A meeting of the Board of County Commissioners was held on April 17, 1989. Commissioners present were Lois Prante, Tom Troop and Dick Maudlin. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; and other staff. Items discussed at this meeting may be on a future Board business meeting agenda: Discussion from a citizen who is part of Bend Investment Development Corporation, which started up about 28 years ago. They bought a ranch just north of the canals on Boyd Acres Road, and ran a 12" water main from the City of Bend to the property. This was for Bend Millwork, who sold out to Pozzi Corporation. At that time the County helped with the road and the bridges. Since then most of the area has been sold out to Fuqua Homes and Beaver Coaches. The group then took on Phase II and Phase III, which have been sold out. In 1979 they bought more property for Phase IV. They got a grant for extending water to the end of the development but paid for all the rest, plus the streets, at no profit. They are seeing some profit now as they sell parcels. They now have stockholders involved and all have recovered their investment. The problem is that the County wants more done with the roads. Some of the property owners are upset about this. The Road Department has a new rule to improve the roads with curbs. The Planning Department has been good to work with, though. Mr. Throop said that there are some ordinances in place that are subject to interpretation. The citizen said that the curbs will cause some problem with where the water flows. Some of it is going to drain right into his driveway where there is a loading dock. He said he can understand this requirement in new subdivisions, but not retroactive. They are getting out of the business anyway, since there are others picking up where they left off. When they started, no one was helping people find industrial or commercial property. Now the property owners are upset about the County's new requirements. Ms. Prante said that they should not require this of someone who developed properly at the time. These are the City of Bend standards. The citizen said there are only about four lots left to sell, and this is making it hard to do. Mr. Maudlin said that some of the property owners seem to have purchased after the ordinance was in effect. Mr. Isham explained that the standards were changed in the mid -1980's, and what triggers the enforcement is when someone comes in for a building permit. It doesn't affect those who have already built. This requirement has been consistent. That will gradually get roads up to the proper standards. However, this ends up with patches of sidewalks and curbs. It is also expensive to do this kind of work piecemeal. There was a lengthy discussion about when the properties were sold and built upon. The Board asked for a list of potential impacted properties in that area and in others. Staff will investigate. Discussion of a Children's Trust Fund contract. Discussion of Amendment #20 for case management under the Health Department contract with the State. Discussion of a letter of support for the dispatch program. Discussion of a development agreement with Thomas Weston. Discussion of a minor partition and declaration of dedication. Mr. Throop spoke about the transportation plan update. COCOA and Bend Dial -a - Ride are involved. (There was a long discussion about the increase in calls and services.) Update on recycling efforts with the Solid Waste Advisory Board and one of the Commissioners. Discussion on self -haulers versus contract haulers, with the input of the contract haulers group. They have come up with a list of recommendations. Discussion of the acceptance of a right of way easement from Oregon Fish & Wildlife, off Bridge Drive. Discussion of an indemnity agreement with Central Oregon Park & Recreation District for the 7th Annual Redmond Triathlon. Discussion of personal services contract with Jeffrey Barclay as a supervising psychologist in the Mental Health Department, at a cost of $50 per hour. Discussion of Order 89-027, budgeting cash transfers. Discussion of Resolution 89-026, appropriating transfers. Discussion of an upcoming Health and Human Services Division meeting. Discussion of an upcoming special Parks & Recreation meeting for the greater La Pine area. Discussion of upcoming work sessions and a tour of potential surface mining locations. Discussion of the desire of mobile home park owners to expand their existing park areas. The County's hands are somewhat tied due to the law and non -conforming uses rules at the State level. Although the County wants to support affordable housing, the problem is these are non -conforming uses in rural areas, and there is not much the County can do about it. Discussion of Barry Slaughter's request to move to option #1 on the CCA. Discussion of the Mental Health Division's top priorities. The Board will support these. Discussion of the resource capabilities of those who want to establish a race track at the Fairgrounds location. Discussion of the staff report regarding Reed Road, which currently does not have an official access. However, the State recognizes the one that is being used.
