DESCHUTES COUNTY BOARD OF COMMISSIONERS

February 4, 1991; 10:00-11:15 AM.
A meeting of the Board of County Commissioners was held on February 4, 1991.
Commissioners present were Nancy Pope Schlangen, Tom Troop and Dick
Maudlin. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; and other staff and a few citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Discussion of Court funding, to be addressed later in the week by Judge
Mosgrove.
Discussion of the acceptance of two warranty deeds for the Ward Road right of
way acquisition.
Discussion of a public hearing on Ordinance No. 91-002, amending PL -15 relating
to site plan review requirements for a surface mining zone.

Staff explained that DLCD reviewed the ordinance and found some problems,
particularly concerning DOGAMI comments. (A lengthy discussion occurred.)
DOGAMI does not regulate blasting or deal with some of the safety concerns.
These are issues that no one has dealt with very well. It is a statewide problem.
Mr. Maudlin asked about the provision regarding the regulation regarding asphalt
plants being within two miles of vineyards. Since there are no vineyards here,
the wording was removed from the ordinance. LCDC also wanted exploration for
minerals left in the ordinance.
Discussion of an intergovernmental agreement between the County, the District
Attorney and the Sheriff regarding distribution of asset forfeitures. Mike Dugan
explained there are similar agreements with the three cities that are being
considered. He went into detail regarding the agreements.
Discussion of a public hearing on an Order transferring County -owned property
adjacent to a ball field in Redmond. It is about 2.5 acres.
Discussion of a public hearing on a final Order, annexing Wells Ackerman territory
into Deschutes County Rural Fire Protection District. It is located southeast of
Knott Landfill.
Discussion of a cooperative agreement with the State Highway Division and the
City of Redmond regarding the Yew Avenue interchange. Mr. Maudlin said he
understood that the State is doing all of it, but the agreement says there will be a
negotiation process. He wants to delay this action a couple of weeks, pending
there is further review.
Discussion of an indemnity agreement for an off-road race in the Millican Valley in
February.
Discussion of a development agreement for Dolo Enterprises for construction of a
mini -storage facility and car wash, located on Third and Huntington Roads in La
Pine.

Discussion of three appointments to the Historical Landmarks Commission.
Discussion of the appointment of Gene Padgett to Riverbend Estates Special Road
District.
Discussion of the reappointment of Karen Grimm to Vandevert Acres Special Road
District.
Discussion of the signature of minor partition 90-65 for S & E Associates, for two
parcels, one of which is approved for a manufactured home park. This is located
on the west side of 27th Street. The Board had questions about the park and will
discuss it further later in the week.
Discussion of a minor partition, No. 90-71, creating two parcels.
Discussion of an upcoming meeting regarding the County Administrator and
Counsel; also, a Library Department meeting.
Mr. Throop said he is meeting with a Division of State Lands representative in
Sisters later today, with Dave Leslie from CDD, regarding a major violation in
Squaw Creek.
Discussion of the Clean Air Committee's upcoming meeting with the
Commissioners.
Discussion of a draft County fee proposal, for the management team to review,
for presentation to the Department Heads.
Discussion of a memo regarding Health Services' request for an increase in
expenditures relating to hold agreements with the hospitals.
Discussion of urban growth management issues, and planning a meeting with the
appropriate staff.
Discussion of an upcoming meeting relating to using hand-held devices for traffic
citation stops.

Discussion of the transportation system and problems with ingress and egress,
especially around Cooley Road. There is a problem with Public Works issuing
driveway permits when Community Development says it should be issued due to
potential problems with the sites. Local builders are confused and not happy
about this situation. The Board wants to meet with the department heads to
work on this.
Discussion of several issues with Juvenile Director Denny Maloney:
Regarding the new Community Corrections Act for Juveniles, which is picking up
steam. It has been heavily supported by the CSD. There was a long discussion
about the program and its funding structure. Mr. Throop was not optimistic,
because it is a new idea and involves tax money.
There has been a threat of deep cuts by the legislature, and groups are working to
protect these funds.
Discussion of the Youth Conservation Corp assisting the counties with various
projects.
Discussion of the Sagebrush Coalition, and the pressure being felt as a result of
Measure 5. It is widely felt that a sales tax is the fairest and most logical way to
handle the shortfalls, while helping out at the property taxation level. There was
also discussion about a kicker tax refund. Certain taxes would sunset once a sales
tax goes into effect. It was felt that it would be cowardly not to support this sales
tax effort. Something needs to replace the revenue that is being lost through
Ballot Measure 5.
Discussion about renting an efficiency apartment in Salem, to save on costs when
department representatives and/or Commissioners are spending a lot of time
there to gain support of County issues. It would be necessary to arrange for
housekeeping services.
