DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
April 15, 1991; 10:00-11:15 AM.
A meeting of the Board of County Commissioners was held on April 15, 1991.
Commissioners present were Nancy Pope Schlangen, Tom Troop and Dick
Maudlin. Also in attendance were Rick (sham, County Counsel; County
Administrator Mike Maier; and other staff and a few citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Discussion of a complaint regarding John Bell's fence, off Johnson Road. The
complaining citizens said the fence is like a billboard, and they can't see over or
through it. It is in a beautification area, and they feel it is out of place. They think
it was put up for spite.
Karen Green explained the long history. It was part of a building permit taken out
in 1988. The fence was not reviewed under the landscape management
ordinance as it should have been by CDD.

It was permitted, staff was alerted by the neighbor and looked at the fence, and
stopped the work on it. A modified permit was issued that required the fence be
lower and a different color. Dr. Bell then sued the County, saying that he had a
legitimate permit. After two years of litigation, Dr. Bell and his attorney assumed
the decision was in his favor and proceeded to finish the fence.
The Judge's decision was that the County could not issue a stop work order. He
concluded that he did not have jurisdiction to deal with the land use part of the
issue. One option is to take Dr. Bell to LUBA.
Bruce White said they could try to revoke the fence permit or file a nuisance
abatement order in circuit court. The court decision is not very clear to anyone.
County Counsel is trying to figure out which way to go.
After a lengthy conversation, the Board said they would support whatever way
that Legal Counsel says they should go.
A lengthy discussion of a modification of a loan to High Tech Trust. There was a
long conversation regarding the County's security standing behind that of
Western Bank.
Discussion of acceptance of a corrected warranty deed from Redmond School
District.
Discussion of an order setting a public hearing for the Antler Lane local
improvement district. This LID petition was filed prior to the passage of Ballot
Measure 5.
Discussion of a public hearing on amendments to PL -15, to expand the definition
of Class C manufactured homes and to clarify building materials required for Class
A and B manufactured homes. George Read said this will clarify some of the
terminology in the new manufactured homes ordinance. A long discussion
ensued. The Commissioners were concerned about the small square footage
requirement.

Discussion of a fee waiver request for a minor partition and other costs relating to
a new Fire Hall for Black Butte Ranch. There was a long conversation about
whether to have CDD foot this bill. It was determined that it would be more fair
to the department for this kind of waiver come out of the general fund.
However, the Board is concerned about other organizations asking for the same
thing. Most of the districts are in better financial shape than the County is right
now. Whatever they do, they need to be equitable to everyone. This will be
discussed further prior to the new budget process.
Discussion of a request for the appointment of Don Williams to the Farm Use
Board of Review.
Discussion of appointments to the Historic Landmarks Commission.
Discussion of several appointments to the proposed Municipal Golf Course
Steering Committee.
Discussion of approval of a tax refund Order.
Discussion of signature of an industrial subdivision plat for Sisters, for Arnie
Swarenz and Joe Taylor.
Discussion of upcoming meetings with County Counsel and the Administrator, and
the Sheriff and Jail Manager.
Discussion of a request from Bob Riggs for help regarding a mobile home
subdivision northeast of Redmond that is having a problem coming up with
advance funds for a utilities and road deposit. Allan Kirk, the project developer,
spoke at length about the situation. It involves a land use decision as well as
public works, and the decisions don't match. This will be discussed further in a
week.

Discussion of an agreement between Rural Fire Protection District #1 and the City
of Bend regarding various fire hall sites.
Discussion of a complaint from Fred Hansen Excavation regarding people using his
name for getting permits, but not having him to do the work. He feels this puts
him in jeopardy for work he did not do. Perhaps the excavator needs to sign the
application. This could be impacting other contractors as well.
