A meeting of the Board of County Commissioners was held on February 25, 1991. Commissioners present were Nancy Pope Schlangen and Dick Maudlin. Commissioner Tom Throop was out of the office. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; and other staff and a few citizens. Items discussed at this meeting may be on a future Board business meeting agenda: Discussion of the adoption of Ordinance 90-007, and problems administering it since then. County Counsel went over the changes including lot line adjustments and issuing permits. Discussion occurred regarding the authority of the Planning Director and whether the decision of the Director was something that could be appealed. A discretionary decision cannot be appealed except to a Hearings Officer. This adds to the number of appeals that can occur. Transcription of Audio Recording of a Work Session, February 25, 1991 Page 1 of 4 This has become an issue because of a decision regarding a transmission line for Central Electric Cooperative. Flaws in the appeal process were discovered and County Counsel feels these should be tightened up. (There was a lengthy discussion between the Board, Counsel and CDD staff about a variety of recommended changes.) Discussion of a public hearing of an appeal of the Hearings Officer's denial of a conditional use permit for a farm dwelling on a forty -acre parcel in the EFU zone. This is in the Alfalfa area. The primary issue is that it was determined that the entire forty acres is an alfalfa field and the dwelling would have an impact on the amount of farmland developable on the parcel. This is different than a grazing operation where there might be no non-farmable areas. Discussion of a hearing approving the annexation of territory into the Sisters - Camp Sherman Rural Fire Protection District. Discussion of a public hearing on the designation of Skyview Terrace Subdivision as an area where the discharge of firearms should be prohibited. This is located at the southeast corner of Bear Creek Road and 27th Street. There have been a lot of complaints about shooting activities there since it is near BLM land. Discussion of signature of an Order regarding the vacation of a portion of the old Cline Falls Road. Discussion of the approval of the purchase of crushed rock for projects in the Lower Bridge area. Discussion of Resolutions accepting a petition regarding the vacation of a portion of Willamette Valley and Cascade Mountain roads. There will be some controversy regarding access to the river for fishing, so an easement will need to be established. Discussion of the demolition landfill and the use of part of the site by the BMX group. The issue of permits has become complicated, so this was postponed for another week. Discussion of a transport fee increase. Discussion of the Jordan Bridge closure option. An inspection indicated that people should not be using this bridge. Staff is interested in replacing the bridge with an aluminum arch bridge. The Director would like to find out if there is a need for the bridge at all, by meeting with people in the area. It would not cut off any access, but would inconvenience a few residents. There was a lengthy discussion about this issue. Discussion of the acceptance of a deed of dedication. Discussion of Order 91-023, approving and confirming sale of tax foreclosed properties. The total amount was about $159,000. Discussion of approval of a memorandum of lease of an Awbrey Butte property. Discussion of an order establishing an imprest cash account for Legal Counsel, to handle small litigation issues. Discussion of reimbursement of the fund for the maintenance and supervision of County lands. Discussion of signature of an indemnity agreement with Pro -Cam -Am Racing in the Millican area. Discussion of approval of the renewal of a liquor license application for La Siesta Cafe on South Highway 97. Discussion of a minor partition, creating two parcels off Ward Road, and signature of the Mylar. Discusison of approval of a liquor license application for Erikson's Market in La Pine. Discussion of the approval of a final Mylar for McKinney Butte Ranch, creating four lots. Discussion of the reorganization of, and new office procedures in the District Attorney's Office. D.A. Mike Dugan was disappointed that Mr. Throop was not in attendance, given his strong opinions at their last meeting about how the D.A.'s Office was being run. Mr. Dugan went into great detail about how his office is structured, and an efficiency study that was done on the department a few years ago. (This meeting continued for nearly two hours.) I certify that the above is a true and accurate record of a meeting, as reproduced from a cassette tape identified as Minutes of a Meeting of the Deschutes County Board of Commissioners, held on February 25, 1991.
