DESCHUTES COUNTY BOARD OF COMMISSIONERS

A meeting of the Board of County Commissioners was held on March 15, 1988.
Commissioners present were Lois Prante, Dick Maudlin and Tom Throop. Also
present were Rick Isham, County Counsel; County Administrator Mike Maier; and
other staff.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Amendment #8 to the Mental Health contract with the State, increasing funding
from the State.
Approval of subcontractors for Mental Health services.
Authorization to purchase a striping machine.
Discussion of agreements with the Deschutes National Forest regarding rights-of-
way stipulations for an archeological survey of the Burgess Road area. This road
project should go forward this summer.

Discussion of the student retention grant for Mental Health, in the amount of
$20,000. There was a lengthy conversation about liability and whether the
County would be protected.
Mr. Isham conducted a general discussion about liability and contracting that
would be fair to all parties.
Three requests for out of state travel; one from support enforcement and one
from Mental Health, and another for the District Attorney. (These were discussed
at length.)
Appointments to the Deschutes River Mitigation and Enhancement Committee.
Signature of a letter from the State Marine Board, requesting a hearing speed
limits on the Deschutes.
Bill Gibson spoke about a burnt building in Lazy River South. The owners have
failed to take care of the problem after being notified, so the County needs to
address it now. The fire happened in February 1987 and a resident perished in
the fire. All known relatives were notified that they need to do something with
the property, but none were willing to step up or didn't respond.
The property is valued at $7,120 for the land. There is about $3,000 value in
various improvements. Two years of taxes are owed, along with an LID fee. It
would cost about $2,000 to remove the structure. It is a nuisance and needs to
be handled.
Order No. 88-006, annexing property into the La Pine Rural Fire Protection
District.
Signature of Order No. 88-009, revising PL -15 provisions concerning legal lots of
record. Mr. Isham provided an overview of the issue, and said that these
revisions are appropriate. The Board is concerned about the bigger picture.

Reappointment of Scott Freshwaters to the Vandevert Special Road District
board.
Signature of Mylar for Awbrey Butte Homesites Phase 6, for the City.
Chair signature of a liquor license for the Rendezvous Restaurant in La Pine.
Reconvene a meeting regarding the 4H -Extension Service District. This involves a
new appointee.
Cooperative agreement with the City of Bend for Bend Millworks sewer line
extension.
Resolution 88-014, approving the boundaries of the Lazy River West annexation
into the livestock district.
Order 88-020, setting a hearing for the proposed formation of the Deschutes
River Recreation Homesites livestock district. The surveys were not accurate and
it needs to be approved again.
Signature of findings and decision for Dale Rath's lot of record application. This
was a denial by the Hearings Officer.
Discussion of settlement offer for a dog control case before it goes to the Court of
Appeals. Part of the settlement would be turning the dog over to someone else.
Amendment to agreement with the City of Bend regarding special transportation
services. The Mental Health Department asked that coupons be given to people
who need transportation to and from the Opportunity Center or to their
workplaces. The total cost would be $5,928. It also has to do with Rainbow
House clients.
Several plats and replats need signature. These are mostly housekeeping
documents.
Temporary use permit for CDD for Lyle Wilcox, for a new building on American
Lane.

Minor partition signature for Ted Roberts.
Newberry Special Road District appointment of three board members.
Liquor license renewal for Hook, Wine and Cheddar in Sunriver.
Amendment to the sanitation agreement regarding the Brothers School District.
Contract for $2,400 for further law enforcement on BLM land.
Order authorizing the refund of taxes.
There was a lengthy discussion regarding an economic development update will
be presented soon, including the role of the County.
A project for a La Pine helicopter pad is not feasible, at least not with County
funding and where it was proposed.
Discussion about the Gislers, owners of the Tumalo Mall, wanting to do further
development. Some of it already does not comply with the site plan, and they are
supposed to pave the parking lot and add landscaping this spring. They want to
mine the aggregate in that area, along the highway and within a residential area.
The Hearings Officer wrote a decision that this is not feasible. Local citizens have
organized and are very involved. They want to see this land used for an
appropriate purpose.
Additionally, the Gislers wants to acquire two small parcels owned by the County
to better orient a building for retail development. Legal Counsel is working on
determining the value of the lots and how this might work into a trade. The
Commissioners may hear from the Gislers regarding this situation. They want to
modify the site plan so the parking could be placed in a better location. The
parking would need to be paved.
There needs to be an open and public process, although the Gislers still think the
aggregate could be mined. This particular issue could be addressed at a later
date.

Discussion of vacating the Inn of the 7th Mountain Special District. Some owners
want to buy out the District to get better sewer service.
Discussion of Arnold Irrigation District and how to determine district boundaries,
in conjunction with the Watermaster. Similar issues are arising with other
irrigation districts. Mr. Maudlin asked what the County has to do with this. Mr.
Isham replied that it has to do with property assessments and taxes, and
recording liens. He will get more information so this can be discussed further
next week.
