A meeting of the Board of County Commissioners was held on September 11, 1989. Commissioners present were Lois Prante, Tom Throop and Dick Maudlin. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; and other staff and citizens. Items discussed at this meeting may be on a future Board business meeting agenda: Discussion of a public hearing on the formation of the La Pine Park and Recreation District. Mr. Isham said there has been at least once person who indicated they want to be removed from the District. The Board is able to adjust boundaries. There might be some people in the northern part of the District who will feel they won't be benefited. The other issue is the appropriateness of the District's services. There will be two hearings. County Counsel explained that they manufacture and distribute precast concrete products such as septic tanks, utility vaults and so on. They were established in 1976 and purchased by Larry and Nancy Floyd in 1988. Sales are outpacing the company's ability to produce products, and they want to construct a 4,000 square foot indoor pour facility, with a seven -ton bridge crane and a badger mixed, and upgrade their fleet of delivery trucks. The total project is $175,000. U.S. Bank has committed $108,600 on a seven-year program. (A lengthy discussion took place of the terms of the loan.) The building owner has asked for a loan of $55,000 from the County, for ten years, at 8% interest. Collateral and other terms of the loan were then discussed at length; as well as sales for the past few years, expected new sales, and the number of employees and how many more new jobs were expected as a result of this project. The Board asked for more written information on financial statements. Discussion of a public hearing on an appeal of the Hearings Officer's decision regarding a request for a lot of record determination. This is for a lot in Cascade Woods subdivision. It is for one lot, but the implications of the decision could potential affect the entire subdivision. The file is extensive. Discussion of standard evaluations and feasibility for sewage disposal systems. A citizen was asked if he is focusing his attention on a new lot, and not the one that was discussed in the past. A citizen, Albert Phillips, said he is still interested in both. There was a lengthy discussion about the State's rules. The citizen feels that the County is supposed to implement the rules, and he feels the County is not treating citizens equally in this situation or using the same standards. Transcription of Audio Recording of a Work Session, September 11, 1989 Page 2 of 6 Mr. Throop said that they agreed there were a few mistakes, and the employee who made them is no longer with the County. The citizen stated that the same person evaluated four lots plus two since then, and did not use the same standards for each one, and did not treat this citizen the way he has treated others. They would not come back out and reevaluate his lots. There was a lengthy discussion about this situation. Mr. Maudlin said this has been discussed for a long time, and even if there were mistakes made, that doesn't mean this is still happening. They can't correct a mistake with another mistake. They cannot continue to allow these under the current program. DEQ feels there is a serious issue in the area with the depth of the water table, and do not want to allow septic systems because of this. This problem has not changed. Staff pointed out that this problem was brought to the County's attention as long as ten years ago by the DEQ. Things have not gotten better, because the water level remains the same. DEQ spent a week in the La Pine area evaluating the soils and water level, and determined, among other things, that the County had not been digging test holes deep enough in the past. The DEQ developed new criteria for test holes and evaluating Tots for septic feasibility. This criteria is more restrictive than in the past. However, they can't go in and tell someone to pull out a system that has already been approved and installed. This discussion went on for quite some time. Mr. Phillips still felt he was not being treated fairly. The Board said there is not much they can do about the situation going forward. Ms. Prante explained that a mistake was made in allowing a neighbor to have a system, but it does not make sense to allow other mistakes to occur because of this. They have to take the readings in the high water time of the year, not the dry season. She recommended that staff go out and do a test on each one, and it will either show that a system is not allowed and the other shouldn't have been, but was; or that the water is far enough down that this is not a problem. There should be clear, written criteria. If they can do this, it should provide a final answer to this problem. Discussion of an intergovernmental agreement with DEQ regarding the illegal storage of quantities of tires. There are two sites in question. One is the Comstock site and the other is in Hampton. The cost will be about $80,000 for the two sites, and the County is responsible for 5% of the total, which is about $4,000. Discussion of an agreement with the Redmond School District regarding foodservice inspections. Signature of plats for Awbrey Butte Homesites phases 11 and 12. Department of Public Works acceptance of dedication of a deed for the Tyler Road realignment, so a big ponderosa pine can be spared. Resolution accepting a petition to vacate 27th Street in Terrebonne. Discussion of the realignment of Arnold Market Road, with a proposed right of way to be vacated. Petition to vacate Mill Road, which is an alley located in the Skyliners subdivision. Discussion of the award of a bid for the southwest landfill transfer station, for concrete work. Appointment of Ray Bennett to the Historic Landmarks Commission. Liquor control license approvals. Discussion of SRS contract #12. Discussion of a Mental Health program for a speech therapist. This was delayed for a week due to insurance coverage questions. Transcription of Audio Recording of a Work Session, September 11, 1989 Page 4 of 6 Amendment to an agreement regarding the Welcome Center project, with the City, County and Bend Chamber of Commerce. It is important for the Chamber to operate the facility under a master lease. The various parties are working out their differences in how this is supposed to happen. Discussion of a staff decision regarding a metal building at W.B. Anderson that someone wants to move onto a property owned by his parents. The person who bought it needs to move it off its current location soon. The procedures ordinance allows for an administrative appeal and decision. The building is over 2,600 feet and would go into a residential zone. It is a one -acre parcel and the parents own a mobile home there. It is not felt that it is consistent with the nature of the standard residential zone. They want the building to house an RV, a boat, several cars, camping gear and a travel trailer. Some large buildings have been allowed in the County outside the urban growth boundary. However, this is within the UGB and it might cause problems within the neighborhood. The Board suggested that the neighbors should be notified to see if they have any problem with the building coming in. Staff said that time is short for the person who bought the building. Staff and the Board decided that they would go out and look at the property and the building, and make a decision. Discussion of tax refunds. Discussion of MP -89-26 from Robert and Marcia Smith. Discussion of a budgeted cash transfer. Discussion of transferring appropriations. Discussion of an upcoming hearing regarding surface mining. The owner of Cascade East publication is concerned about public dollars going into the Central Oregon booklet, which is a response piece when people inquire about visiting the area. He feels the County is subsidizing his competition. Ms. Prante feels they are describing two different things entirely. This funding comes out of room tax money for this specific purpose. Resorts and hotels have requested that both be in the guest rooms. This is not a County issue. Discussion of tax refunds. Jeff Kern, Deputy Surveyor, would like to see his position be more than just a title. He feels he is not getting the respect or acknowledgment he deserves in this position. He fills in when the Surveyor is unavailable. He wants a title defined and have it on the elections ballot, the same as the Surveyor. Mr. [sham will find out if this is discussed in the Constitution. The Coats sign is in the Sinclair Avenue right of way, in Conestoga Hills. The sign is to be removed. Nichols Market Road has been chip sealed. O.B. Riley Road badly needs to be done as well. Discussion of field burning permits, with the cooperation of the BLM and USFS.
