DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
September 8, 1987; 10:00-11:15 AM.
A meeting of the Board of County Commissioners was held on September 8, 1987.
Commissioners present were Lois Prante, Dick Maudlin and Tom Throop. Also
present were Rick Isham, County Counsel; County Administrator Mike Maier; and
other staff.
The following items may be on the next or other future Board business meeting
agenda.
Additional Deputy D.A. position. Mike Dugan, Dennis Maloney and Mr. Brown
came up to explain the request. They introduced the Board to some family
members of the deceased, the Housers ? of Terrebonne. They support adding
staff to the D.A.'s Office. The Board shared their concerns about thorough and
adequate prosecution. The family members then spoke about there being
enough help at the D.A.'s Office to handle this case and others. They felt the
defendant is being given a lot more State support, and that this is not fairly
balanced.

The three defendants charged with the murder of this family's parents have two
attorneys each, appointed by the court. It hardly seems fair.
The Board is aware of the situation and know about the attorneys. They will do
all that is humanly possible to deal with this. Mr. Dugan pointed out that on
January 1, 1988, his department will have the additional duty of absorbing
municipal court caseload from the City. This will be an additional 1,100 or more
cases. Mike Maier stated that the budget allows for the D.A.'s Office to handle
hiring one more Deputy D.A. The need is increasing drastically but is very urgent
right now.
(A lengthy discussion then took place about the budget and the need for
additional attorneys.) The Board will meet with Mike Maier to discuss this
situation further.
Contract with Century West Engineering for the SW landfill project. They were
required to install ground monitoring wells for groundwater, per DEQ. The DEQ
wants them to refill on the first phase and build it up to a closure level. There is a
cap of about four to six feet on it, with much of this material being bentonite.
They just paid to have the test wells covered with bentonite to avoid
contamination of the well sites. This is a special clay material that is essentially
impervious.
Staff feels that the DEQ picked up a coastal closure plan, where there is a lot of
rain, in error. It may not be that important here. No one on staff has the
expertise to discuss this in technical terms with the DEQ. Therefore, a technical
service contract is being proposed with Century West, who has the knowledge
and testing facility.
The first phase is to talk to DEQ and visit the site, and review the closure plan.
Then, to give the County reasons to open the closure plan. There are probably
grounds for opening up the closure plan. (There was a lengthy discussion of this
situation.)

Bike lanes were discussed for Boyd Acres Road. The new plan talks about a turn
pocket there and at Studio Road. (Staff referred to photos and sketches.) Empire
Avenue would be appropriately striped, with 'no parking' signs. This would
connect Highway 97 to Empire and across Boyd Acres to Studio Road.
The Board questioned whether there is enough traffic to merit a turn pocket in
the Empire and Boyd Acres Road area. They could just put a stop sign there to
handle the truck traffic on Boyd Acres. Staff will determine where the best place
for a stop sign might be. They still need the turn pocket. The action required
from the Board is to authorize the placement of 'no parking' on the sides of the
roads there.
An intergovernmental agreement with the Mental Health Division.
Development agreement proposal from Pat Gisler for landscaping work.
Final Mylar for Landers Acres subdivision.
Liquor licenses Millican Trading Post, Chen's Garden and Casa de Ricardo. These
were approved at this time.
Indemnity agreement for Central Oregon Youth?
Discussion of the indemnity agreement for the Juniper Classic.
Firewood permit for Michael Welsh? This is an extension and usually are
approved by Rick (sham. They have to meet the State standards for forestry and
wood cutting.
Emily Barlow from Senator Packwood's office will be in town on September 22,
and the Commissioners will be meeting with her. They will develop a list of issues
before then.

The Public Works Department has gone through a computerizing process, and
suggested it might be helpful to eventually have a terminal at Community
Development and at the Board's office for communication purposes.
