DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: SPECIAL MEETING REGARDING LA PINE SEWER
PROJECT DISTRICT ELECTION
January 9, 1986; 9:00-10:00 AM.
A meeting of the Board of County Commissioners was held on January 9, 1986.
Commissioners present were Lois Prante, Dick Maudlin and Larry Tuttle. Also
present were Rick Isham, County Counsel; County Administrator Mike Maier; and
other staff from the Building Department.
There needs to be a first hearing on the annexation of the sewer district on
January 22. However, apparently the legal description on the certificate is
incorrect. Mr. Isham said that some properties have been cut out that shouldn't
have been. This will create confusion.
There was also a petition from someone who didn't want to be included. Some
people also want to form a vector control district that has a similar legal
description. He is not sure of the effect of errors in the legal description.
There was a discussion about correcting this at a Board meeting. Mr. Isham said
they can delete property but can't add property.

The maps are correct. He does not know whether the people who brought this up
want to remain in the District. The republishing will take extra time and cost, but
he has been told that the time is critical. The hope is that those who own
property in the proposed District can vote in the March election.
After this, there are grants that are dependent on the results of the election. He
feels they should be able to change the ballot title. It is due to the Clerk in
February.
There were plenty of signatures and there was enough assessed valuation to get it
on the ballot, and the Clerk will validate those. If time allows, the least confusing
and the easiest thing by far is to republish with the corrected legal descriptions. It
needs to be correct when it comes to dealing with the bonds and how the
properties are taxed. The Board can decide now that this was an error and not
anyone's attempt to mislead anyone, and call for republishing. It is easier to nip it
in the bud now. Bond counsel will have a problem with a defect in the description
later.
(There was a long, redundant discussion regarding timelines and the properties
involved.)
It was decided that there is time to republish the correct information at this time,
and that this is the most logical way to handle the error.
