DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: Special Meeting regarding Road Improvements
for Special Road District #1

A meeting of the Board of County Commissioners was held on September 21,
1985. Commissioners present were Lois Prante, Tom Throop and Dick Maudlin.
Also present were Rick Isham, County Counsel, other staff and citizens.
It was pointed out that this is not a public hearing and testimony will not be
taken, although the Board may have questions and may direct them towards
certain attendees.
After the meeting last week, two issues were raised. One had to do with a prior
discussion regarding a hearing for the original formation of the District, related to
lots that are presently on a paved road, Spring River Road. Those lots should not
have been included by prior agreement with the Local Improvement District.
The other issues raised related to lots that appear to be unbuildable, that can't
get septic system permits. This needs to be clarified.

Staff said the memorandum submitted to the Board needs to be corrected, as
there was an error in the number of lots to be assessed. He was off by ten. Also,
15% of the total bid was $74,131.80. This will be reduced to $67,429, with the
difference being absorbed by the Road Department. This will be added to the
Bend Aggregate and Paving final bid estimate $561,641.
When divided by 393 lots, that is $723 per lot; and the remaining 1,559 lots will
remain at $178 per lot. The $723 is payable over a ten-year period. The $178 can
also be paid over time, but the interest rate is at 9% so doesn't make a lot of
sense for such a small amount. The owners can pay off the balance due at any
time during those ten years.
The biggest question is around the unbuildable lots. The Board does not feel they
can address that situation at this time since it is not clear which lots are buildable.
A septic permit can't be allowed on some of them, but perhaps others haven't
tried. And there might be other avenues that can be used on some of the lots, or
the situation on individual lots could change in the future.
The Board of Equalization can be contacted if someone thinks their lot could be
buildable. The Assessor's Office would want to make an appropriate evaluation
as part of the appeal process. If someone thinks their property fits this situation,
they need to follow up.
Ms. Prante said she will contact the Assessor's Office to let them know this
question might be raised. The difficulty is that the road improvements need to be
done. This has been a long and difficult process. It concerns her that some of the
values are questionable, but it the responsibility of the owners to come in during
the process to see if the assessment is accurate. At this point, they really can't go
back and do all that. They made an adjustment for the property owners who
front on Spring River Road.
Order No. 85-115 was before the Board, certifying the assessment for road
improvements for certain real property in Special Road District #1 LID, and
requiring notice.

Mr. Isham recommended that the Order be approved, but because of the
changes, extending the dates involved. The publication dates will be set as well.
This will allow all property owners sufficient time to pay the assessment or file to
pay it over time.
