DESCHUTES COUNTY BOARD OF COMMISSIONERS
Audio Cassette Recording Titled: WORK SESSION
January 25, 1993; 10:00-11:30 AM.
A meeting of the Board of County Commissioners was held on January 25, 1993.
Commissioners present were Nancy Pope Schlangen, Tom Troop and Barry
Slaughter. Also in attendance were Rick Isham, County Counsel; County
Administrator Mike Maier; the media, other staff, and a fairly large number of
citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Discussion of Board review of the Four Rivers Vector Control District program.
Bruce Landolt gave an overview of the item. He said they are not yet able to use
an ultralight aircraft for application purposes due to insurance issues, but are still
working on this.
Discussion of approval of a decision on a 20 -acre parcel being divided into two 10 -
acre parcels.

Discussion of signature of Order 93-002, vacating a portion of Ponderosa Cascade
Drive and Sisemore Road.
Discussion and an update on the bridge replacement at Spring River Road/Harper
Bridge. Staff indicated that funding and the project itself are on schedule.
Discussion of acceptance of a bargain and sale deed from Arthur Pozzi for Brinson
Boulevard, from Boyd Acres Road to Butler Market Road.
Discussion of the establishment of fifty roads into the County maintained road
system. Staff indicted that these are all subdivision roads. Some were improved
through local improvement districts, or were improved by the developer at the
time. Some were able to be taken in years ago, but are now being included with
others.
Discussion of signature of a text amendment to Title 18, to add utility facilities
and schools as uses allowed in the MUA-10 zone.
Discussion of a continued public hearing on the proposed annexation of property
into Cloverdale Rural Fire Protection District. There was an error in the legal
description as advertised, so this will have to be renoticed.
Discussion of a public hearing on Ordinance 93-002, a text amendment to Title 18,
regarding flood plain zone standards.
Discussion of signature of Order 93-067, tax refunds.
Discussion of signature of plat MP -91-41, creating two 10 -acre parcels on MUA-10
property at the intersection of Highway 20 and Peterson Ridge Road.
Discussion of consideration of signature of MP -92-25, dividing 41 acres into two
parcels at 16570 Serpentine Drive in La Pine.
Discussion of the companion animal overpopulation issue. This is not a public
hearing, but a discussion between Commissioners and staff, although the
Commissioners may ask questions of members of the Task Force, however.

Mr. Throop said the Task Force provided excellent materials for their
recommendations. He asked County Counsel about the statutory authority to
approve an animal service district to cover what is desired.
Mr. Isham said the only one in section 609 is what they have established now,
with a Dog Control Board of Supervisors. There would be no way to set up a
separate funding system outside of the collection of license fees or similar
revenue.
He said all the activities they mentioned would be allowable, except for setting up
a taxing district. Any tax measure would have to be referred to the voters. The
cities would have to be a full partner in whatever is decided about the overall
issue.
Representatives of the group were asked to speak, including representatives of
the Sheriff's Office. They indicated that they certainly intended to include the
cities. Mr. Throop said that there could be more difficulty developing this in
Oregon than in other states, because Oregon does not address this issue at great
length.
The group wants to focus on what can be done, and not what can't, since dealing
with the legislature is very time-consuming. Mr. Throop said the Jackson County
model might be the best fit. He asked the group to come back with a more
specific plan. A representative of the group asked that County Counsel help with
this, since he is familiar with local and state law.
Mr. Throop said Counsel can probably give an idea of the maximum authority
allowed. Mr. (sham seemed hesitant to get involved. Mr. Throop felt it would be
a really hard sell to get a new special district formed.
The Board was asked if it would be possible to create a County animal control
services department to do the things this group would like to see accomplished.
Mr. Throop said this is legally possible, but unlikely that the County would set up
another whole department. They'd have to be absolutely certain that it would
pay for itself.

Mr. Isham advised that Jackson County is a home rule county, so things can be
done differently there.
The spokesperson said that there are some things that the County could do right
away that could begin to make an impact, like the license fees. Mr. Throop said
there is a backlog in County Counsel's work and it would take months to get
hearings on the docket to deal with those changes. He said that the group needs
to refine what they want to do and bring it back.
Mr. Maier suggested that the group meet with the cities and get a feeling for how
supportive they would be. It was noted that some counties have animal control
as a department already. Mr. Throop suggested that the group find an animal -
loving attorney who might be able to work through this process.
Discussion of possible locations to provide some veterans' health services.
