A meeting of the Board of County Commissioners was held on July 20, 1992. Commissioners present were Nancy Pope Schlangen, Tom Troop and Dick Maudlin. Also in attendance were Rick Isham, County Counsel; County Administrator Mike Maier; and other staff and a few citizens. Items discussed at this meeting may be on a future Board business meeting agenda: Discussion of the establishment of a portion of Camp Polk Road. Staff went over a map of the area. A part of the road has been rebuilt to address some safety issues. Discussion of Oregon State Health Division budget revision #1, for mental health services. Discussion of approval of Order 92-076, changing the name of Buck Canyon Road to Pocahontas Lane. There is a Buck Canyon Drive, and they don't connect. Transcription of Audio Recording of a Work Session, July 20, 1992 Page 1 of 6 Discussion of several other road name changes. Discussion of a decision on the realignment of Brookswood Boulevard. A few people living in the area said they were not aware this was happening. Paul Blistad explained that the School Board set this up and had a couple of alternate plans. This was clarified to the local residents and they had the opportunity to attend the hearing that was already held. Mr. Throop said he wants to meet with Public Works staff to determine why that particular location was selected. Mr. Maudlin suggested that staff just show up at the Board meeting and explain it then. Discussion of a public hearing required to readopt Ordinance 91-022, providing for the placement of manufactured homes in the R-4 zone in the Redmond urban area. This was previously adopted but an error was found regarding the sunset clause. The City of Redmond is still discussing whether manufactured homes should be allowed in this zone. The Board would like to extend the sunset clause to allow time for this to take place. A couple of the Commissioners felt that the City was getting far too selective in their requirements. Discussion of a County policy regarding accepting donations of land. There was a request from a Realtor representing a landowner who wants to donate the land because they don't feel they can build on it. Most of the area is swampy and a septic approval would be impossible. The property is valued at $3,000 and about $60 is due in taxes. The County does not have a policy for accepting properties. The alternative is foreclosure, but that involves the cost of the foreclosure process. Staff indicated that the County needs to see a title report and would need a warranty deed, and that all taxes would need to be paid up. Transcription of Audio Recording of a Work Session, July 20, 1992 Page 2 of 6 This is in an area with moderately high deer migration routes as well, so it does have some value with respect to wildlife. Staff explained the process to foreclose and how long it takes, as well as the costs involved. Mr. Maudlin said this is the second time in eight years that they have had a request like this, and thinks that since each situation and parcel are different, they should address them as they come up instead of instituting a policy. Ms. Schlangen said that the three requirements noted are probably the way to go in each situation. The other Commissioners agreed. Discussion of a development agreement for the Rasmussens regarding an MUA- 10 zoned parcel in a landscape management zone. Discussion of approval of a conservation easement in an LM zone. Discussion of liquor license renewals for Bend Speedy -Mart and M.J.'s Terrebonne Tavern. Discussion of the appointment of Don Harmon and Ellie Waterston to the Deschutes County Children & Youth Services Commission. Discussion of extending closing of a land sale to Rusty Hurdle for property at 9th Street and Reed Market Road. They are waiting for approval from the City of Bend. Discussion of a contract regarding intermediate sanctions guidelines for the Department of Corrections. Mr. Isham said that the program has changed; he went into lengthy detail. The Board asked for more information, which Mr. (sham will obtain when discussing this with the Sheriff's Counsel, Sue Brewster. Discussion of upcoming meetings with Public Works, the County Administrator and County Counsel; as well as the Sheriff, Jail Administrator, Community Corrections, and another meeting with Public Works regarding recycling services. Transcription of Audio Recording of a Work Session, July 20, 1992 Page 3 of 6 Discussion of a meeting with members of the La Pine Chamber of Commerce Economic Development Committee at the Midstate Electric conference room in La Pine. Mr. Throop said he obtained maps of the zones and the rural service center in that area, as well as a list of permitted and conditional uses in each of those zones. The Property Manager will also attend so they can talk about the process of handling applications for the industrial park. There is also some interest in possible incorporation, but it is unknown if that topic will come up. Mr. Maudlin said he is in favor of this. Staff said that one issue that may come up is the zoning for the BLM land that is being transferred into private ownership, as a result of the greater exchange process. Staff does not have an answer to this yet. They have to examine the surrounding zoning. Discussion of a public hearing to take testimony on the Deschutes County periodic review order. Discussion of upcoming meetings with the County Treasurer, the County Librarian and the District Attorney. Discussion of the six homes lost in the Sage Flat wildfire. The County did waive permit fees for one those owners, and another request is coming. The assumption is that these fees will be waived for all six, upon their request. This is what the County did in regard to the Awbrey Hall wildfire. Some of them may not rebuild. They have to demonstrate that the insurance coverage won't cover all or part of the permit fees, but this was not asked of the one who already received a waiver. He asked if the Board wants to allow for a process to allow this. If the structure is destroyed more than 50%, the people would lose their non -conforming status. Some homes have been built in parts of the subdivision that are partially within a farm use zone. It was determined that the County will deal with this on a case -by- case basis. Discussion of the Buffet Flat issue. It appears that parts of the Hearings Officer's decision are not legal, in regard to water and a septic system. Mr. Maudlin said that this should go back to the Hearings Officer. The parties involved have been very critical of the planning staff, yet want some concessions made. Mr. Throop feels that they should get together with these parties, along with staff from CDD and Legal, to talk about the issues. Mr. Maudlin said this is not being handled as it should, but he doesn't think the Board needs to be involved in it. CDD needs to work it out. There was then a lengthy, heated discussion involving the Commissioners and staff about how to proceed. Discussion of forest receipts funding and whether there is an update to this issue. Mr. Maudlin explained that he spoke with a Forest Service representative, who explained that the County should get about $3 million; however, that it is not guaranteed. An article in the Bulletin said that the County was not going to get this much. It still has to be divided up with the cities. It was decided that they would not advise the cities of this until the County actually has received the promised funding.
