A meeting of the Board of County Commissioners was held on July 8, 1985.
Commissioners present were Lois Prante, Dick Maudlin and Larry Tuttle. Also
present were Rick Isham, County Counsel; County Administrator Mike Maier; and
other staff.
Items to be addressed at the next Board business meeting:
OLCC license, Tumalo Emporium.
OLCC license, Fireside Tavern in Redmond, which still needs to be signed off by
the Sheriff.
Acceptance of letter of credit for The Pines in Sunriver.
Request for a temporary permit for Eagle Crest.

Plan on how to deal with dogs versus livestock. It is the understanding that if the
dogs that killed the livestock are known, a claim has to be made first at that level.
This is based on State law. Mr. Isham will check it out.
Ordinance regarding dog control. A representative of the Sheriff's Office said that
the biggest program is getting the dog owners to work with the Sheriff's Office
and shelter. There has to be a hearing. For example, two dogs chased a horse
and one of the dogs was put down because the owner never showed up —two
different owners. One owner said his dog would not remain at the shelter, which
was ironically broken into, letting approximately 15 dogs out. The shelter ends up
eating all of the expenses of taking the dogs in.
This chasing by these dogs happened more than once. The shelter can't take the
dog unless someone signs a complaint. Some people don't want to pay because
they think the dog will be put down anyway. Mr. Isham said that there can be a
fine under the ordinance with the owner covering basic costs, if they are cited. A
judgment can be obtained if necessary.
The representative said that there needs to be a $75 bond in advance, which
would be refunded if the dog is found not guilty. If a dog is guilty, he wants to
know if a hearing is required. Mr. Isham said that they have to even if though the
dog will be put down per State law. Anytime you destroy personal property,
there is a right to a hearing. The only issue is whether the dog is guilty. You can't
prejudge innocence or guilty. The Board doesn't like having to hold these
hearings in any case; it is a difficult situation.
The bail is not the cost of keeping the dog. It is the cost for breaking the law. The
cost of keeping the dog is another expense that the owner is responsible for.
They are different things. One is a County expense and one is the shelter's. The
coming contract allows for 100% rather than 75% of distribution of the dog
licensing fees to go to the shelters, for those services. A dog has to be held for
five days regardless of ownership or situation.

The Commissioners feel that people who want a hearing need to be cited and pay
something up front for this. Mr. Isham said that the County could assign the
charges to the Humane Society and they can pursue it, since it is expensive for the
County to do so. (A very lengthy discussion ensued.)
There needs to be a way to clean this process up. Mr. Isham asked that the
department and shelter write out what changes they would like seen made to the
ordinance so he can review it, to make sure it complies with the State's version.
Whatever they do needs to be consist and should apply to all.
Request for signature on minor partition 85-6 for Oldaker.
Person services contracts with private physicians for the prenatal program, with
an increase in the fee.
Some revised personal services contracts are being written for consideration in
the near future.
Revision of maternal child health planning agreement.
Project agreement for the forest development service roads cooperative
agreement. Mr. Hornung explained that this means if they are working in the
same area, they can share each other's basic equipment that does not require an
operator.
Contract for LID's so they can proceed with the projects.
Petition and Order for refunds on personal property taxes.
Discussion of projects at the Armory in Bend and Redmond. They were supposed
to hire locally but instead have hired from out of the area, and are also using
National Guard for security work. It is a federal program and the County has no
control over it. It was also pointed out that union workers may be a requirement
at the federal level. The person who has complained needs to contact the project
coordinator.

Agreement with the City of Redmond for the Humane Society and license fees.
Tom Del Nero of Tamarack Learning Center is putting on the High Desert Horse
Show and is seeking a water truck for the event, twice a day, to do the road from
Knott Road. The Board said that the County uses its truck for its own work and
can't let other groups use equipment.
Allocation from the State for at -risk children services. Deschutes County has not
been getting its fair portion of this funds, and a study is being done to determine
what is more accurate.
Mr. Hornung spoke about a property that is listed under the developers' name off
Chamberlain Street. The County needs this for 60 feet of right of way, plus the
north portion is the extension of Arthur Avenue, necessary in case it ever goes
across the river at that point through Diamond International property. This right
of way can be picked up for $216, the taxes owed. Some might be a city street.
Some of this land is designated for parks.
Temporary permits for Eagle Crest. There is a problem with tents and mobile
homes being out there, and some people are complaining. This needs to be the
end of it. There should be a conclusion to the projects and a specific expiration
date for the permits.
Transportation plan in Redmond, starting with Redmond going north.
Information is being shared with the BLM and the National Forest so that they can
assist with mapping. The USFS and BLM deadline for their studies is late 1991,
which is a long way off. They added in areas for Jefferson County and Klamath
County which delays it overall. Some pressure needs to be put on them, as the
final index is needed before the County can deal with the agricultural lands
situation. This needs to be done by late 1987.
Dick Stromberg, State Electrical Division, followed up on his meeting with the
County and electrical contractors a few weeks ago. The main issue was a concern
about the time it took to get an electrical permit.

If there is no structural aspect to the permit, it can be fast, maybe within a day. If
there is a structural aspect when there has to be a plans review or other work, it
will take longer. This is running about three to five days now. The use of coupon
books for multiple projects has been stopped at the State level, although they sell
bulk labels. These are not permits. Mr. Stromberg explained the State's process
at length. He said that this has worked well for other counties, with none of the
problems noted by Deschutes County.
The County needs to have inspectors available to answer questions by phone and
to do the inspections. It works well if this process is in place. The contractors
who used to not bother to get a permit for a small job are doing so, since they can
use the labels and more easily apply for the permit. This creates more work, but
also means that buildings are safer. This goes beyond the electrical part.
The Board asked that the building department director review this information
and come back with the possible impacts on the department. Mr. (sham asked
for a copy of the instructions given to other counties and to the field inspectors
who are using the process. The County is obligated to adopt State code in any
case, if that is where this procedure is found.
