DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
March 11, 1991; 10:00-12:00 PM.
A meeting of the Board of County Commissioners was held on March 11, 1991.
Commissioners present were Nancy Pope Schlangen, Tom Troop and Dick
Maudlin. Also in attendance were Rick (sham, County Counsel; County
Administrator Mike Maier; and other staff and a few citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Discussion of a request for a fee waiver for a conditional use permit for moving a
house. A representative of Habitat for Humanity said they have had a house
donated to them, and would like to relocate it from Harmon Street to just off
Blakely Road. They need two conditional use permits: one for placing the house,
and one to deal with the fact that it was built prior to 1961.

The new property is 1.7 acres and has one dwelling on it, but can have another
with a conditional use permit. It would remain as a single tax lot at this time. The
permits are $330 each. The other dwelling is a trailer with an attached porch, and
will likely be torn down.
Long-range, they would want to subdivide and put several homes on the
property. It is in the UGB and a lot that size can accommodate five or six
dwellings per acre.
The Board will determine the total fees, including inspections of the house once it
is moved. They emphasized that the department is supported by fees and things
are very difficult right now. They will let them know later this week.
Discussion of a public hearing on Ordinance 91-014, amending the zoning
ordinance to allow landfills as a conditional use in the EFU-320 zone. This would
be to establish a County burn site east of town to handle stumps and other waste.
DLCD has been notified of this potential change.
Discussion of an appeal of the Hearings Officer's denial of a farm petition on a 40 -
acre parcel, into two 20 -acre parcels in the EFU 20 zone. One parcel would be
entirely irrigated and the other won't. The applicant could not show that this
would enhance the farm use of the property.
Discussion of Order 91-036, designating Sky View Terrace Subdivision as an area
where the discharge of firearms is prohibited. There were four individuals
opposed to this, but 22 signed the petition.
Discussion of the possible award of a contract for improvements to the Inn of the
7th Mountain's sewage facility. They were over estimate, but are dealing with
change orders, per the advice of Counsel.
Discussion of the acceptance of a warranty deed for a right of way acquisition for
the Redmond School District.
Discussion of a lease for the Education Service District.

Discussion of a contract for training on security hardware for the jail.
Discussion of an Ordinance, amending code regarding manufactured homes in the
Redmond urban area. There has been a sunset clause attached to it.
Discussion of signature of a declaration of dedication and acceptance for Back
Alley and Nighthawk Road, which have been brought up to County standards.
They will be accepted into the County road system.
Discussion of signature of an acceptance of dedication for Bend River Mall
Avenue, as a public right of way and County maintained road.
Discussion of a memorandum of lease, assigning a lease to Sequoia
Communications.
Discussion of appointments to Deschutes River Recreation Homesites Special
Road District.
Discussion of signature of Order 91-042, changing the name of 32nd Avenue to
32nd Street.
Discussion of the BMX track at the demo landfill will occur at the end of the
meeting today.
Discussion of the progress regarding surfacing mining land use issues as they
become part of Code and the comprehensive plan. Deschutes County is the first
in the state to go through this process.
Discussion of an invoice for the County's part regarding the systems development
analysis. This is being shared equally between the County and the City. The
Board agreed that it will be paid out .of Public Works since CDD is struggling to
make ends meet at the present time.
Discussion of Bill 2652 that CDD has been working on with the Central Oregon
Builders' Association, regarding altering the definition of an owner -built structure,
from one year to three years. Penalties would be increased as well. Dennis Luke
is head of the State Builders' Association this year and is helping with this
situation.

Discussion of the Children and Youth Services Commission regarding proposed
terms. They have a new coordinator on board.
Discussion of an upcoming meeting with Health Services, and another with Data
Processing.
The Board adjourned briefly, and then reconvened to discuss the BMX situation.
It was decided that Blue Sky probably won't work because of access problems at
the site. The solution seems to be using the demo landfill site. To make that
work, there needs to be a plan amendment and a zone change, plus some other
applications. The cost is about $3,500.
There was a discussion about a temporary use permit and what it would take for
this, so BMX can begin to do some work at the site prior to the 120 days it might
take to get through the process.
They need to start the public hearing process and see if there is some kind of
consensus and predominate support from the public. If the plan amendment and
zone change do not materialize, it would be the responsibility of BMX to restore
the site to its original condition.
They have spoken about a variance that would be needed for the road and
parking standards. It became obvious that it is not practical to use an improved
dirt road for this and trucks that would be utilizing the landfill. It needs to be
improved to a higher standard.
They also need a DEQ lease for that portion of the site. This should not be a
problem because it was never used for a landfill.
There is also a need to address the need for a fire hydrant. The City said they
would waive this. They would need enough water to sprinkle the tracks and
supply bathroom facilities. PP&L has already signed off on providing power to
the site.

The site needs to be maintained by Public Works until the site is developed. It
would be under a lease until then. Title would be transferred from the County to
Bend Metro Park & Rec once the site is developed fully for this use.
BMX is not happy with the fees, but the County can't waive them, either. It is
possible that the Waste Management team will participate in some of this work
as well. There is another $300 fee for a septic feasibility test.
Staff advised that they can't do temporary use permits for a zone change and plan
amendments or variances. Race tracks are specifically prohibited as a conditional
use from practically anything except a commercial zone. The Planning
Commission would have to do a 'similar use' ruling that these are not racetracks.
It doesn't say motorized or not, so this requires an interpretation. This is an extra
step in the process. This would require public notice.
At the very least, there would be two public notice periods and this will take this
out several months at best.
There was a discussion about this activity already taking place on the Power -All (?)
site. It was not known if this was every legalized.
The Park & Recreation District is still behind this effort. DEQ is not satisfied that
the County has closed off portions of the road adequately to deal with the dust
issue.
There was a lengthy discussion as to whether the criteria can be met. Staff said it
is more complicated than what the Board is anticipating. Given the history of the
neighborhood and complaints about dust, it could be that there will be a lot of
people against it. There are no guarantees when you start working on a land use
change.
The proposed applicant and Park & Rec were advised to perhaps start doing some
research on what the neighborhood might think about this proposal, and some
possible outreach. The group will meet again with the Board in a couple of
weeks.
