A meeting of the Board of County Commissioners was held on April 28, 1989. Commissioners present were Lois Prante, Tom Throop and Dick Maudlin. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; and other staff and citizens. Chair Prante explained that although this is a public meeting, it is not a hearing where testimony would be taken. Questions may be considered, but it is not a time for anyone to give opinions or testimony one way or another. The Board will be touring some of the sites this afternoon, and citizens are welcome to join. Mr. Throop added that one way to look at this meeting is that it is basically an orientation and informational exercise for the Board. The Planning Commission has already held some hearings. An overview of the Goal 5 process was explained. Reference was made to the LCDC, maps and other information within the packet. The Goal 5 process is a four -step process: the inventory, the ESEE hearings, developing a plan after the ESEE analysis, and adopting the ordinances. An ordinance has been adopted regarding the inventory. Some policies were adopted into the comprehensive plan. Staff has identified the conflicting uses around each inventory site, and prepared staff reports on each resource site. Included is an ESEE analysis as required. The Planning Commission hearings were meant to review staff's ESEE analyses and recommendations regarding zoning designations and conditions put on a particular site. The Planning Commission is still addressing some sites, and should be finished in a week or two. In some cases, they have recommended adopting staff recommendations as written. In other cases, they made their own recommendations. There are six to eight sites that have been identified as high conflict sites, and some of those will be visited later today. ESEE hearings will start on May 9. The Board will have the ESEE analysis and recommendations, along with the ESEE model with general assumptions. There will be recommendations by staff, and by the Planning Commission if different. There will also be minutes of all the Planning Commission meetings. Staff went into further detail regarding the recommendations of staff and the Planning Commission. They did a lot of the legwork for the Board. There have been about 70 hours of hearings already held. The Board can agree with suggestions and recommendations, or come up with its own. Also explained was how the information would be made available to the Board and the public. Staff then provided a list of the high conflict sites, the adjacent property owners who are involved, and which attorneys are representing them. A few of the property owners have not yet retained legal counsel. Some of these situations may involve a period of negotiations with the owners and their counsel, to try to reach a settlement. One of the sites to be toured today is an example of how reclamation can be done successfully. Another site will show how it was not done so well. The Board will have to keep track of any pre -hearing contacts so those can be put on the record to avoid the appearance of conflicts of interest. The County -owned site creates a somewhat more difficult situation. The Board has to look at potential benefits for the County as a whole. The Board's role will be the same, which is as an impartial fact-finding body. County Counsel feels that perhaps the County should retain an outside attorney to represent Public Works on this particular situation. Mr. Maudlin does not necessarily agree with this recommendation. Mr. Throop talked about his contact with the Coalition for the Deschutes and how he would disclose these conversations. There have been discussions between environmental groups and certain mining site property owners to see if they can reach some kind of settlement outside of the County process. It is unknown how this might impact hearings and the decision-making process. Someone in the audience asked if they or their attorney could attend these conferences where there might be compromise reached. It was explained that since just one Commissioner would be there, it would not necessarily be an open meeting. It would be up to the parties involved as to whether this would be allowed. A citizen express concern about a Commissioner acting as a mediator in this type of situation. There was a lengthy discussion about what venue and equipment to use for the hearings.
