A meeting of the Board of County Commissioners was held on February 11, 1991. Commissioners present were Nancy Pope Schlangen, Tom Troop and Dick Maudlin. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; and other staff and a few citizens. Items discussed at this meeting may be on a future Board business meeting agenda: Discussion of real property auction process. A citizen has questioned the fairness of the auctions. One bidder raised the amount to over the stated asking price, and did not follow County terms. He did not pay or apparently plan to pay. The citizen would like the overage amount that he was forced to pay, $1,200, returned to him, in fairness. He was forced to overpay for this purpose because of this bidder. The County could also return the property to the next bidding event to get a fair and honest price for it. Transcription of Audio Recording of a Work Session, February 11, 1991 Page 1 of 5 He thinks the County should ask for some kind of deposit from the bidders to ensure that they are sincere in their efforts. The County needs to be sure that bidders are qualified. Mr. Maudlin said that the high bidder also bid on another property, and did not continue bidding on the one in question once he knew he was high bidder on the other property. However, he seems to walk away from it as well. These are average citizens and are not required to post a bond or deposit. This has never been required, but they have never had anyone not complete their purchase. However, individuals can stop bidding whenever they want to, if it goes over the minimum bid price. This person is asking for the County to return the higher amount that he felt he was forced to bid, or put it back into the next auction. In any case, the amount received by the County cannot be lower than the original minimum bid price. The Realtor is also due a 5% commission. There was a long discussion about the auction and whether to change the bidding process. The Board asked staff to look into revisions that may keep this from happening in the future. Discussion of a cooperative agreement with the State Highway Division regarding the Yew Avenue interchange. The County could be responsible for up to $200,000 of the costs. Discussion of an amendment to the intergovernmental agreement with the State for Health services. Discussion of revenue shortfalls due to Ballot Measure 5, and whether to continue certain services. Discussion of a Resolution to exempt Black Butte Ranch County Service District from the Social Security system and instead participate in PERS. The Board was not prepared to take action on this and asked for clarification. Discussion of a transfer of land to the Fair Board by means of a lot line adjustment or a partition. It was determined that a partition was necessary. This will bring the total to 160 acres. Discussion of granting two power line easements to Central Electric Cooperative. One is near Alfalfa off Walker Road, and the other is between Bend and Redmond. Discussion of a power substation that was built without permits, that is already in operation by Central Electric Cooperative. They proceeded even though they were advised not to, and created some road damage while they did this. Residents have complained about the trees being removed and about a loud humming noise that they can hear within the residences. The citation process will proceed. Discussion of a public hearing on an Order transferring four parcels to the City of Bend. Discussion of a personal services contract for the feasibility study on the La Pine Sewer Project. Discussion of a new direct deposit policy for Deschutes County. About 36% of employees are supportive, and it is felt that this makes the program viable. There is no real cost to the County after initial setup fees; and in the long term, it could save the County money. It is a voluntary program. Discussion of minor partition 90-57, creating three parcels of over ten acres off Cascade Estates Drive. Discussion of the repurchase of real property off Third Street between Heierman and Mayfield, outside of La Pine. This is part of Deschutes River Recreation Homesites, about five miles north of Burgess Road. The Property Manager wants to view the property and report back to the Board. Discussion of MP -90-5, a minor partition of an existing lot in Gemstone Estates off Archie Briggs Road. Mr. Throop said the Bend City Commission is planning to move forward on the adoption of a backyard burning ordinance. They won't do this unless Deschutes County does the same thing. The County learned about this from newspaper articles. He is supportive. Mr. Maudlin said he has gotten calls from people who are in the UGB who needs to burn pastures every year. There will be a ten-day window to burn twice a year in the rural areas. This is already regulated by the Fire Departments. Discussion of the work of the Central Oregon Fire Task Force. There are three priorities for this group, based on the Awbrey Hall Fire debriefings. One is to have a command center for this kind of event in Central Oregon. All other agencies want to be involved with this. Supposedly FEMA will cover 80% of costs related to a command center, and the State might cover the additional 20%. However, a logical site has to be identified. Another priority is getting the word out pre -season to the public. There has already been a wildfire in La Pine. Another recommendation is communications: internal within agencies, and external between agencies and the public. Among other ideas, there is talk about two dedicated phone lines for dealing with the media. There will be a meeting soon of anyone who is interested in pursuing this command center idea. The Sunriver Owners' Association has gone on record as opposing any effort to incorporate.
