A meeting of the Board of County Commissioners was held on August 27, 1990. Commissioners present were Lois Prante, Tom Troop and Dick Maudlin. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; and other staff. Items discussed at this meeting may be on a future Board business meeting agenda: Discussion of a public hearing regarding McManus nuisance abatement and Lazy River South subdivision. Brad Chalfont is handling this issue. He explained that there are safety hazards associated with this property, and it is an eyesore. It quite clearly comes under the nuisance abatement ordinance. He recommended that the owner be given ten days to clean up the property. Then Public Works could go in and clean it up, and attach a lien to the property to reimburse costs. The bid from a private contractor was $4,500 for cleanup of the mobile home, but there are other buildings as well. There are several buildings that cannot easily be made secure, however. The property is now on the foreclosure list. There are taxes and an LID to pay off as well as Public Works' costs. There is a two-year redemption period for the foreclosure. Discussion of a final public hearing on Order No. 90-084, the Jacobs annexation to Rural Fire Protection District #2. Discussion of final public hearing on Order No. 90-085, the Daniels annexation to Rural Fire Protection District #2. Discussion of out of state travel requests for Bob Dean and Pete Manley of Public Works. This has to do with data management programs. This training is necessary. Discussion of out of state travel request for Roger Kryzanek from the Health Department. This is mostly funded by a grant. Discussion of a request for funds for runaway and homeless youth, which is a Children's and Youth Services Commission request. Board approval is needed to draw down some of the State funds for this purpose. (A lengthy discussion ensued regarding how this program was developed, who would handle it, and the goals.) Discussion of approval of a contract for a grant amendment for the La Pine Sewer District. This is the close-out document for the program, which has taken quite a while. Discussion of approval of contracts with the Central and Eastern Oregon Juvenile Justice Consortium for various programs. This is to meet indemnification requirements. This would delegate authority to the Director of Public Works, but the Board decided they want to do this in case there is an appeal. The Board also wanted to make a provision for gate permits for public agencies. There was a lengthy discussion about the document and what to do in the case of an appeal. Discussion of a personal services contract for the STF program. Discussion of a code enforcement task force update. Discussion of a Bend salvage company fence. This is not as simple as it might seem. The owner of Bend Salvage was cited regarding the fence, which is 16 feet tall, and required a permit and engineered plans. A complaint came in from someone in the area that part of the fence was falling down. It has been fixed, but the citation is still pending. The neighbors would prefer it remain, but the salvage company owner said he can't afford to do anything further. It is a serious hazard, lacking the structural support it needs. This has been a problem for several years. Mr. Maudlin recalls that this is the fence the company was told to build by the County, to protect the neighbors. They also planted some trees, which are all dead now. He has a problem questioning why they were told in 1983 or 1984 to build the fence, but now the County has issued a citation. Staff indicated that there is no record of this, and there was never a permit issued. There was a lengthy discussion as to what can or should be done about the situation. They are obligated to have a fence, per the site plan. Mr. Maudlin feels they should just tell the owner to keep it in good repair and move on. This will be discussed further this week. Replacing it requires more funds that the people have, since it was a 1979 model but needs to be larger with a higher roof pitch, so the Red Cross is helping. Discussion of census numbers. They are not what the County anticipated and there needs to be an organized response. The City of Bend shows a 5.5% vacancy rate. Not all vacant homes are second homes, however. There was a question as to whether they can cross-reference with voter registration or vehicle registration records. There was a lengthy discussion about the validity of the numbers and whether they can be adjusted. Discussion of OLCC license applications for Kathy's Deli, Woodmark Bowl, La Pine Bookstore, Thousand Trails, Ponderosa Pizza in Sunriver and La Pine, Sunriver 19th Hole Restaurant, Sunriver Owls' Nest, and two for Hook, Wine and Cheddar. Discussion of Ordinance No. 90-036, amending animal control code. Bruce White explained the proposed changes that will go into effect soon. He has met with the Sheriff's Office to determine how to implement it. There need to be some refinements to kennel licensing provisions. Most of this is housekeeping to make sure the various references are consistent. Discussion of Order No. 90-124, redemption of tax foreclosed property by the Eades, by bargain and sale deed. Apparently cartography in the Assessor's Office got the name wrong, and notice was given to the wrong party. This redemption will correct this error. Discussion of MP -90-17, final Mylar creating three parcels on Highway 97 south of Redmond. Discussion of MP -90-9, a minor partition for two lots in South Hyatt Division. Discussion of Order No. 90-123, tax refunds. Transcription of Audio Recording of a Work Session, August 27, 1990 Page 4 of 6 Discussion of proposed personnel actions. Mike Maier explained that there are a number of classification adjustments for four departments — Community Development, Data Processing, Public Works and Building Services. He has worked with the departments to deal with these. These are not merit increases but adjustments that are appropriate, based on experience, as an equity adjustment. The Board agreed. Mr. Maier spoke about beginning cash balances. The purchase of an air conditioning system came in lower than estimated. They also need to start the Courthouse windows project, and the type of windows will be different if they don't use central air and keep the variety of window units. The Board was supportive of central air. They are looking for a County -wide solution to this problem, including the library. Mr. Maier will come back with more firm figures. This needs assessment should also include 9-1-1. It would need to be bonded. Discussion of an asbestos survey at the White School in La Pine. It is going to La Pine Park & Recreation, and they will deal with any immediate needs. Discussion on a call from Benton County asking what the County is going to do for those members of the Armed Services Reserve who are employees but are called up for active service, and whether benefits are covered for the families while they are gone. The County is required to maintain their position for them. Mr. Maier feels that the families would be covered by military benefits, but will investigate the issue further.
