DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
February 8, 1993; 10:00-11:30 AM.
A meeting of the Board of County Commissioners was held on February 8, 1993.
Commissioners present were Nancy Pope Schlangen and Tom Troop.
Commissioner Barry Slaughter was the victim of an accident and was not able to
be present. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; the media, other staff and a few citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Discussion of Resolution 93-007, proclaiming the month of March as "Red Cross
Month". Doug MaGuire of the Red Cross explained the item and then read the
proclamation.
Discussion of approval of creating a video poker lottery fund, which goes towards
Health services as well as to law enforcement and economic development
programs.

Discussion and a presentation on the use of lottery dollars for the gambling
addiction program. Frank Moore and Roger Kryzanek of the Health Department
provided an overview of the program and services offered by the County.
There was also a long discussion about the negative effect that gambling is having
on the community.
Mr. Throop said that during the 1991 session, the Board was unanimous in its
opposition of the lottery program.
Discussion and a presentation regarding the formation of a board of directors for
the Deschutes Children's Foundation. This group would be separate from the
Deschutes County Children & Youth Commission. Suki Waller, staff, gave an
overview of the item.
Discussion of a plan amendment to the Children & Youth Services Commission's
1991-93 comprehensive plan. Ms. Waller explained this item as well. There will
be a future meeting with the Board to go into more detail.
Discussion of the Children & Youth Services Commission's comprehensive plan for
1993-95. Ms. Waller provided an overview, noting that they still have some work
to do on this. She noted that there are over 120 volunteers involved in this
program.
Discussion of the appointment of Wes Price to the Solid Waste Advisory
Committee. He was recommended by Larry Rice of Public Works. He indicated
that he will be requesting that the Board extend the terms of office for four other
members of the Committee. He feels it is important for them to stay involved
during the extensive landfill planning process.
Discussion of signature of the acceptance of a warranty deed for right of way on
Brookswood Boulevard. Mr. Rice gave an overview of the location.

Discussion of signature of Order 93-002, denying a petition to vacate a portion of
Sisemore Road. Mr. Rice explained that County Counsel feels this is an
appropriate action.
Discussion of signature of Resolution 93-002, accepting a petition to vacate a
portion of Blue Eagle Road in Vandevert Acres South subdivision, and setting a
public hearing for the vacation. There is some local controversy regarding this
situation.
Discussion of signature of Orders authorizing expenditure of funds for
maintenance of 17 roads until they can be annexed into the City of Bend.
Discussion of signature of Orders establishing 34 roads into the County
maintained road system.
Discussion of signature of Ordinance 93-006, amending Title 15 regarding building
and construction codes and regulations. Staffer Dan Hines gave an overview of
the change, which will make the County's code consistent with what the State has
established.
Discussion of signature of a development agreement for the La Pine Funeral
Home.
Discussion of signature of two road dedications, adjacent to Butler Market Road.
This is necessary to widen the road in the future.
Discussion of authorizing the Property Manager to option excess water rights on
the new Jail site. The County has over six acres of water rights, and four are
needed for landscaping at the site. The other two acres have been deemed
excess.
Swalley Water has an option to purchase program to put excess water to preserve
it for the district. They would pay $250 an acre over five years, and the County
would not have to pay yearly fees. There is not a market for water in the Swalley
District at this time. This has to be addressed this week.

The Board advised staff to proceed as explained.
Discussion of approval of an agreement with the Washington County Juvenile
Department for residential treatment services.
Discussion of approval of an amendment to the Deschutes County Community
Correction Plan.
Discussion of signature of tax refund Order 93-070.
Discussion of a decision on a conditional use permit for a livestock arena, to divide
a 20 -acre parcel into two 10 -acre parcels in an MUA-10 zone.
Discussion of upcoming meetings: the Board liaison update, administrative staff
meeting, Solid Waste disposal meeting, Community services meeting, and a
meeting to address the Deschutes housing solution.
Discussion of an upcoming public hearing, with Board review of the Hearings
Officer's decisions regarding conditional use permits for five non-farm dwellings
and one farm dwelling, which includes a minor partition.
Discussion of a possible code enforcement action involving Jeff King and Cooper.
Discussion of supplementing the County's workers compensation program,
especially when dealing with someone who might make significantly more money
than most at the County. This has become an issue due to Commissioner
Slaughter's unfortunate accident.
Mr. Throop asked County Counsel what happens if a majority of the Commission
has to conflict out of a land use decision. He wanted to know if the Board can be
bypassed and the issue go directly to LUBA. Mr. !sham said that the person is
expected to set aside any bias and decide anyway. However, this can be
challenged by the public.

Mr. Throop said he is asking not because of personal gain, but more based on his
philosophy and personal opinion. This has to do with developer T.M. Pete issue.
Mr. (sham stated that the burden of proving bias is on the appellant. This has to
be raised on the record.
