A meeting of the Board of County Commissioners was held on December 14, 1992. Commissioners present were Nancy Pope Schlangen, Tom Troop and Dick Maudlin. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; and other staff and a few citizens. Items discussed at this meeting may be on a future Board business meeting agenda: Discussion of changes at the Bend Recycling Center. Ann Kerr, co -president of the group's board of directors, provided an update of various changes in programs. They have been working with Bruce Bailey regarding a donation of the front half of the recycling center to the group. He would keep the cardboard recycling part for himself. They have made an agreement in principal at this point, but need to work out a few details. Transcription of Audio Recording of a Work Session, December 14, 1992 Page 1 of 6 Mr. Maudlin confirmed that there would be a new lease with the County for the operation of the recycling center, including all of the buildings now under operation. Mr. Throop said this would be a major change, and wants Public Works staff to weigh in on it, and to obtain recommendations from the Solid Waste Advisory Committee. Mr. Maudlin asked for an explanation of why the program is costing so much money, and how to reduce this. He asked if it should go out to bid. Ms. Kerr indicated she would like to see the subsidy reduced as well, and sees an opportunity to do so from what they make from recycling cardboard through Bend Garbage. Mr. Throop said that this does not reduce the subsidy, but instead allows one private hauler keep the only economically beneficial part of the solid waste stream, with all of the losing parts of the operation going to a private nonprofit. He feels this is a significant departure of what is currently done, which is to try to have profits offset losses. He thinks that the loser in this arrangement is the fee - paying public. Mr. Bailey then asked if he could speak. There was a lengthy, heated discussion about this issue. It was pointed out that in maybe five or ten years, they may have to have a new facility or the waste may even be going out of state. The Board will have the Solid Waste Advisory Committee review the proposal and provide input. Discussion of an environmental pollution clause in the proposed Wilbrose (?) Energy lease. The County and this company have been unable to come to an agreement regarding property near Knott Landfill. He asked his attorney, Bob Lovlien, explain the issue. They do not want to have to drill all the way to the groundwater level, but are open to a level 1 assessment as a benchmark. Transcription of Audio Recording of a Work Session, December 14, 1992 Page 2 of 6 Mr. Lovlien went over the terms of the lease and what he saw as problems with the language. This company does not want to be responsible for any future pollution on their site, when the property is next door to the landfill and the company will only occupy the site for about a year. Staff went into a long explanation about why they have included this language in the lease. A long, heated discussion followed between the attorney for the company and the County Property Manager. The two parties will work on this and return to the Board with some recommendations. Discussion of Resolution 92-092, declaring the intention to transfer real property to Bend Metro Park & Recreation District. Representatives of the District updated the Board on what they are doing at this time. One item is the concept of river run trail, from Pioneer Park around the north side of Awbrey Butte and then over to Tumalo Creek and Shevlin Park. (The group reviewed maps at this time.) There are some concerns about land ownership. They are working with the City and Brooks Resources as well. A grant from Oregon State Parks is looking positive for a trail from approximately 15th and Reed Market Road, following an irrigation lateral road, ultimately over to Pilot Butte and beyond. They like the idea of the area using irrigation roads for this kind of use. John Simpson then did an update on the Hollinshead Park project, to rehabilitate various buildings on the property. Initially there will be a cost to groups to use the buildings to recuperate some of the costs. They will be coming back to the County in the near future with a detailed budget, and a request for a grant from the County. They are working on a partnership with the District and Broken Top Development. This relates to the development of Big Sky Park, Phase II, east of town, for a 33 acre parcel just south of the new school on 27th Street near the landfill. They feel this would be a great opportunity for a sports complex, which is desperately needed for the community. Transcription of Audio Recording of a Work Session, December 14, 1992 Page 3 of 6 They would go into the Skyline Park area and deal with some of the problems there, since it is built over an old landfill and is subject to the land settling. This would be converted to a general purpose park, good for picnics, landscaping, and other outdoor activities, plus a ballfield on one end of the site. Regarding the Resolution, this deals with the larger Eastgate complex, which will eventually be a 900 acre regional park. The Board confirmed they would approve this transfer so the District can start making plans for the area. Discussion of a Resolution declaring the intention of transferring real property to Bend Area Habitat for Humanity. This is a lot on the corner of Bond and Florida. It was pointed out that at some point, the City may want to widen Bond Street for additional right of way, as a part of the Parkway project. Discussion of returning property to the owner of record, as a purchase out of foreclosure. Discussion of a public hearing, amending PL -20, the comprehensive plan for year 2000 regarding surface mining site ESEE analysis; in particular, the R.L. Coats mining site below Tumalo rim. This is a housekeeping item per staff. They have one year to complete work on the site. Discussion of a public hearing on application for a farm dwelling on a 1,750 acre parcel zoned EFU. Discussion of approval of a City of Bend condominium plat for Rivers Edge II condominiums of Mt. Bachelor Estates C. Discussion of the reappointment of Ernest DeCort to the Deschutes County Budget Committee. Discussion of an appointment to the McCarty (?) Special Road District. There are just 23 electors in the District so it is hard to get District members. Discussion of an appointment to the Fall River Estates Special Road District board of directors. Transcription of Audio Recording of a Work Session, December 14, 1992 Page 4 of 6 Discussion of a partition to create three farm parcels in an EFU-20 zone, containing 26 acres, 22 acres and 42 acres. This is an old issue from 1991 that needs to be completed. Discussion of an upcoming meeting with the Mental Health Director. Discussion of an upcoming jail update. Discussion of potential appointments to the Sunriver Planning Commission. Discussion of the previously held household hazardous waste meeting. OSU Extension agreed to provide staff as a project coordinator, and haulers will help with other staffing. Discussion of the most recent OSU population numbers, and whether to contest the County numbers. Mr. Throop talked about the John Adams issue that will be before the Board on December 30. This was previously a 2 to 1 land use decision. The people do want to exercise the permit. Bruce White said they have made significant progress and are applying for an extension on that basis. This is a normal extension that could be granted. (A long discussion ensued.) Discussion of two decisions: one regarding Pacific Power & Light, and one with J Bar J. Discussion of a meeting with Squaw Creek Canyon Estates residents regarding a local improvement district. Discussion regarding a salary for the Board of Equalization members. It is a minimal amount. To avoid confusion, the Clerk recommended that they get $40 a day and no reimbursement for lunches. They are getting $25 a day now plus lunch reimbursement. Mileage is computed separately. In most places in the State they are paid between $50 and $100 per day. The Board was supportive of the $40. Transcription of Audio Recording of a Work Session, December 14, 1992 Page 5 of 6 Mr. Maudlin said that he heard from a citizen who wants to replace an old home with a new double -wide mobile home. They have had a hearing on this. It is in the flood way, and the Hearings Officer said they can't do it. Staff said that the problem is that it is already a non -conforming use. Mr. Maudlin stated that the house they are living in is now insulated with newspapers. They would be ten times better as a living situation. It is located off Highway 126 about a mile east of Sisters. CDD staff said they had recommended it be approved. This is the first one like this that they have done. Mr. Maudlin wants the Board to bring this up on review and let the people improve their situation. They have already paid out over $2,000 in fees. Staff will review this and get back to the Board.
