DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
January 5, 1987; 10:00-11:30 AM.
A meeting of the Board of County Commissioners was held on January 5, 1987.
Commissioners present were Lois Prante, Dick Maudlin and Tom Throop. Also
present were Rick Isham, County Counsel; County Administrator Mike Maier; and
other staff.
Items to address at the next Board business meeting:
This is Tom Throop's first official meeting since taking office.
Authorization to advertise for a Deputy District Attorney, as requested by Mike
Dugan. (A long discussion occurred regarding promoting someone to the Chief
Deputy D.A., at what level to hire a new person, and whether to wait to save
some money.)

Review of memo from Juvenile Department Director Dennis Maloney regarding a
proposed agreement relating to the downsizing of the McLaren juvenile facility in
the Valley. This can only be done with the cooperation of the various counties. A
diversion plan for juveniles has been developed so that central and eastern
Oregon agencies can pool resources.
JCRI is a private, nonprofit corporation that was put together by eight juvenile
department directors, as individuals and not employees, so it not a county
consortium. They are attempting to get funding for downsizing efforts.
However, those dealing with grant funds had incorrectly assumed that the group
was a consortium of counties, so the situation has gotten complicated. Some
work is already being done by private providers of foster homes under these
grants in Jefferson County.
There was a lengthy discussion on how to address this lack of communication.
The county has no legal standing in this partnership, but might have liability if it is
assumed this is the case. JCRI has no liability insurance, probably because of the
cost. The contract now in place does not require insurance, but that was probably
because they had assumed this was a county agreement. It may be possible for
JCRI to use part of the grant funds for insurance coverage purposes. However,
JCRI has committed on paper that all funds will go towards programs and basic
administrative expenses.
There was a lengthy discussion about which directors are involved, and at what
level. Also discussed was which providers would be used, and the timeframe
involved. The group should get a Chapter 190 established, but that would take
several months, and some providers are already looking into securing locations
for their work. The total amount of funding is $326,000 for 1986-87. It comes
down to $775 per month, per child, and involves 14 counties.
The biggest issue is the timeframe. JCRI would have to be dissolved and the
current agreements dissolved and rewritten with the new entity. Also, some
counties that originally wanted to participate may change their minds, or leave
things structured the way they are. This is extremely sensitive politically.

An alternative might need to be considered so they can take advantage of the
grant funds in the appropriate way. After a very lengthy discussion, it was
determined that this will be discussed further with Mr. Maloney and others from
his department.
The group discussed their schedules for the next couple of weeks.
Lengthy discussion of the structure of salaries within the County and when to pay
extra for lead work, or to be able to hire the appropriate person.
Discussion of personal services contract components.
At this time, Mr. Maloney and others showed up at the meeting, and a lengthy
conversation occurred regarding the JCRI and how to deal with the structure of
the group, insurance, and how to transition over to another type of organization,
such as a 190, to satisfy grant requirements. They will develop the steps that
need to be taken to deal with this issue, and present it to the other counties so it
can be handled in an organized fashion. There are many advantages having a
private nonprofit, but it takes time to form one.
Perhaps in the meantime, the County can accept the grant funds until the new
entity is formed. An intergovernmental agreement can be drafted with the other
counties to handle the funds in the meantime. County Counsel was asked to take
the lead on this.
At this point, there was a lengthy discussion of a letter from the Workers
Compensation Board regarding the disposal of asbestos waste at the landfill, and
exposure of County employees to this waste. The County had an agreement with
Alaska and Washington to take some of this material, because no one else would
take it. There was a long discussion about why the County allowed this to
happen. They have been informed that as of February this year, the County will
no longer accept asbestos waste. Workers Compensation will be advised that the
only waste to be accepted here will be what was generated here.

Evidently, the DEQ originally advised that they thought this was a good idea
because no one else would take this waste, and asked the County to take it. They
still encourage the County to accept this waste because the County is good at
handling it.
It was determined that the out of area companies will have to deal with finding
some other facility to take this kind of waste. It also should not be transported
down Highway 97.
Discussion of appointments to the Budget Board. They'd like to get someone
from the Sisters area if possible, maybe Linda Swearingen who is the Mayor, if
that is allowed.
Mr. Maudlin is on the Board of Equalization, but Mr. Throop said he is available if
they want him to participate instead. The Board will determine the appointments
and liaisons very soon, with a list made so everyone will know who is involved
with which group.
