ORDER NO. 2017-026 WHEREAS, LUBA issued its decision in Grimstad v. Deschutes County, LUBA No. 2016-035 on September 29, 2016, and WHEREAS, the LUBA Grimstad decision effectively invalidated the historic process and procedures (see LR -93-47) utilized by County planning staff to validate the lawful status of lots and parcels within unincorporated areas of Deschutes County; and WHEREAS, the LUBA Grimstad decision was subsequently affirmed by the Oregon Court of Appeals; and WHEREAS, in response to the LUBA Grimstad decision County planning staff has alerted property owners, real estate professionals, title companies and local builders to the ramifications of the decision; and WHEREAS, the Board of Commissioners have studied this issue, received public testimony and evidence, consulted with staff and communicated with numerous interested parties and have concluded that it is appropriate to reduce and in some instances reimburse a portion of the application fees; now therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, hereby ORDERS as follows: Section 1. County Administration and County Finance are directed to transfer up to $80,000 to Community Development Department from the General Fund for partial reimbursement of fees paid by Lot of Record Verification applicants. Lot of Record Verification applicants who paid an application fee, on or after October 1, 2016 and prior to July 1, 2017, and who had been issued some form of prior approval by CDD, such as septic permits, building permits or planning permits qualify for partial reimbursement of the fee (either $250 or $675 depending upon the nature of the subject application(s)).
