DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: PUBLIC HEARING ON AN APPEAL OF THE
HEARINGS OFFICER'S DECISION REGARDING CU -88-21, A CONDITIONAL USE
PERMIT FOR A BED AND BREAKFAST OPERATION AS A HOME OCCUPATION IN A
RURAL RESIDENTIAL ZONE.
July 14, 1988; 6:00-7:30 PM.
A meeting of the Board of County Commissioners was held on July 14, 1988.
Commissioners present were Lois Prante, Dick Maudlin and Tom Throop. Also
present were Rick Isham, County Counsel; County Administrator Mike Maier; and
other staff, plus citizens and members of the media.
Mr. Maudlin gave the opening statement. None of the Commissioners had any
conflicts of interest or bias to declare except they had met the real estate people
involved at difference times in the past.
Staff gave an overview of the appeal. The subject property is located off Donna
Butte Lane, northwest of Bend, and abuts U.S. Highway 20.
The Hearings Officer based his denial on three factors. The first was access
concerns.

The second was the existing three -party well on the subject parcel. The third was
identified as the intrusion of a commercial use in a non -urban residential area.
The applicant revised the total number of rooms from four to two. Staff stands by
its original recommendation with the following changes. Item #4 would be
amended to two rooms with four guests. Item #6, staff changed from four
parking spaces to two parking spaces. Under item #9, staff feels the well
agreement should be removed from consideration. Staff had originally required
that there be an additional well, but that was before the number of guests was
reduced.
There was then a lengthy discussion with the Board about these changes.
Win Francis, attorney for the applicant, gave testimony supporting his client's
appeal.
Neighbors testified that they have concerns about additional traffic, whether the
well can accommodate additional use, and the negative impacts to their lifestyle
from a commercial use in a rural residential area.
The Board indicated that a lot of the concerns are intangible and hard to measure.
They said they would take all of the testimony into consideration, and come to a
decision in a future public meeting.
