DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: BUSINESS MEETING
June 17, 1992; 10:00-11:30 AM.
A meeting of the Board of County Commissioners was held on June 17, 1992.
Commissioners present were Nancy Pope Schlangen and Tom Troop.
Commissioner Dick Maudlin was absent. Also in attendance were Rick Isham,
County Counsel; County Administrator Mike Maier; and other staff and a number
of citizens.
This was a regular business meeting of the Board of Commissioners. Chair
Throop said that items #1 through #10 are on the consent agenda and were
thoroughly discussed by the Board on Monday. The Board then approved the
consent agenda.
#11 is a public hearing on Order 92-047, forming the Fall River Estates Special
Road District, and setting a November election date. Bruce White, Assistant
County Counsel, gave a brief staff report. He explained the process to establish a
Road District.

There were a number of citizens present who wished to speak regarding this item.
The Chair opened the public hearing.
Bob Lovlien, attorney for the petitioners, testified at length on the importance of
forming the District and the history of the development. He noted that the
purpose of the election is to let the residents decide if they want to take this
important step.
Various members of the development then testified, for or against the Road
District. It was explained that voluntary collection of funds to maintain the roads
has been at about 60%. This is not fair to those who are paying for it now, and
should be paid by all. The biggest concern at this point is the bridge, which needs
to be upgraded or replaced.
It was explained by the Board that this would be somewhat like a small
municipality, and the County would have no jurisdiction over it. Staff then
provided a very lengthy explanation of the nature of Road Districts, their powers
and how they interact with governmental entities.
After testimony and a long discussion, the Board took action on putting the
measure on the ballot for election. Both Commissioners voted that it could
benefit the area.
#12 was consideration of signature of findings and decisions on CU -92-6 and MP -
92 -5. This was deferred for a week.
#13 was consideration of filing as intervener in the PacifiCorp relicensing of the
Bend hydroelectric dam. This was moved and approved.
#14 was consideration of approval of accounts payable vouchers in the amount of
$87,119.80. This was moved and approved, upon review.
#15 was consideration of a right of way license to landscape a portion of the right
of way on Neff Road, adjacent to Providence subdivision. This was moved and
approved.

#16 was consideration of signature of a grant agreement with the Marine Board
and the U.S. Forest Service to install composting toilets at Cultus Lake. This was
moved and approved.
#17 was consideration of reappointments of several people to the Deschutes
County Bicycle Advisory Committee. This was moved and approved.
#18 was a discussion with George Read of CDD regarding hearings to be held by
DLCD all over the State regarding the secondary lands issue. One will be here. He
asked if the County should go on record as supporting the package as it now
exists. There will be another hearing before the Commission before it is finally
adopted.
He went into great detail on how well these changes apply to lands on a local
basis. He feels the Board should go on record at this point with at least a letter,
supporting the broader context. The Board agreed to have staff draft, sign and
send it an appropriate letter.
#19 was information from the Board of Commissioners. Staff said the County's
brief was filed with the Land Use Court of Appeals regarding the destination
resort appeal of the County's ordinance. There has been an intervention by Eagle
Crest but they did not file a brief. The biggest concern, especially from Jim
Gardner, was about the proposed Smith Rock destination resort situation. There
is opposition to this, with arguments set for next week.
The Board discussed upcoming meetings. One is in regard to Courthouse security
issues and also converting the use of some facilities.
At this time, the Board met as the governing body of the Deschutes County 4-H
and Extension District.

The only agenda item was consideration of a transition agreement changing one
employee's position from State to County. This has to do with a reduction of
hours. This was moved and approved.
The Board convened as the governing body of the 7th Mountain County Service
District. The Board considered signature of Order 92-061, eliminating the
Bancroft bond redemption fund and providing for transfer of ballots for the
District. This was moved and approved.
