DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
June 16, 1986, 9:00-10:00 AM.
A meeting of the Board of County Commissioners was held on June 16, 1986.
Commissioners present were Lois Prante, Larry Tuttle and Dick Maudlin. Also
present were Rick Isham and other staff.
Agenda Items for the next business meeting:
Report on Recycling, for review.
A development agreement for John and Margie Marshall.
Three modifications of the Mental Health Division contracts.
Rezone from RS to RM in the Bend Urban Area, adjacent to the Bend Cinemas
Theatre.
Retainer agreement between the County and Bruce Bischoff, for labor relations
services.

Resolution No. 86-037, approving the Juvenile Services Comprehensive Plan for
Final signing for minor partition no. MP -865, partitioning a 40 -acre parcel in the
EFU 20 zone.
There was a discussion of an agreement with Lane County regarding lodging of
prisoners. Mr. Isham said that this was put on the agenda at the request of
Sheriff France. Lane County has requested that they be allowed to purchase
vacant bed space from Deschutes County when Lane County is over capacity.
They would primarily be city prisoners. Lane County would transport. The Sheriff
wishes to do this. (There was a long discussion about liability issues.) The new
fee is $65 per day, calculated midnight to midnight. This is usually favorable to
the host facility; especially for very short stays. Most of these from other counties
could be for months. Lane County had to close one of its facilities.
Many jurisdictions have agreements with others in this regard. Sheriff France
indicated that there won't be much of an impact on existing jail personnel, since
most have to be there anyway. He feels that there would be a maximum of six
from Lane County at any given time.
There was another long discussion about potential liability issues, and also what
happens if there are a bunch of local arrests and there isn't room for them at that
time. There are existing problems in the local jail that they are trying to resolve,
and do not want anyone analyzing how they operate. And it might not be a good
idea to be at design capacity all the time.
Two OLCC applications: Tumalo Emporium; and the Hampton Station, subject to
the $15 fee.

There was a lengthy discussion on a variety of road designations, going from
public right of way to private road. Mr. Isham explained that these were originally
initiated by Dave Hornung under the belief that some sort of project might be put
together on Rae Road. Jan Ward owns part of the property, and part is owned by
the homeowners' association. Some is public road that is not designated as a
County Road, and some is a County road.
This is not yet in its final form, and is it ready for action by the Board. He doesn't
see a reason to proceed with getting the right of way in completely public
ownership and improve the road at this time. The original anticipated project was
to be done by a local improvement district, partially contingent on an agreement
with the School District to participate.
Mr. Isham needs to know what direction to take with this project. $260,000 as
quoted would be inadequate today. It is unknown what percentage would be the
responsibility of the School District.
It is unknown what the homeowners' association bylaws require. They got the
right number of signatures and deeded property over to the County, but has not
yet been accepted by the County. Nothing has happened since then, about eight
months.
There was discussion on local improvement district projects becoming very costly
to the County, and resulting in legal issues. So the County put a stop on LID's until
they could reassess the criteria to know when it is feasible to move on an LID.
Staff said that the Ward Corporation (the Iris Ward estate, and not Jan Ward) also
needed to deed over some property as well. The homeowners' association may
be willing to participate with the LID, depending on the scope and the cost. There
are two different LID sizes, one that is only four or five along Rae Road, and one
that includes almost all of Tillicum Village (176 owners) and more. The problem
is that this road is not heavily used by most of the Tillicum owners.

The Murphy Road completion is a long way off. The roads are not built to
standard for school busses and other traffic that has used them for years. The
School District did not develop access as it should have.
There was a long discussion about the extent of road improvements, safety for
children, speeding, and other issues. At this time, the residents would like to see
patrols stepped up to slow traffic down. It is not the only unsafe situation or crisis
area. They need to know which other parties are willing to participate in an LID.
They need an update on potential costs and decide how the dollars could be
spread out. Then they can find out what people are willing to pay. The School
District has declined to contribute anything so far, and wants the County to take
ca re of it.
The group discussed whether to get the costs first or ask the property owners if
they are even interested. Most felt that the total cost should come first so people
can decide if they can or want to participate. If the School District won't
participate, the others will have to pick up the costs, so they need to know this
right away as well. Public Works will contact the larger entities to gauge their
interest.
It is unknown if sidewalks are required, and if so, whether on one side of the road
is enough. The width of the project would need to take in sixty feet. The County
has not yet budgeted for its part of the overall project. This would happen in the
1987-88 fiscal year.
