Audio Cassette Recording Titled: WORK SESSION
January 24, 1994; 10:00-11:30 AM.
A meeting of the Board of County Commissioners was held on January 24, 1994.
Commissioners present were Nancy Pope Schlangen and Barry Slaughter.
Commissioner Tom Throop was out with the flu. Also in attendance were Rick
Isham, County Counsel; County Administrator Mike Maier; the media, other staff
and a fairly large number of citizens.
Items discussed at this meeting may be on a future Board business meeting
agenda:
Discussion and an update regarding equipment for the new jail facility. Sheriff
Greg Brown indicated that the Data Processing Department staff does not have
enough manpower to do all the required work on a timely basis. It has been
recommended that someone who is qualified be hired to do this work on an
hourly basis.

He anticipates that the total cost will not exceed $7,000, and that the person
could be hired locally. He will come back to the Board with a more refined
proposal.
Discussion of the release of a revisionary clause on real estate located on First
Street in Redmond.
Discussion of approval of a video lottery grant application for the Access to Equity
Capital project. Gary Capps of the Bend Chamber of Commerce provided
background about the program, which is directed at business expansion and
retention. The County was asked to put about $2,500 from video poker funds
into this program.
There was a lengthy discussion about the merits and details of this proposed
program. The Board will make a decision at this week's business meeting.
Discussion of a public hearing on the 73rd Street local improvement district.
Discussion of an upcoming hearing on the Cooley and Empire connector project.
Tom Blust gave an overview of the transportation plan for that area. There has
already been a hearing on this issue but there have been a few adjustments to the
plan. The project stops at Yeoman.
There is pressure to get this work bid and done soon, before the new school
opens.
Discussion of approval of the vacation of an alley in Block 31 in La Pine, between
First and Second Streets.

Discussion of the award of work for the China Hat Road bridge widening project.
Developer Jan Ward widened the road and put in curbs, but it is the County's
responsibility to deal with the bridge.
Discussion of approval of Order 94-011, to determine a uniform set of policies and
establish rates for franchise services. There were numerous representatives of
the solid waste haulers present. Staff explained that Emco was retained to do a
rate study last year, and they recommended that the cities, County and collectors
get together to devise some policies to guide the development of rates in the
future.
Some areas of concern were depreciation schedules, and the relationship
between income and expenses — or, the before tax profits. A consensus of the
group was reached, the results submitted to Emco, and Emco came back with
some recommended changes. The haulers are concerned about some of the
revisions.
Staff went into detail at length about the changes and the responses submitted by
the haulers. If the policies are adopted, they would then be sent out to the cities
of Bend and Redmond for review.
Chair Schlangen advised the audience that it would be better if they spoke when
there is a full Board, so this will be addressed at the Wednesday Board business
meeting.
Discussion of approval of Resolution 94-007, referring the OSU/Extension tax base
to the voters.
Discussion of a position description for Donna Brandon. Staff is not yet prepared
for this item.

Discussion of the USGS groundwater study in La Pine. Dave Leslie explained that a
number of dates have been set for meetings to talk about water issues. He went
over a report from the USGS to the County and other agencies talking about their
work to date. Everyone is satisfied with the technical field work that has gone
into the project so far, by USGS and Water Resources.
There should be additional progress reports provided on a quarterly basis.
Sometime in this calendar year, they should be able to present some preliminary
conclusions and ideas.
A similar study is being done in Warm Springs, and they are starting to advise the
irrigation districts of the early results and possible solutions. There are several
possible pieces of federal legislation that will need to be approached on a
regional, basin -wide basis. This will help address some issues relating to fish
passage and water shortages.
The Bureau of Reclamation has also come out with its own water study on the
Deschutes Basin, as a part of its water conservation efforts. One result were canal
lining demonstration projects. The Bureau also completed a water quality
analysis.
Mr. Leslie then spoke at length about the financial commitments from State and
Federal agencies to get this work done. Ms. Schlangen said she spoke with the
Governor, who has indicated that she will find the funds to cover the shortfall in
the near future.
Mr. Leslie said the Deschutes Basin Resource Committee is trying to find
additional funding from partners as well.
Discussion of signature of a ballot measure for the formation of the Port of La
Pine. Staff said that this may not be ready by the business meeting.
Discussion of signature of Order 94-007 and Order 94-008, authorizing the refund
of taxes.

Discussion of approval of an indemnity agreement for The Lobos Hare Scramble
event.
Discussion of a letter from U.S. Bank acknowledging rewriting an equipment lease
at a lower rate, for the 9-1-1 District. This will lower the rate to 5% interest and
save the District about $36,000 over the life of the lease.
Discussion of approval of an application for funds for the Dispute Resolution
Commission, and approval of a contract with the Victim - Offender Reconciliation
program.
Discussion of authorization to intervene in the 1,000 Friends of Oregon's appeal
of the farm zone periodic review order. Staff explained that the main party
involved is LCDC, since it is their order that is being appealed. However, this
situation is a little different.
Ordinarily the LCDC would defend the County, but staff feels that the County
should intervene to make sure its interests are adequately protected. Staff thinks
that there is some level of disagreement at LCDC. This would be an appeal at the
Court of Appeals.
Staff was authorized to file the appropriate documents and develop appeal
paperwork accordingly.
Discussion of approval of the appointment of Steve Lonian (?) to the Bend
Cascade View Estates Special Road District board of directors.
Discussion of the 2% equal tax initiative. Several citizens asked to make a
presentation. Display material was distributed and set up. A lengthy
presentation then took place, with most of the discussion not caught by the audio
recording equipment.
