determined it was an unbuildable lot. In that district, it was not assessed due to the low value. If you do not confer a benefit on the property, you cannot assess it. It appears that there was no assessment to properties that have a nominal value and are basically worthless. Mr. Maudlin said there were several combinations of lots that were done after the first hearing in 1985. Mr. Tuttle asked if there is going to be a problem with all the lots that have a nominal value. Mr. Maudlin stated that this was discussed at the hearing. He only knows of three that have combined their lots after the district was formed, and they will get assessed for each lot. Liquor license approvals. They have a deadline coming up, so they will approve them tomorrow at 11 AM. A lease for a holding place for the Bend Armory. Vector Control agreement. A work session with Community Development will take place on Wednesday at 1:30, followed by the BLM Grazing Advisory Committee at 3:00. There was a discussion about Special Road District #4 and the disposition of equipment that they hold. The assessment will be $2 higher per lot than the original assessment, but can be given back directly. Transcription of Audio Recording of Work Session, Sept. 9, 1985 Page 2 of 7 Some lots were not assessed but have been paying into the equipment fund, so are entitled to some of it back. Mr. Isham said that this might be a good project for the new Assistant County Counsel. Mr. Isham said they have gotten some applications for junk dealerships. Request from Eastern Oregon Health Agency. This group has asked to be considered to be the applicant for a program grant from the Oregon Department of Energy, to increase voluntary use of motor vehicle restraints — seat belts. They have set out a work plan for this. He'd like to talk about this next week. They should be able to get full reimbursement for any out of pocket expenses, such as audits and supervision. There might also be a couple of other small grants for this. There was a letter from the Toastmasters, who want to offer their services to employees. The Board was supportive. Possible LCDC grants for plan maintenance. Staff spoke about the potential grants, to use for keeping the plan up to date. In the past the County has received these, but at first these were not going to be available this year due to the periodic review process. Instead, the State put some money into both. The County will be applying for the periodic review funds as well. The maintenance funds can be used for the update. He proposed an application for $10,750, the maximum amount, which would be put into the periodic review work that has already started. (There was a long discussion as to the specific use of the funds.) Sheriff Jim France spoke about the Sheriff's Department management training program, and a request from COCC that he formalize a list of expectations and outcomes. Everything is ready to go, and he would like the contract signed by the Chairman. The classes start tonight. The Board approved and signed. Informational diagram and statement regarding General Fund support and voter registration. Staff asked that each department have this information posted. A lot of people are not aware that General Fund support goes into the running of some departments. It is also desired that voter registration material be available to people in waiting rooms. This might help with the upcoming levy. This includes things like child support, WIC, health, police and others. Mr. Maudlin is concerned that the departments that seem to be least liked by the public get the most general fund dollars. For example, the Assessor is funded 100% by this. They can't just put this information in a few select departments. Mr. Maudlin said that it will cost something to put this together, and the people who care are probably already aware. Staff said that there is a very low awareness level at health, WIC, child support and Randall House. Maybe those people will vote to maintain these programs. At the same time, they can make information available on voter registration. They may have up to 2,000 cases just in one department this year. Mr. Maudlin stated that whether they like it or not, the attitude of the public is that the dollars are not being spent like they want. Those who vote are generally not overwhelmed by the importance of these cases. It would be nice if the people getting the help would actually vote. Mr. Maudlin is concerned that they might raise more issues than they settle. Mr. Tuttle asked they put a sample chart together so they can see what they are talking about, and find out about the potential cost. Mr. Isham said they got a certificate of deposit from Vacation International. They have asked for a release of a letter of credit. There were some concerns about the development agreements over the past four or five years. They need to review the whole situation and the agreements, funding and security. (There was a lengthy discussion regarding this situation.) Mt. Bachelor has decided to accept the parking lot arrangement and will be signing an agreement. Offers of Gifts of Land to the County. Mr. Isham said there is no clear policy. Normally, the land is of low value and has taxes owed. To accept them as a gift, the County would have to clear the taxes, and there are no funds set aside to do this. There probably have been some requests in past years. He feels a letter from the Board needs to go out to say the County is not interested. He asked what the Board thinks about this, and whether there should be a policy set. Even free and clear land could end up having pollutants on it, creating another problem. M. Tuttle doesn't think the County wants to be the owner of 17,000 acres like this. Mr. Isham stated that there may be 2,000 of this that is good land. Most is unirrigated and won't support much. Most would have some kind of liability on it, unless it is for right of way purposes. Mr. Maudlin said they might want to look at this on a case by case basis, since maybe a parcel will help round out something they are trying to do. There can't he that many requests. Transcription of Audio Recording of Work Session, Sept. 9, 1985 Page 5 of 7 License with High Country Disposal. Mr. Isham spoke about the license for recycling activities at Negus Landfill. It has been in effect for some time but the original draft did not come back from the attorney. This will formalize it. Mr. Maudlin said that he has attended some LCDC meetings, along with representatives of most other counties. The biggest issue is to have more local control over the land use process. This is especially true of central and eastern counties. He thinks they have a basic good amount of local control, but then when it goes to the Land Use Board of Appeals, it is taken out of the hands of the local government. There were a lot of complaints about this. The biggest complaint is that the original administrative rules are constantly being changed. They set up a small item for the formation of an organization to address local land use laws. This would consist of one member from each participating county. They would meet within a month to determine the form of the organization, to elect officers, determine a source of funds, and staff needs and resources. The staff of AOC would be used for this meeting, on September 26. Each county to participate has to make a financial contribution. He will plan to attend the meeting. The amount of funding is not yet known. Some counties have no funds to do any of this. Also, some of them are still trying to put their plans together, but it is harder because the rules keep changing. Not everyone came in at the same time so it is a big mess. The rules need to be finalized and stay the same for everyone. People have lost control of their local lands and most don't like where this is going. They pave over or build on perfect farmland in the valley, while land in the rest of the state that can't even grow cattle is not allowed to be developed in any way, not even for a residence that would be low -impact to the area.
