DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: CONTINUATION OF PUBLIC HEARING
October 14, 1991; 10:00-11:00 AM.
A meeting of the Board of County Commissioners was held on October 14, 1991.
Commissioners present were Nancy Pope Schlangen, Tom Troop and Dick
Maudlin. Also in attendance were Rick (sham, County Counsel; County
Administrator Mike Maier; and other staff and a few citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
The Chair reconvened a hearing for a decision on a plan amendment and zone
change from RS, rural industrial, commonly known as the Shields site in La Pine.
The property has legal conditional uses in place at this time. These uses are
grandfathered and cannot be stopped. Mr. Maudlin feels that the Board can
exert some control over some uses if the zone change and plan amendment are
allowed.

There was testimony regarding access; and there was a lot of discussion regarding
a BLM letter from 1980, which says that the access road was built over public land
to serve the plant area in 1972, and it has been in use since that day; further, that
the road does not require application for right of way under public law.
There was also testimony regarding use limitations for roads in the rural industrial
zone; in particular, over thirty heavy equipment trips per day.
Mr. Maudlin suggested that the plan amendment and zone change be allowed,
with conditions. He shared a long statement at this time, listing his desired
conditions.
Ms. Schlangen agreed with most of his statement, but does not think they need a
year to clean up the site as required. The owner has indicated it would not take
that long. There was a lengthy conversation regarding the timeframe and
whether the changes should be allowed first, or as a condition after the work has
been done.
Mr. Maudlin moved that the zone change and plan amendment be allowed,
subject to conditions written as findings, with a one-year, or October 1, 1992,
time limit for them to be completed.
Ms. Schlangen seconded. The vote was unanimous.
